May 24, 2010 - Naharnet - STL Prosecutor's Spokeswoman Achouri Resigns

The spokeswoman of the Special Tribunal for Lebanon's prosecutor, Radhia Achouri, has announced her resignation.In a statement issued Sunday, Daniel Bellemare's spokesperson said it was time for her to resign after a year of work with the STL. She said she was leaving The Hague, where the tribunal is based, on May 29 "to return home." Achouri added that her experience at the prosecutor's office was beneficial.

AFTER 12 months of investigations into the 2005 assassination of former Lebanese prime minister Rafiq Hariri, no one has been charged and four high-ranking generals considered suspects have been allowed to go free.

The NSW Police Deputy Commissioner, Nick Kaldas, who served as chief investigator of the Special Tribunal for Lebanon established by the UN to investigate the Hariri assassination, said there was no guarantee there would be prosecutions.

He is confident, however, that the whole picture of the incident in which a car bomb killed Hariri and 22 others, will soon emerge.

It had been widely believed that Syria was behind the assassination, but more recently the Shiite militant group Hezbollah is believed to be implicated.

''What I can say is the evidence and material and information the tribunal gathers will eventually be placed by the prosecutor where it ought to go,'' Mr Kaldas said. ''It's his decision whether it needs to go to a court or some other forum. There are a number of options open to him.

''I would not say there is certainty that it will be a prosecution. It could go quite a number of ways.''

But a case like this, so intensely political, is not without pitfalls. Opinion in Lebanon is divided between those who want the tribunal to succeed and those who want it to stop investigating.

The intense public interest and scrutiny of his work surprised him, Mr Kaldas, a NSW former homicide investigator, said.

The tribunal was set up to end the ''culture of impunity'' where political killings go unpunished, he said.

''A human being along with a number of other innocent victims were assassinated. This is simply about finding out what happened and bringing to justice those who were responsible.''

While he was away, Mr Kaldas missed out on the job as the head of the Australian Federal Police, but said he has no regrets.

عاشوري لـ"النهار": سأعود إلى الأمم المتحدة
قدّمت الناطقة الرسمية باسم مكتب المدعي العام الدولي راضية عاشوري استقالتها من منصبها.
وقالت في بيان: "حان الوقت ان اقول وداعاً بعد اكثر من عام من العمل مع المحكمة الخاصة بلبنان بصفتي ناطقة باسم المحكمة. سأترك هولندا في 29 ايار 2010 لاعود الى وطني وبلدي. وآخر يوم عمل لي في المحكمة هو 27 ايار (بعد غد). اعتبر ان تجربتي في عملي مع مكتب المدعي العام ثرية جداً واشعر بالامتنان لذلك".
واضافت: "ان مكتب المدعي العام في طور البحث عن بديل مني ليتم تحديد ناطق باسمه".
وعن سبب قرارها قالت عاشوري لـ"النهار": "اغادر لانني بكل بساطة اريد العودة الى الامم المتحدة حيث كنت قبل الانضمام الى المحكمة، وسأنضم الى مجال قوات حفظ السلام خارج نيويورك. هذا كل شيء".
بدأت عاشوري عملها في مطلع آذار 2006 بصفة ناطقة باسم رئيس لجنة التحقيق الدولية سابقاً سيرج برامرتس. وهي تونسية، وقبل تعيينها كانت تشغل منصب ناطقة باسم الممثل الخاص للامين العام للامم المتحدة في السودان يان برونك. وخلفت نصرة حسن الناطقة باسم اول رئيس للجنة التحقيق الدولية ديتليف ميليس.

سوريا تسأل الإمارات عن «الشاهد الملك»
تبلغ اللواء الركن جميل السيّد من محاميه في دمشق بأن السلطات القضائية السورية وجهت خلال الاسبوع الماضي كتاباً رسمياً الى السلطات في دولة الإمارات العربية المتحدة، تستوضحها فيه عن مصير «شاهد الزور» محمد زهير الصديق، المطلوب استرداده الى سوريا والذي «اختفى» في الإمارات في ظروف غامضة بعدما أنهى مدة سجنه لديها بجرم دخولها بجواز سفر تشيكي مزوّر. وأفاد محامو السيد بأن الطلب الرسمي السوري الى الإمارات جاء بناءً على مراجعة قضائية تقدموا بها منذ أسبوعين الى قاضي التحقيق الاول في دمشق، بعدما وردت معلومات متناقضة عن مصير الصديق، إحداها أنه عثر عليه مقتولاً مطلع الشهر الحالي على الطريق الصحراوي المؤدي من إمارة دبي الى أبو ظبي، وأن سلطات دولة الإمارات لا تزال تتابع تحقيقاتها وتتكتم عن الجريمة تحسباً لانعكاساتها، بينما أفادت معلومات اخرى بأن اختفاء الصديق يعود الى كون السلطات الاماراتية قد زوّدته بجواز مرور مؤقت في الثلاثين من شهر نيسان الماضي وأبعدته الى بلجيكا التي وافقت على استضافته كلاجئ «إثر الضغوط والوساطات التي مارستها مراجع استخبارية عربية وأجنبية، بناءً على طلب فرقاء في السلطة اللبنانية ممن تورّطوا معه في مؤامرة شهود الزور لاتهام سوريا والضباط الأربعة» بحسب ما ورد في بيان صدر أمس عن مكتب السيّد.
الصدّيق يحظى باهتمام استثنائي عربي وأجنبي، وبرعاية لبنانيّين
يضيف البيان إن «طلب الفرقاء في السلطة اللبنانية» جاء من أجل «الحؤول دون تسليمه (أي الصديق) إليها، مما كان سيكشف الادوار التفصيلية لكل منهم في تلك المؤامرة، وحيث كانت السلطات الاماراتية قد هددت بأنها ستلجأ الى تسليم الصديق الى بلاده ما لم يُقبل به في بلد آخر لأن الامارات لم تعد تستطيع تحمّل المراجعات السورية لاسترداده. وقد جاءت موافقة بلجيكا بحجة أنه كان سيتعرّض لعقوبة الإعدام لو سُلّم الى سوريا». وختم البيان: «بانتظار الجواب الرسمي من دولة الامارات الى السلطات القضائية السورية، إن ما يتأكد يوماً بعد يوم، أن الصديق يحظى باهتمام استثنائي عربي وأجنبي، وبرعاية وتمويل لبنانيين من فرقاء في السلطة، لا لشيء إلا لكونه رأس الخيط الذي يختبئ خلفه المتورّطون في جريمة اتهام سوريا والضباط الأربعة زوراً، من خلال مؤامرة تضليل التحقيق الدولي في اغتيال الرئيس رفيق الحريري، وحيث لا يجوز في أي حال للمحكمة الدولية في لاهاي أن تقف موقف المتفرج أو المتبرّئ من ملاحقة هذه القضية التي تؤثر على صدقيتها».

May 24, 2010 - YaLoubnan - STL spokesperson resigns

Radiya Ashouri, Special Tribunal for Lebanon (STL) spokesperson said in a statement that she has resigned from her post at the tribunal.

“The time has come after one year of work with the Special Tribunal for Lebanon to say goodbye in my capacity as the spokesperson for the STL’s general prosecutor,” Ashouri said in the statement.

Ashouri’s last working day would be May 27, he statement said adding that she will leave The Hague, where the STL is located , on May 29 to return home.

Ashouri pointed out that her work experience in the general prosecutor’s office was “calm and beneficial.”

“I am grateful for that,” she said, adding that the general prosecutor’s office has begun searching for a replacement.

STL was created to try the killers of Lebanon’s former PM Rafik Hariri . Hariri was assassinated on Feb 14 , 2005.

Officials from the Special Tribunal for Lebanon (STL) have stated that they expect charges to be filed in the Hariri murder case between September and December of this year.

May 24, 2010 - CNN - Obama to talk security with Lebanon's prime minister

Lebanese Prime Minister Saad Hariri meets with President Barack Obama on Monday on his first official visit to Washington.

Washington (CNN) - Lebanese Prime Minister Saad Hariri meets with President Barack Obama on Monday on his first official visit to Washington after assuming office, the White House announced.

The two are expected to talk about a broad range of issues, including regional peace and security.

These are the first face-to-face talks between the two men since the United States moved to put an ambassador back in Syria, a country with which Lebanon has a difficult relationship.

Washington pulled its ambassador from Damascus in 2005, after Hariri's father, former Prime Minister Rafik Hariri, was killed in a huge car bombing, which the United States blamed on Syria.

Syria denied the accusations, but an investigation by a United Nations Special Tribunal found Syrian government involvement.

The 2005 bombing led to massive protests in Lebanon, prompting Syria to withdraw the troops it had kept in Lebanon for decades.

Hariri has also made moves to improve relations with Syria.

The Obama administration wants to renew dialogue with Syria as part of a wider effort for establish regional peace.

It nominated veteran diplomat Robert Ford, an Arabic speaker, to serve as ambassador in February. He has not yet taken up the post.

قدمت الناطقة باسم المدعي العام في المحكمة ذات الطابع الدولي الخاصة بلبنان راضية عاشوري استقالتها من منصبها.
وقالت في بيان صادر عنها، ان «الوقت حان بعد عام من العمل مع المحكمة الخاصة بلبنان كي أقول وداعاً بصفتي المتحدثة باسم المدعي العام»، معلنة أنها ستترك لاهاي في التاسع والعشرين من أيار (مايو) الجاري «عائدة الى بلدي»، وأن اليوم الأخير لها في المحكمة سيكون في السابع والعشرين منه.
وأعلنت أن تجربتها في العمل في مكتب المدعي العام كانت هادئة ومفيدة، و «أنا ممتنة لذلك». ولفتت الى أن مكتب المدعي العام في طور البحث عن بديل لها.

Prime Minister Saad Hariri seems determined to visit a different capital city every day, and we believe this is a good tactic that opens the door to benefit Lebanon.

Some wags might have it that Hariri is jetting about the world because his Cabinet back home remains utterly inert; and no, the premier is not trying to put Foreign Minister Ali Shami out of a job.

Hariri is merely following a wise plan to hear firsthand the various foreign agendas that largely shape the political landscape here.

Hariri began his tour Sunday in Saudi Arabia, holding talks with King Abdullah bin Abdel-Aziz. On Tuesday he visited Damascus and on Friday met with Jordan’s King Abdullah II. On Saturday Hariri will make stops in Cairo and Ankara before departing on Sunday for the United States, where he will meet on Monday with President Barack Obama.

Certainly, it also carries much import that Hariri will on Wednesday speak before the UN Security Council, which Lebanon is presiding over this month, and that he will meet with the head of International Monetary Fund.

But Hariri’s travels, aside from helping to carve out a niche and identity for himself, will translate into a much more meaningful discussion with Obama and the Security Council’s members. To be sure, Hariri will be asking what Obama and the Security Council can tell him about Israel’s military intentions, but the prime minister’s fresh awareness of the regional dynamic will allow him to judge much more soundly the two major issues which will determine Lebanon’s coming course – issues which he can affect.

The first is the UN Special Tribunal for Lebanon; all of Hariri’s recent powwows should help him to figure out how he needs to react to the tribunal’s future trials as this country’s prime minister – and not as the son of the former prime minister whose assassination led to the tribunal’s formation.

The second is the US-Iran showdown. Much more diplomatic grappling awaits – in the US push for new sanctions in the UN Security Council, in whether Iran follows through on its promise to ship out some of its low-enriched uranium to Turkey – but after returning from the US, Hariri should know how he needs to proceed with Hizbullah, in order to prevent Lebanon from paying a steep price when the deadlock takes a wrong turn or ends in military action.

Hariri needs all the knowledge and regional backing he can muster to eke out a deal with Hizbullah that allows domestic factions to unify enough to keep Lebanon out of harm’s way should the regional scene deteriorate. Lebanon is deeply divided, we know; but if Lebanon is to avoid becoming the battlefield of larger powers yet again – indeed, if it to be stable at all – the deal that cinches cooperation is going to be between Hariri and Sayyed Hassan Nasrallah.

ادعى على «شاهد الزور» بجرم التحريض واختلاق الجرائم
«حزب الله» يطالب القضاء بتوقيف الصديق وتحريك «الانتربول» للقبض عليه
في تطور لافت للانتباه, اتخذ «حزب الله» صفة الادعاء على شاهد الزور محمد زهير الصديق وكل من يظهره التحقيق فاعلا أو شريكا أو متدخلا أو محرضا, وذلك بجرم اختلاق جرائم وتحريض وقدح وذم وافتراء.
وارتكزت دعوى «حزب الله» المقدمة الى النيابة العامة في بيروت, على ما أورده «شاهد الزور» في مقابلته الاخيرة مع صحيفة «السياسة» الكويتية في نيسان الماضي, واتهم فيها كوادر في «حزب الله» بالتورط في اغتيال الرئيس رفيق الحريري. وطالب القضاء اللبناني بإلقاء القبض على الصديق ومحاكمته, وإصدار مذكرة توقيف بحقه وإبلاغ الانتربول الدولي بذلك وفقا للاصول.
جاء في نص الدعوى الآتي:
1 ـ الموضوع : اختلاق جرائم وتحريض وقدح وذم وافتراء.
2ـ القاء القبض على المدعى عليه وتوقيفة ومحاكمته وفقا للمواد 217 و218 و385 و386 و403 في قانون العقوبات اللبناني. وإصدار مذكرة توقيف بحقه وإبلاغ الانتربول الدولي بذلك وفقا للاصول.
في الوقائع:
نشرت صحيفة «السياسة» الكويتية في عددها رقم 14894 تاريخ 12/4/2010 مقابلة صحافية مع المدعى عليه مجهول الاقامة تحت عنوان وبالخط العريض الصديق لـ«السياسة» كوادر من «حزب الله» متورطة في اغتيال الحريري ومن ثم لتبدأ المقابلة:
«اذا كان نصر الله يعتقد ان 7 مايو قد يتكرر فهو مخطئ اذ لا أحد يجرؤ على ترهيب المحكمة, بعض سياسيي حزب الله أشبه بأفراد عصابات شيكاغو» لتنتقل الى الفقرة الاولى من المقابلة وتبدأ بالقول
اتهم ضابط المخابرات السورية السابق محمد زهير الصديق الذي يعرف بـ«الشاهد الملك» في قضية اغتيال الرئيس الشهيد رفيق الحريري كوادر من حزب الله بالتورط في الجريمة...
وفي الفقرة الثانية :.... استغرب الصديق حديث الامين العام لحزب الله السيد حسن نصر الله عن شهود الزور رغم ان القرار الظني لم يصدر بعد, معتبراّ ان بعض سياسيي حزب الله أشبه بأفراد عصابات شيكاغو وان المقاومة أشرف من ان تحتضنهم.
وفي الفقرة الرابعة أقر الصديق بأنه دخل الامارات بجواز سفر تشيكي مزور وقال انه لم يكن على علم بذلك, كاشفاّ انه حصل عليه من مكتب الرئيس الفرنسي نيكولا ساركوزي عندما كان الاخير وزيرا للداخلية.
وفي الفقرة الخامسة يجيب عن سؤال.... لقد تم إعطائي هذا الجواز من مكتب الرئيس الفرنسي .... وقيل لي انه مخصص لحماية الشهود في قضية الحريري وبعدها وصلتني معلومات ان تنسيقا جرى بين المخابرات السورية والمخابرات الفرنسية وأنا لن أتنازل عن حقي في إقامة دعوى أمام القضاء الفرنسي ضد من زودني بهذا الجواز..
وفي السؤال عن ان الامين العام لحزب الله شكك بصدقية المحكمة واشتراط اعتقال شهود الزور
أجاب الصديق ان هناك كوادر من حزب الله متورطة لوجستياّ في عملية اغتيال الرئيس الحريري ولا يعلم اذا كانت قيادة حزب الله على علم بذلك.
وفي سؤال آخر ... كيف يتحدث نصر الله عن شهود الزور وقرار الاتهام لم يصدر بعد؟
يجيب الصديق اذا كان يعتقد ان 7 مايو قد يتكرر, فهو مخطئ, اذ لا أحد يجرؤ على ترهيب المحكمة .....
أما في السؤال انك ضد المقاومة؟ يجيب الصديق:
«لا يعقل ان من لديه ذرة شرف ان يكون ضد المقاومة, انما أنا ضد من يحاول أن يتستر بعباءة المقاومة ويوجه طعناته الى الداخل, ومن يستمع الى تصريحات سياسي حزب الله يعتقد انهم من افراد عصابات شيكاغو والمقاومة أشرف من أن تحتضن هؤلاء الناس».
وفي سؤال عن التنسيق بين الاستخبارات السورية وقيادة حزب الله على الساحة اللبنانية وفي الامور السياسية والامنية البسيطة فكيف بقضية الحريري. أجاب الصديق انه «إبان الحكم السوري في لبنان أي عمل أمني صغير أو كبير كان يتم بالتنسيق بين حزب الله والقيادة السورية عبر المخابرات العسكرية السورية».
سنكتفي بهذا القدر من الوقائع المتعلقة بحزب الله, ولن نناقش في التفاصيل المتعلقة بالغير ولا يفهم من ذلك اننا موافقون على تفاصيلها او اننا نقر بصحتها.
في القانون:
في الشكل:
حيث ان نيابتكم الموقرة صاحبة الاختصاص وفقا للمادة 13 من قانون اصول المحاكمات الجزائية في اقامة الشكوى كون المدعى عليه المجهول الاقامة لما صرح به وتناول موضوع اغتيال الشهيد الرئيس رفيق الحريري وكون الجريمة من اخطر الجرائم المقترفة.
في الاساس:
حيث ان المدعى عليه «الشاهد الملك» قد سبق وأعلنت الناطقة باسم لجنة التحقيق الدولية أمام الرأي العام وعلى مسمع من جميع وسائل الاعلام الفضائية والدولية عدم صدقية المدعى عليه المذكور.
وحيث ان كل ما يتحدث به ويصدر عنه بواسطة وسائل الاعلام المكتوبة أو المسموعة أو المرئية تعتبر ادعاءات ساقطة وكاذبة وافتراء بحق المدعين.
وحيث ان كوادر «حزب الله» الذين نعتهم ووصفهم بالعصابات والمافيات وحرفيا عصابات شيكاغو.
وحيث ان العنوان العريض الذي يختصر المقابلة الصحافية باتهام كوادر من حزب الله متورطة في اغتيال الحريري يشكل جرما جزائيا بحد ذاته ان جريمة القتل المتعمدة من قبل الفاعلين المجرمين يعاقب عليها وفقاّ للمادة 549 من قانون العقوبات.
وحيث ان المدعى عليه ثبت كذبه وافتراؤه في توجيه التهم الى كوادر حزب الله بقتلهم الرئيس الشهيد رفيق الحريري هو محض افتراء وكذب.
وحيث ان المادة 403 من قانون العقوبات اللبناني تنص صراحة في موضوع اختلاق الجرائم والكذب وتنص في فقرتها الاخيرة على ما يلي:
اذا أفضى الافتراء الى حكم بالاعدام او بعقوبة مؤبدة فلا تنقص عقوبة الاشغال الشاقة عن عشر سنوات ويمكن ابلاغها الى خمس عشرة سنة.
وحيث ان الافتراء هذا والجرائم المختلقة تتطابق مع المادة المذكورة, لذا يتوجب تطبيق المادة المذكورة بحق المدعى عليه.
وحيث ان المدعى عليه يسيء مباشرة الى الامين العام لحزب الله السيد حسن نصر الله بحديثه عن 7 ايار بهدف اثارة نعرات طائفية ومذهبية على الساحة اللبنانية بل التحريض وخلق الفتنة مستغلاّ اغتيال الشهيد الرئيس رفيق الحريري. وحيث ان المادة 217 من قانون العقوبات لجهة التحريض تنطبق على المدعى عليه فلذلك يتوجب تطبيقها بحقه.
وحيث ان المدعى عليه في الفقرة التاسعة من المقابلة يتهم حزب الله بالتآمر والتنسيق بشأن كل كبيرة وصغيرة وبأنه شريك في اغتيال الرئيس الحريري.
وحيث ان هذه التهمة تنطبق على المادة الآنفة الذكر مواد 217 و402 من قانون العقوبات.
وحيث ان المدعى عليه يوافق السائل بأن حزب الله والنظام السوري يمارسان اقصى الضغوطات عل جنبلاط للتراجع عن إفادته.
وحيث ان هذا الافتراء والكذب والتحريض في ممارسة الضغط على جنبلاط لتغيير إفادته لا ندري ما هذا الخيال الواسع والاستشعار عن بعد فكيف عرف وعلم وهو في عالم السندباد, يختلق التهم والجرائم بحق حزب الله وقيادته وكوادره دون رادع ولا عقاب.
وحيث ان استمرار المدعى عليه وتماديه في جرائمه واتهاماته يشكل خطرا ويلحق الاذى المعنوي بالمدعين ويؤدي الى الفتنة في حال السكوت على ما يصدر عنه بين الحين والآخر.
لذلك, ولهذه الاسباب, ولما ترونه عفواً:
1ـ فإن المدعي يتخذ صفة الادعاء الشخصي بحق المدعى عليه وكل من يظهره التحقيق فاعلا أو شريكا أو متدخلا أو محرضا.
2ـ إلقاء القبض على المدعى عليه وتوقيفه ومحاكمته وفقا للمواد 217 و218 و385 و386 و403 في قانون العقوبات اللبناني وإصدار مذكرة توقيف بحقه وإبلاغ الانتربول الدولي بذلك وفقا للاصول.
3ـ إلزام المدعى عليه بدفع العطل والضرر الذي نترك تقديره للقضاء المختص.
4ـ تدريك المدعى عليه الرسوم والمصاريف وأتعاب المحاماة.

علّق المدير العام للأمن العام السابق اللواء الركن جميل السيد، على نفي نائب رئيس المحكمة الخاصة بلبنان، القاضي رالف رياشي، إدلاءه بما أدلى به لـ«الأخبار» في 12 أيار، الذي نُشر في عدد 13 أيار (الخميس الفائت)، فقال «اطّلعت على حديث رياشي لـ«الأخبار»، وقبل أن أُصدر بياناً أستنكر فيه تصريحاته، التي أسقط من خلالها عن نفسه صفة النزاهة والحيادية، وأدعو كاسيزي إلى اتخاذ قرار في هذا الموضوع، بادرت إلى الاتصال بصحيفة «الأخبار»، وتأكدت حينذاك أنّ القاضي رياشي قد أدلى بما أدلى به حرفياً، وبدون أدنى شك، وخصوصاً أنّ الصحافي الذي نقل عنه هذا الحديث قد جزم بصحّته، وباستعداده لمواجهة القاضي رياشي بهذا الواقع، لذلك، عندما سمعت أمس نفي القاضي رياشي شخصياً للوكالة المركزية للأنباء، وقرأت اليوم (عدد أمس) في «الأخبار» نفياً صادراً عن المحكمة الدولية لمصلحة رياشي، فوجئت فعلاً، ورأيت أنه لم يعد يجوز بقاء القاضي رياشي لحظة واحدة في عضوية المحكمة الدولية، لأنه عندما لا يقول القاضي الحقيقة، ويتهرب من المسؤولية بهذه الطريقة لا يكون أهلاً للحكم في أية قضية، فكيف إذا كان الأمر في قضية اغتيال الرئيس رفيق الحريري؟».
وتابع السيّد قائلاً «إنّ هذه الفضيحة الجديدة يجب أن تدفع مجدداً إلى المطالبة بإقالة القاضي رياشي فوراً من المحكمة الدولية، وإلى دعوة مختلف القوى السياسية الفاعلة في لبنان، من المعارضة والموالاة، إلى أخذ هذا الأمر بمنتهى الجدية، حفاظاً على سمعة المحكمة الدولية وصدقيّتها».
لتفعيل التفتيش القضائي
وتعليقاً على «الرسالة» التي نُقلت من رئيس هيئة التفتيش القضائي القاضي أكرم بعاصيري إلى «الأخبار» يوم أول من أمس (نشرت في عدد أمس)، والتي قال فيها القاضي بعاصيري إنه «ليس في قاموس هيئة التفتيش شيء اسمه «أحد كبير» في المحاسبة أمام القضاء ووفقاً للقانون، حتى ولو كان القاضي سعيد ميرزا نفسه، أو اللواء جميل السيد أو أيّ أحد آخر»، استغرب السيّد صدور
دعا الرئيس كاسيزي لإتخاذ قرار بشأن نائبه القاضي رياشي
مثل هذا الكلام عن قاض «محترم، وفي حال ثبوت صحّة الرسالة التي ذُكر أنه بَعَث بها، أقول إنّ صاحب الحقّ أكبر من القاضي ومن التفتيش القضائي، وإنّ من حقّ القاضي أن «يستقوي» على القاضي ميرزا، لكن ليس من صلاحيته أن يتوجّه بهذه الطريقة الى أيّ مواطن لبناني آخر، ولا سيّما أنّ صلاحيته محصورة فقط بمحاسبة القضاة».
وفي سياق صلاحيات هيئة التفتيش القضائي، دعا اللواء القاضي بعاصيري إلى «إثبات قوّته من خلال فتح الملفات العديدة المجمّدة لدى التفتيش بحق القاضيَين ميرزا وصقر صقر في قضية الاعتقال السياسي والتعسفي، ورعاية شهود الزور في قضية اغتيال الرئيس رفيق الحريري، وخصوصاً أنّ وزير العدل إبراهيم نجار اعترف في مناسبة سابقة علناً بوجود تلك الملفّات».
وإذ تمنّى السيد أن تكون الرسالة المنسوبة إلى القاضي بعاصيري غير صحيحة، أمل في المقابل أن تقوم هيئة التفتيش برئاستها بالإسراع في فتح تلك الملفات، مبدياً استعداده الشخصي لـ«التقدم من الهيئة وإبراز جميع المستندات التي تدين القاضيَين ميرزا وصقر، وتثبت تجاوزاتهما ومخالفتهما لأبسط القوانين، بما في ذلك توخي المصلحة الشخصية من جانبهما على حساب العدالة في قضية الرئيس الحريري»، ودعا السيّد «القضاء إلى محاسبته إذا لم يستطع إثبات كل ما تقدم ذكره. عندها فقط يثبت القاضي بعاصيري أنْ «لا أحد فوق هيئة التفتيش القضائي بالفعل لا بالقول، وفي خلاف ذلك يكون على تلك الهيئة ألف رحمة وسلام».

As-Safir newspaper reported on Friday that Hezbollah has filed a lawsuit against Mohammad Zuhair as-Siddiq, for new accusations that the group’s members were involved in the 2005 assassination of former Prime Minister Rafik Hariri.

Kuwaiti newspaper As-Seyassah reported last month that Siddiq, a Syrian agent who allegedly misled the UN probe into Hariri’s murder, had resurfaced in Europe after serving jail time in the Gulf. In that article, he renewed previous claims that Syrian and Lebanese leaders were involved in the late prime minister’s assassination, but added this time that Hezbollah was also involved.

As-Safir newspaper reported that Hezbollah’s lawsuit, which was filed with the public prosecutor in Beirut, cites Siddiq’s interview with As-Seyassah.

A clarification from President of the Special Tribunal for Lebanon (STL) Judge Antonio Cassese was published Wednesday in The Daily Star over an article written in the English-language daily two days earlier.

In an article titled “STL’s Bellemare to press charges in Hariri case by fall”, the paper reported on Monday that Cassese said STL Prosecutor Daniel Bellemare was likely to issue an indictment between September and December of this year.

However, Cassese’s clarification said charges “will depend on when the prosecutor determines there is enough evidence to support the submission of an indictment.”

“There are indications the prosecutor might submit an indictment by December 2010,” he added.

فعبّر في حديث للصحيفة عينها، عن خشيته بألا يكون قد عبّر عمّا يريد قوله "بشكل صحيح، فما عنيت قوله هو وجود مؤشرات لإمكانية أن يصدر المدعي العام قرارات ظنية بحلول كانون الأول 2010".

President of the Special Tribunal for Lebanon Judge Antonio Cassese clarified what was published by the English-language Lebanese newspaper The Daily Star on Monday, May 17 that STL Prosecutor Daniel Bellemare could file charges by the end of the year.
"On the issue of when an indictment might be forthcoming, I am afraid I did not express myself correctly. What I in fact intended to say was that there are indications the Prosecutor might submit an indictment by December 2010. I am sorry that I unwillingly caused this misunderstanding. Let me also add that of course the issuance of an indictment will depend on when the Prosecutor determines there is enough evidence to support the submission of an indictment," Cassese said in a clarification published by the same newspaper on Wednesday.

On Monday, a front-page article published by The Daily Star quoted Cassese as saying: "Prosecutor Bellemare announced that he is likely to issue an indictment between September and December of this year."

May 19, 2010 - Naharnet - Hariri-Assad Hold 4-Hour Meeting Described as 'Very Good'

Prime Minister Saad Hariri held four hours of talks with Syrian President Bashar Assad on Tuesday ahead of a visit to Washington scheduled for May 24.

"The talks were very good," Hariri told the daily Al-Liwa after his return home from Syria.

Hariri believed the meeting with Assad comes in the framework of "consultations" between the two countries.

"I am very satisfied with my meeting with President Assad," he said.

Al-Liwaa said Hariri will visit Jordan on Friday for talks with King Abdullah II.

Hariri's trip, his second official visit to Damascus, follows accusations by Israel and the United States that Syria and Iran are continuing to supply the Lebanese Shiite movement with arms and undermining regional stability. Hariri has rejected these allegations.

Hariri is due to meet U.S. President Barack Obama on May 24 and is expected to address the United Nations Security Council the following day.

Lebanon is currently a non-permanent member of the Security Council.

Syrian presidential adviser Bussaina Shaaban hailed the improving ties between Lebanon and Syria.

"Since his last visit to Damascus, relations (between the two countries) have deepened...President Assad warmly welcomes this visit which aims at coordinating policy ahead of (Hariri's) trip to Washington," she told the pro-government Al-Watan newspaper.

"We look favorably on every Arab visit to Washington that explains the Arab position," she added.

Israeli President Shimon Peres sparked controversy last month when he accused Syria of supplying Hizbullah with Scud missiles, a claim Damascus has staunchly rejected.

U.S. Defense Secretary Robert Gates made similar accusations in April, saying Syria and Iran were providing Hizbullah with rockets and missiles of ever-increasing capability.

During Hariri's December visit to Syria, the first since the 2005 assassination of his father, ex-premier Rafik Hariri, he expressed his desire for "privileged, sincere and honest relations...in the interest of both countries and both peoples."

Hariri and his allies from the majority March 14 coalition have in the past blamed Syria for the murder and for a series of subsequent political assassinations in Lebanon. Damascus has denied any involvement.

Syria dominated Lebanon for nearly three decades until April 2005 when it pulled out its troops under international and regional pressure, two months after the assassination of Rafik Hariri.

The two countries established diplomatic ties for the first time in 2008, with Syria opening an embassy in Beirut, while Lebanon opened its mission in Damascus in March 2009.(Naharnet-AFP)

Prime Minister Saad Hariri traveled to Saudi Arabia on Monday as part of an Arab tour ahead of his scheduled meeting with US President Barack Obama in Washington on May 24.

He met with Saudi King Abdullah bin Abdel Aziz to discuss developments in the region and the prospects for strengthening bilateral ties, the National News Agency (NNA) reported.

The PM will today meet with Syrian President Bashar al-Assad after his visit with Kuwaiti Sheikh Sabah al-Ahmad al-Jaber al-Sabah.

Hariri said that the sheikh’s visit to Lebanon is “an additional entrance to strengthen the cooperation between our two countries and root deeply the present understandings that flow in this direction in a positive and open way.”

Speaking to the KUNA Kuwaiti news agency, Hariri said that Lebanon has not forgotten Kuwait’s assistance toward achieving political stability.

Meanwhile, President of the Special Tribunal for Lebanon (STL) Judge Antonio Cassese told The Daily Star newspaper in an interview published on Monday that a list of charges in the case of former PM Rafik Hariri’s assassination will be presented at the end of 2010.

He quoted STL Prosecutor General Daniel Bellemare as saying the list may be presented between September and October.

However, he declined to give details about the list, saying that Bellamare had not informed the judicial council about the identity of any of the accused.

In regional news, on Monday, three-way talks in Tehran between Iranian President Mahmoud Ahmadinejad, Brazilian President Luiz Inacio Lula da Silva and Turkish PM Recep Tayyip Erdogan culminated in the signing of an agreement that would send low-enriched Iranian uranium to Turkey in exchange for enriched reactor fuel.

The agreement stipulates that Iran will formally notify the International Atomic Energy Agency (IAEA) of the deal within one week.

Iranian Foreign Ministry spokesperson Ramin Mehmanparast told reporters that it would then be up to the IAEA to inform "the Vienna group" – the United States, France and Russia – of the proposal. Should the Vienna group accept the deal, the new accord says Iran would deliver the uranium to Turkey within a month and would expect to receive the nuclear fuel from the world powers within a year.

The new agreement responds IAEA demands, EU foreign affairs chief Catherine Ashton said Monday. However, White House spokesperson Robert Gibbs said that the US would not halt or slow its drive for toughened sanctions on Iran.

May 18, 2010 - L'Orient le jour - Assassinat Hariri : Bellemare publiera un acte d’accusation en automne, affirme Cassese

Dans une entrevue accordée au quotidien anglophone Daily Star, le président du Tribunal spécial pour le Liban, Antonio Cassese, a indiqué que le procureur, Daniel Bellemare, compte publier son acte d'accusation à l'automne prochain.
« Le procureur Daniel Bellemare a annoncé qu'il émettra probablement un acte d'accusation entre septembre et décembre de cette année ». « C'est ce qu'il m'a dit, c'est ce à quoi je m'attends », a affirmé M. Cassese.
Le président a toutefois indiqué qu'il n'avait aucune information au sujet des coupables potentiels ou quelque détail que ce soit sur l'enquête menée par M. Bellemare.
« Je n'ai aucune idée (à ce sujet) car nous sommes très stricts... Le procureur ne dévoile jamais des informations (concernant l'investigation) devant qui que ce soit au sein du tribunal », a ajouté M. Cassese.
À noter que le bureau du procureur, Daniel Bellemare, qui a été contacté par le journaliste du Daily Star pour un commentaire, n'a pas répondu à sa requête.
Par ailleurs, et toujours dans le cadre de cet entretien, le président du TSL a indiqué que le tribunal devra se démener pour trouver des donations suffisantes pour nourrir le budget de l'année prochaine car les coûts additionnels pour le procès devraient être collectés auprès d'États qui financent le TSL et dont les économies respectives sont affectées par la crise, notamment en Occident. « Le problème se posera l'année prochaine car si nous avons un procès cette année-là - ce que je souhaite vivement -, nous devrons alors recruter du personnel. »
Le budget de 2009 s'est élevé à 51,4 millions de dollars et celui de 2010 à 55,4 millions, dont 49 % sont assurés par Beyrouth.
Par ailleurs, le TSL a annoncé hier qu'il accueillera le procès de l'ancien président libérien Charles Taylor conduit par le Tribunal spécial pour la Sierra Leone (TSSL) à compter du 17 mai 2010. Le TSSL cessera d'occuper la salle d'audience de la Cour pénale internationale (CPI) à La Haye, précise le communiqué.
Un protocole d'accord a été signé entre le TSL et le TSSL concernant ce transfert. En vertu de ce protocole, le TSSL s'acquitte de l'ensemble des frais liés au procès.
« La nouvelle salle d'audience du TSL a été mise à la disposition du TSSL dans un esprit de coopération entre les tribunaux. Les travaux du TSL se poursuivront et ne seront pas perturbés par ce transfert », ajoute le texte.

Tribunal president: Heads of State not immune from international law

BEIRUT: Special Tribunal for Lebanon prosecutor Daniel Bellemare plans to file charges this fall, tribunal President Antonio Cassese told The Daily Star in an exclusive interview on Saturday.

“Prosecutor Bellemare announced that he is likely to issue an indictment between and September and December of this year,” Cassese said. “This is what he said … This is my expectation.”

Cassese added that he did not have any information about the potential culprits or the details of Bellemare’s probe. “I have no idea, because we are very strict … The prosecutor does not tell anything [about the investigation] to anybody within the tribunal,” Cassese said. Bellemare’s office did not respond to a request for comment.

The UN Security Council established the court to try suspects in the February 2005 assassination of former Prime Minister Rafik Hariri, although the tribunal has a mandate to pursue the perpetrators behind assassinations, attempted killings and political violence from October 2004 through January 2007. Hariri’s killing sparked a wave of popular demonstrations which brought about the withdrawal of Syrian troops from Lebanon after a 29-year presence. Syria has always denied any involvement in Hariri’s assassination.

At the same time, Cassese believes the tribunal will struggle to find enough donations for its budget next year, because the added costs of a trial would run into state budgets shrunken by the economic crisis afflicting the Western nations bankrolling the court. Lebanon pays 49 percent of the tribunal’s annual budget, which for 2010 amounts to $55.35 million.

“There is no problem [with financing] this year,” said Cassese who also served as the first president of the International Criminal Tribunal for the former Yugoslavia. “The problem will be next year, because if next year – as I very much hope – we have a trial, then we will have to recruit staff.”

Critics have assailed the tribunal as a political tool for the US and its allies to pressure Damascus and Hizbullah. Syrian Foreign Minister Walid Moallem has said that Syria had received offers to terminate the tribunal in return for facilitating a presidential election in Lebanon. Cassese said that no one had spoken to him about political goals for the tribunal and that charges of politicization were “totally wrong.”

Since the UN voted in May 2007 to form the court, “the whole process has never been political or politicized,” said Cassese, who added that when he headed the Yugoslav tribunal and the International Commission of Inquiry on Darfur he rejected ambassadors’ requests for political favors.

“When we are going to pronounce upon a case brought before us, this will be done by us without any political considerations. We will never attach any importance to the political repercussions. I don’t care about political grounds. I go ahead and do my job.”

Experts on international law have said it remains unclear how far the tribunal could go in any case to pursue high-ranking politicians, because the court’s statutes do not address whether heads of state enjoy immunity from the court. While Cassese said he could not comment on his court’s jurisdiction, he added that he had previously published his opinion that international tribunals did not have to respect diplomatic immunity because of the serious nature of the crimes they deal with.

“As an academic studying international law, I am on record … I have always argued that, as the International Court of Justice rightly pointed out, heads of state do not have functional immunity – that means that immunity because of the exercise of their functions while they were incumbent,” Cassese said.

“They enjoy personal immunities, however, before national courts. Before international tribunals they don’t enjoy any immunity whatsoever.”

The tribunal has also battled negative perceptions over the exodus of key personnel. Since being officially established in a suburb of Holland’s The Hague in March last year, the tribunal has witnessed the exits of the chief of investigations and two registrars – the officials who act as the court’s chief executive. Cassese said that all international courts experienced high rates of staff turnover, but the departures were usually connected to outside issues such as family or more lucrative job opportunities.

“I know that when [registrar Robin Vincent] left and then when [Vincent’s successor] David Tolbert left, people said, ‘So there is something wrong with this tribunal,’” Cassese said. “This happens all the time because these are international institutions where people are, in a way, taken away from their own countries. You don’t have friends. You don’t make friends in The Hague. I only go out to dinner with ambassadors or judges. So you get fed up.”

Cassese resigned from his post as president of the International Criminal Tribunal for the former Yugoslavia because his wife threatened him with divorce, even though he relished the work, he said. “I myself left after seven years because my wife said, look, either you come back or I will divorce you,” he said. “I had no choice. I was very happy to work there. I enjoyed my job very much, but then I had a family problem.”

"Prosecutor (Daniel) Bellemare announced that he is likely to issue an indictment between September and December of this year," tribunal chief Antonio Cassese told the English-language newspaper The Daily Star.But Cassese refused to disclose information on the possible culprits."I have no idea... The prosecutor does not tell anything to anybody within the tribunal," he said.

The Hague-based Special Tribunal for Lebanon was set up by a UN Security Council resolution in 2007 to find and try suspects in the assassination of Hariri, a five-time billionaire prime minister who was killed in a massive bombing on the Beirut seafront on February 14, 2005.In its first annual report published in March, the tribunal announced investigators were getting closer to identifying the suicide bomber who carried out the attack.

A flurry of press reports over the past year said the UN court was readying to accuse Hezbollah operatives in the Hariri murder but the tribunal dismissed them as "mere speculation."Hezbollah chief Hassan Nasrallah has confirmed the team investigating the murder interrogated members of his party but in March said Hezbollah was not in the tribunal's line of fire.The Hariri murder has been widely blamed on Syria, a main backer of Hezbollah, although Damascus has roundly denied involvement. A UN commission of inquiry had said it had evidence to implicate Syrian and Lebanese intelligence services prior to the tribunal's formation, but there are currently no suspects in custody.

The work of the STL will continue to progress and will not be affected by the move," a press release issued by the STL said.

May 15, 2010 - Now Lebanon - Syrian PM says Damascus not worried about STL

In an interview with Tunisian Al-Sabah newspaper on Saturday, Syrian Prime Minister Mohammad Naji al-Ottari said that Syria does not fear the Special Tribunal for Lebanon (STL). Prime Minister Saad Hariri’s visit to Syria in December was a huge step in bridging the gaps between both countries, he added.

Ottari warned Israel against any offensive against Syria. He also said that Damascus would respond harshly to any Israeli attack and immensely affect the Jewish state.

This comes after Israel accused Syria in April of transferring Scud missiles to Hezbollah.

Iran’s nuclear program is for peaceful purposes, Ottari said, adding that any attempt to make the Arab world fearful of Iran aims to lift Arab pressure on Israel.

The Syrian PM also said that Syria is not interested in waging a war against Israel and instead is ready to enter talks to create a just and complete peace in the region.

Organisées sur plusieurs dimanches du mois de mai, les élections municipales libanaises ne soulèvent guère l’enthousiasme de la population. Le fort taux d’abstention, notamment dans la capitale où le vote chrétien vaut symbole de l’affrontement entre la coalition du 14 mars et les pro-syriens du 8 mars, signe le désaveu des électeurs pour un scrutin qui donne en général la pire des images du Liban: clientélisme exacerbé et mésalliances locales tentent de sauvegarder les intérêts politiques des grandes familles patriciennes.

Les Libanais se souviennent à peine de l’engouement pour les élections législatives de juin 2009, gagnées arithmétiquement mais dont la victoire leur a été confisquée dans les faits par la question des armements du Hezbollah.

Mois de juin : une « fenêtre à risque »

Seule la perspective de la saison estivale avec un nombre record de touristes européens attendus redonne le moral au pays du Cèdre. Et encore. Le soleil de l’été 2010 semble d’ores et déjà assombri. Sinon dangereusement encadré. La réunion du Conseil de sécurité sur les sanctions contre l’Iran, prévue en juin au plus tard, ouvre une « fenêtre à risque » selon un avis pour une fois partagé entre un expert israélien des questions de sécurité et un proche du Hezbollah. Juin ou plus tard, le Parti de Dieu s’attend inéluctablement à une guerre avec l’Etat hébreu. « Un mois, six mois ou deux ans, peu importe » résume l’un de ses partisans qui croit dur comme fer que « la confrontation se projettera cette fois-ci sur le territoire israélien ». Peur des bombardements ? « Nous avons des villes entières sous terre reliées par des galeries », se vante un autre de ses militants. Précaire équilibre de la terreur. Autre certitude avancée par le premier : après l’alliance renouvelée entre la Syrie, l’Iran et le Hezbollah lors de la récente visite à Damas du président Ahmadinejad, « la République islamique d’Iran, assure-t-on, ne restera pas inactive ». Pas d’espoir, fait-on en premier lieu remarquer à l’attention de la diplomatie française, de parvenir à découpler le grand voisin syrien du protecteur iranien. On précise en outre que cette visite a également permis de lever les zones d’ombres et la méfiance qui existaient entre le Parti de Dieu et les dirigeants alaouites depuis l’assassinat de Imad Moughniyé.

C’est cette même assurance qui sous-tend, toujours de ce côté-ci du fleuve Litani, l’analyse de la stratégie israélienne: engagé dans une course contre la montre, Israël alterne, estime-t-on au Liban, provocations et déclarations rassurantes. Et donne le sentiment d’être incertain sur l’issue d’un affrontement au cours duquel il tenterait de rendre complètement étanche la frontière entre la Syrie et le Liban, en obligeant la Communauté internationale à y déployer des soldats de l’ONU en échange d’un arrêt des hostilités. Simultanément convaincu de l’engagement iranien aux côtés de la milice chiite, l’Etat hébreu miserait par surcroît sur un conflit qui devrait automatiquement entraîner un soutien et une intervention militaires des Etats-Unis. Ce que Tel-Aviv, constate ce même interlocuteur, n’a pas encore obtenu en temps de paix.

Une nouvelle « ligne bleue » ?

Bien que le Hezbollah répète à l’envi que la guerre n’est pas pour demain, sa direction a pourtant envoyé une circulaire à tous les chefs d’établissement des écoles Al Hoda, financées par la milice et réputées accueillir les enfants de leurs responsables, leur demandant de terminer les cours fin mai. Un mois avant le terme ordinaire des enseignements annuels. Faut-il véritablement s’en alarmer? Quant à la question si sensible des nouveaux missiles parvenus à la formation pro-iranienne, elle ne semble plus faire de doute parmi les responsables de la sécurité, y compris ceux de l’ONU. Certains d’entre eux citent d’ailleurs les témoignages -des camions à rallonge qui circulent la nuit profitant des coupures de courant- discrètement recueillis auprès d’habitants de la ville de Machghara, localité la plus importante de la Bekaa Ouest, située sur la rive droite du Litani entre le poste frontière de Chtaura et le sud Liban.

Enfin, et dans la même veine, outre les attaques réitérées contre les patrouilles de la Finul par des villageois, les puissances occidentales s’inquiètent d’une récente ré-interprétation, par des responsables de l’armée libanaise, de la « ligne bleue » dix ans après son officialisation et le retrait israélien du Sud-Liban. Sur le terrain, des officiers libanais entendent distinguer une « première ligne bleue » de Naqoura au fleuve Wazzani d’une seconde, du Wazzani vers l’Est, le long de la frontière syrienne. Une deuxième zone qu’ils tiennent pour un « territoire occupé » et sur laquelle ils refusent de contenir, sinon de réprimer les manifestations croissantes des civils. Au point que des responsables de la Finul s’interrogent sur l’existence d’un « agenda caché » de certaines autorités du pays. Une situation suffisamment tendue pour provoquer la visite éclair le 24 avril à Beyrouth du Ministre égyptien des affaires étrangères, Ahmed Aboul Gheit venu, semble-t-il, demander à ses interlocuteurs libanais de « raisonner le Hezbollah ». Peine perdue selon un haut responsable chiite de Amal: « les dirigeants du Parti de Dieu sont convaincus du bien fondé de leur action » et « personne au Liban ne peut entreprendre quoi que ce soit contre eux ». « Pas même Saad Hariri » précise l’intéressé.

Les pressions de la Turquie

C’est sans doute ce qu’a bien saisi le leader druze Walid Jumblatt qui a tiré toutes les conséquences de la bataille de Choueifat entre ses militants et ceux du Hezbollah en mai 2008. Avant même les élections législatives de juin 2009, Walid Bey avait engagé des consultations en vue d’un rapprochement avec la milice chiite. Une orientation qu’il a depuis confirmée en annonçant son retrait de la coalition du 14 mars emmenée par Saad Hariri. Un retournement d’alliance qui est pourtant loin de faire l’unanimité au sein de ses troupes. Son souci clairement martelé de « protéger sa communauté », ne parvient pas à faire taire les critiques, certes toujours respectueuses envers le chef charismatique, mais qu’un chauffeur de taxi druze d’Aley résume à sa manière: « Oui à l’armée libanaise, non au Hezbollah ».

Serait-ce par surcroît une conséquence indirecte de la montée en puissance du Parti de Dieu, toujours est-il que la Turquie joue désormais un rôle explicite dans le « grand jeu » libanais. Pour la première fois en effet, Ankara a exercé des pressions directes sur les autorités de Beyrouth afin d’écarter la présence d’officiels libanais lors des célébrations du génocide arménien du 24 avril à Antélias, haut lieu de l’église arménienne et au grand stade de Bourj Hammoud où s’étaient rassemblées soixante mille personnes. Une manoeuvre vivement dénoncée par le responsable du parti Tachnag et député arménien du Metn, Hagop Pakradounian qui a lancé aux responsables politiques du Liban : « méfiez-vous de blesser la dignité arménienne ». L’activisme turc au pays du Cèdre ne s’arrête pas là, fait-on remarquer : Ankara finance depuis plusieurs années la « réimplantation des confréries soufies par l’intermédiaire d’influentes tribus implantées dans le nord du pays ». Sans compter la « construction d’écoles pour des Sunnites d’origine turkmènes de la région de Baalbeck » tout en établissant de nécessaires passerelles avec les familles chiites du sud, y compris au moyen d’une subvention pour un stade de football. Selon un diplomate de l’Ambassade américaine de Beyrouth, les Etats-Unis « voient d’un œil favorable ces initiatives turques », destinées à établir un niveau de protection contre les Chiites que l’Egypte ou l’Arabie saoudite ne sauraient garantir. Une « remise en cause de la démocratie consensuelle » qui ne laisse pas « d’inquiéter la communauté arménienne », assure de son côté Antranik Dakessian. Une communauté, précise le président de l’Université Haigazian, traversée par de profondes mutations: « un taux de natalité parmi les plus faibles en comparaison des autres communautés vivant au Liban », doublé d’une tendance à l’appauvrissement. « Seul un tiers des Arméniens se suffit économiquement, 30% vivent de soutiens financiers en provenance de l’étranger et le dernier tiers se situe très nettement en dessous du seuil de pauvreté », explique-t-il.

Un acte d’accusation du TSL à l’automne ?

Si rien ne venait contrarier la douceur de l’été libanais, l’automne pourrait s’accompagner de quelques perturbations. Malgré sa redoutable discrétion, le Tribunal Spécial pour le Liban ferait, selon de multiples sources sécuritaires, parler de lui dès la rentrée. Le bureau du Procureur a en effet considérablement intensifié ses investigations: celles-ci se sont récemment étendues à la Direction de la Sûreté générale et ce, malgré les réticences de son Directeur réputé proche du Hezbollah. Ce dernier a dû s’incliner devant l’injonction du Procureur général de la république. Sans dévoiler les noms et les empreintes qu’ils voulaient vérifier, des enquêteurs ont pu ainsi consulter librement les fichiers alphabétiques de l’organisme central des renseignements libanais. Simultanément, d’autres enquêteurs progressaient également sur l’identification d’acheteurs d’objets métalliques dont des pièces éparses ont été retrouvées sur les lieux de l’attentat. Pour le cas de Marwan Hamadé, Ministre proche de Walid Jumblatt blessé dans un attentat en 2004, le procureur serait, affirme-t-on à Beyrouth, en possession de tous les éléments judiciaires.

Contrairement aux estimations du Ministre libanais de la Justice sur un possible échelonnement des procédures afin d’éviter des troubles civils (voir Le Liban doit-il craindre le printemps 2010 ?) , des responsables onusiens s’attendent à un acte d’accusation qui publierait intégralement les noms de personnes impliquées dans l’attentat qui a coûté la vie à l’ancien premier Ministre Rafic Hariri en février 2005. Ceux qui s’interrogeaient sur l’indépendance et fustigeaient la lenteur du Tribunal Spécial pour le Liban semblent maintenant redouter les effets de sa dynamique et craindre les conséquences de sa détermination./.

May 12, 2010 - L'Orient le jour - Pour le juge Riachi, le procès par défaut se justifie par la nature du crime commis


Le juge Ralph Riachi (à gauche) aux côtés de Charif el-Masri et de Majed Fayad.Photo Michel Sayegh Assassinat Hariri Pour le second jour consécutif, les discussions se sont poursuivies à la salle de conférence Pierre Abou Khater à l'USJ autour des rouages du Tribunal spécial pour le Liban, en présence notamment du président du TSL, Antonio Cassese, du juge de la mise en état, Daniel Fransen, et de quelques juristes et magistrats libanais venus partager leurs expériences respectives avec leurs pairs internationaux.

Fait désolant au cours de cette rencontre inédite, la faible participation du public, notamment les étudiants de droit et les avocats, qui ont été pourtant vivement sollicités pour participer à ces débats d'une importance majeure, du moins pour tous ceux qui s'intéressent à ce sujet.
C'est donc devant une salle réduite que les conférenciers sont intervenus progressivement, pour soulever les problématiques fondamentales que pose le régime juridique particulièrement original qui a été adopté par le TSL. Deux jours durant, la question des droits des victimes, des droits des accusés, le système du procès par défaut admis dans le cadre du TSL, la présomption d'innocence, ainsi que toutes les questions soulevées par l'adoption du régime mixte du droit civil et de la Common Law ont été passés au peigne fin.
Prenant la parole au cours de la session d'hier, le vice-président du TSL, Ralph Riachi, a expliqué la notion de « procès par défaut », adopté par le tribunal et rigoureusement défini par le règlement de procédure. « Après de longues discussions sur l'opportunité d'introduire ou non le procès par défaut au régime du tribunal, et après avoir exposé les avis favorables et défavorables au principe, les juges ont enfin convenu de l'inclure à la procédure du TSL, mais seulement après avoir posé des conditions telles que définies par le statut du tribunal pour s'assurer du respect du principe de procès équitable », relève le juge.
Et de préciser que parmi les raisons principales qui poussent certains régimes à rejeter l'adoption du procès par défaut, le fait que ce type de procédure ne garantit pas les requis d'un procès équitable, notamment le droit à la défense, en plus du fait que cette procédure risque d'être exploitée par les régimes dictatoriaux qui seraient tentés de se venger des opposants politiques qui ont été contraints de fuir de peur d'être persécutés.
Selon lui, le TSL a finalement admis le procès par défaut pour deux raisons fondamentales : la première est qu'il s'agit d'un acte terroriste et non de crimes contre l'humanité ou de crimes de guerre, comme cela est le cas pour les autres tribunaux spéciaux internationaux qui ne connaissent pas d'ailleurs ce type de procès. Par conséquent, ajoute l'intervenant, le crime de terrorisme est par définition plus énigmatique et clandestin, donc plus complexe, d'où la difficulté de retrouver et d'arrêter les coupables quand bien même ils auraient été identifiés ; la seconde raison réside dans le fait que le statut du TSL a contraint l'assemblée plénière du tribunal de s'inspirer non seulement des normes de droit internationales, mais également du code libanais de procédure pénale, qui prévoit le procès par défaut, poursuit M. Riachi.
Et le juge de rappeler les cas de figure dans lesquels est prévue la procédure par défaut, et dans laquelle l'accusé peut se soustraire au procès ou se trouve dans l'impossibilité d'y assister.
La chambre de première instance peut ainsi décider d'engager une procédure par défaut lorsque l'accusé a renoncé, expressément et par écrit, à son droit d'être présent à la procédure devant le tribunal ; lorsqu'il n'a pas été remis au tribunal par les autorités de l'État concerné dans un délai raisonnable ; ou dans le cas où il aurait pris la fuite ou bien qu'il serait introuvable, et que toutes les mesures raisonnables ont été prises pour garantir sa comparution. Et le juge de faire remarquer que le procès par défaut ne s'applique évidemment pas aux cas où l'accusé aurait accepté de comparaître par le bais du système de vidéoconférence, ou qu'il se serait fait représenter par un avocat.
Le juge de la mise en état, Daniel Fransen, est ensuite intervenu pour exposer le droit des accusés qui, a-t-il dit, a connu une évolution particulière dans le cadre du TSL, en comparaison notamment avec les autres tribunaux ad hoc, voire les juridictions nationales. Après avoir défini la qualificatif d'« accusé », et explicité le processus de la confirmation d'au moins un chef d'accusation à l'encontre d'une personne donnée, le juge a énuméré les droits du suspect, qui, comme ceux de l'accusé, font partie du droit de la défense.
Parmi ces droits, celui de s'exprimer dans sa propre langue. Cela ne vaut cependant pas pour l'avocat de l'accusé qui doit s'exprimer dans l'une des trois langues officielles adoptées par le TSL, à savoir l'anglais, le français et l'arabe, dit-il. Un autre droit fondamental est celui d'avoir un avocat pour sa défense. Le statut a consacré ce droit et le règlement a prévu explicitement que les communications échangées entre une personne et son conseil sont couvertes par le secret professionnel. Cela suppose bien entendu que la personne qui n'a pas les moyens de se payer un avocat pourra bénéficier d'une aide légale qui sera assurée par ce bureau. M. Fransen a tenu à rappeler que l'une des avancées du TSL est précisément la création en son sein d'un bureau de la défense, qui est placé sur un même pied d'égalité que le bureau du procureur. Il a pour rôle de protéger les droits de la défense, et d'apporter aux avocats un soutien et une assistance sous la forme de recherches juridiques, de rassemblement d'éléments de preuve, ou de conseils juridiques lorsque cela est nécessaire. Il peut intervenir dans la désignation de l'avocat, en s'assurant de sa compétence et de ses qualifications. C'est également le bureau de la défense qui doit s'assurer que le travail fait par l'avocat est un travail de qualité. Il a en outre un rôle important en matière de coopération internationale, puisqu'il appartient au chef de ce bureau de solliciter la coopération d'un État en vue d'aider à la défense des suspects et des accusés devant le tribunal. « Cela signifie, par exemple, qu'il pourra demander au Liban ou un autre État d'effectuer des enquêtes, interroger des témoins, perquisitionner, saisir des documents afin d'assurer le respect des intérêts et des droits des accusés », a-t-il conclu.

May 11, 2010 - L'Orient le jour - Cassese : Le TSL, un animal institutionnel unique, différent des autres tribunaux internationaux

Devant une salle dégarnie d'étudiants, de juristes et d'experts supposés pourtant s'intéresser à un sujet inédit de par sa nouveauté et son originalité, le président du Tribunal spécial pour le Liban, Antonio Cassese, a donné hier un exposé fourni sur les spécificités du TSL et ses rouages internes.


Intitulée « Le TSL et le droit libanais : approche comparative », la conférence, qui a eu lieu à l'amphithéâtre Pierre Abou Khater de l'USJ, a également été l'occasion de parler des droits des victimes, suite à des interventions faites par le représentant légal des victimes à la CPI , Jean Louis Gilissen, et par le juriste senior auprès des chambres du TSL, Jérôme Hemptinne.
« Le crime de terrorisme n'a de commun avec les autres crimes de droit pénal international que l'horreur et le sang », a affirmé le président du Conseil d'État, Chucri Sader, qui a modéré la première partie de la conférence. Rappelant que les actes terroristes que le TSL a compétence de juger comprennent des « spécificités aussi bien au niveau de l'enquête que de la structure du tribunal et de la procédure à suivre », le juge Sader a rappelé les autres spécificités du TSL qui résident, d'une part , dans la loi applicable, « qui n'est autre que la loi libanaise », et dans la mixture agressive des deux régimes de Common Law et de droit civil, « afin d'assurer plus de célérité et d'efficacité au travail du tribunal ». Autre spécificité, ajoute-t-il, le fait que le TSL ait été doté d'un bureau de la défense, indépendant du greffe.
À son tour, le président Cassese parlera des éléments novateurs qui font que le TSL « est un animal institutionnel unique et tout à fait différent des autres tribunaux internationaux ». Parmi ces éléments, le système accusatoire caractérisé par la présence du juge de la mise en état, qui jouit d'un rôle très important.
« C'est un juge indépendant qui ressemble au juge d'instruction dans le système libanais, dit-il. En contact permanent avec le procureur, il est chargé de l'examen préliminaire du dossier et facilite le travail de la chambre. C'est lui qui donne le feu vert pour que le dossier soit transmis devant le tribunal après s'être assuré de la crédibilité et de la pertinence des preuves à charge. C'est également lui qui détermine les victimes, à savoir qu'il décide combien de victimes peuvent se prévaloir en tant que telles. Autre nouveauté inauguré par le TSL, le fait que le déséquilibre entre la défense et le parquet a été rétabli, le tribunal ayant pris des éléments de la procédure américaine qui donne beaucoup d'importance à la défense et protège le droit des accusés. Dernier élément original dans ce régime, celui du droit des victimes qui peuvent désormais participer au procès, témoigner, interroger et contre-interroger les témoins, voire même convoquer des témoins. » « Ils participent à la procédure en exposant les points de droit pour arriver à la vérité », dit-il. Leur rôle est d'autant plus important qu'ils « peuvent pousser le parquet à être plus incisif » . La possibilité enfin pour l'accusé de faire des déclarations et de refuser, éventuellement, de répondre lorsqu'ils sont interrogés par les juges a été octroyée dans le cadre de ce système.
Après avoir rappelé les réalisations au plan des « infrastructures pratiques et juridiques » faites par le TSL au cours de l'année écoulée, M. Cassese a évoqué les « activités juridiques » du TSL qui se poursuivent, dit-il, malgré l'absence, pour l'instant, de procès. Parmi ces activités, le cas de la libération des quatre généraux et les dernières ordonnances rendues par le TSL suite à la requête faite par l'un des officiers. Le général Jamil Sayyed a en effet présenté une demande auprès de l'institution judiciaire pour obtenir les éléments de preuve qui avaient conduit à son arrestation, les juges libanais et le TSL s'étant déclarés incompétents pour examiner et statuer sur la question des faux témoins. Et le juge Cassese de préciser que la requête de M. Sayyed a été transmise au juge de la mise en état qui doit trancher d'ici à mi-juin, dans un sens comme dans un autre.
Face à cette requête, « nous devions affronter un problème sérieux pour savoir si le TSL est compétent en la matière, M. Sayyed n'étant ni un suspect, ni un accusé, ni une victime par rapport au tribunal (...), avant de décider qu'il y a effectivement un lien, puisque M. Sayyed a été lié au TSL durant la période du dessaisissement par les autorités libanaises de ce dossier en faveur du tribunal », précise le juge. Par conséquent, explique-t-il, et sur base du principe du droit fondamental d'accès à la justice, et conformément à un arrêt international qui prévoit le droit pour tout individu d'accéder à un juge pour faire prévaloir ses prétentions pour obtenir des dommages et intérêts, nous avons conclu que M. Sayyed « a effectivement droit de venir devant notre tribunal, mais pas au dossier », du moins à ce stade de la procédure. Car ce sera au juge de la mise en état de décider, après dépôt d'un mémoire de la part de M. Sayyed présentant ses arguments, s'il y aura ou non une confrontation du demandeur avec le procureur sur cette affaire - lors d'une audience publique -, chose que le juge Daniel Fransen tranchera d'ici à la moitié du mois de juin prochain, explique le président qui souligne que les deux parties ont d'ailleurs un droit d'appel.
Place ensuite aux droits des victimes qui ont fait l'objet d'un exposé historique de la part de Jean-Louis Gilissen. Passant en revue la phase du droit international « où la victime n'avait pas de place », le juriste a rappelé que cette question a par la suite évolué avec la mise en place de tribunaux internationaux, tels que celui du Ruwanda, lequel a témoigné d'une amorce de la reconnaissance de la spécificité des victimes. Celle-ci « reste toutefois une épreuve en soi » et « un difficile équilibre à maintenir » entre les tenants de la partie civile et ceux qui insistent pour que les victimes fassent un procès indépendant de la justice internationale, conclut l'expert qui souligne que le combat doit être poursuivi.
Jérôme de Hemptinne élaborera sur ce point, en rappelant que le TSL a tenu compte du système libanais et des limites imposées par le statut du tribunal, les victimes ne pouvant pas bénéficier de réclamations devant le TSL. Elles peuvent par contre se tourner vers les juridictions libanaises pour faire prévaloir leur droit aux compensations. Elles peuvent également se prévaloir d'une réparation morale devant le TSL.
Encore faut-il déterminer qui est victime et quelles sont les victimes qui peuvent se faire prévaloir de leur droit concret, à savoir leur participation au procès, décision qui revient aux juges.

May 11, 2010 - Global Times China - Hariri tribunal says it will 'get the job done'

President of the Special Tribunal for Lebanon (STL) Judge Antonio Cassese stressed Monday that the international tribunal will reveal the truth despite the crime's complexity.

Cassese discussed at Saint Josef University in Beirut the role of Lebanese law and Anglo-American law in the investigation into the assassination of former Lebanese Prime Minister Rafic Hariri.

Cassese addressed the investigation probing the assassination of Hariri, who was killed along with 22 others in a suicide bombing in Beirut on Feb. 14, 2005.

"The work of the court is purely judicial, given the fair participating judges and will not be influenced by political ideologies," Cassese was quoted as saying by Al Mustaqbal local news site.

"The STL will get the job done and reveal the truth despite the crime's difficulty," he added.

The UN special tribunal was established on March 1, 2009 to try suspects that planned, facilitated and executed the assassination of Hariri.

Acting registrar of the Special Tribunal for Lebanon (STL) Herman von Hebel said in April that the tribunal is ready to carry out indictments issued by Prosecutor Daniel Bellemare.

May 10, 2010 - Now Lebanon - Cassese says STL aims to “reach any criminal”

LBCI television reported Monday that during a conference in the University of Saint Joseph in Beirut, President of the Special Tribunal for Lebanon (STL) Antonio Cassese said that the foundation of the tribunal’s work is to “reach any criminal” involved in the 2005 assassination of former Prime Minister Rafik Hariri no matter what position he/she holds.

Cassese also commented on Lebanon’s detention of the four generals allegedly connected with Hariri’s murder, saying the country lacked the evidence to charge them with crimes.

The generals were originally detained on August 30, 2005 at the recommendation of former investigator of the UN International Independent Investigation Committee Detlev Mehlis. However, the STL asked the Lebanese authorities in 2009 to release them.

Cassese reiterated that “the tribunal’s task is purely judicial and its work won’t be affected by any political ideology.”

Cassese also said that the tribunal has always abided to the international legal framework and has demonstrated its ability to work on one of the most difficult cases overseen by the International Criminal Court (ICC), referring to the STL’s investigation into Hariri’s killing.

The STL is staffed by qualified judges and lawyers, he added.

May 10, 2010 - Syria Today - Thicker than Water

Damascus has witnessed few stranger sights in recent years than that of Lebanese leader Walid Jumblatt sitting next to President Bashar al-Assad. Jumblatt’s initial visit to the Syrian capital – followed by a second trip on April 16 – shows just how far relations between Damascus and Beirut have come since Syrian troops pulled out of Lebanon in 2005 following the assassination of former Lebanese Prime Minister Rafik Hariri.

Jumblatt is just one of several politicians who have made their way to Damascus in recent months. After forming a national unity government in Lebanon, Lebanese Prime Minister Saad Hariri visited Damascus in December last year and was due back in the capital for more detailed talks as Syria Today went to print. This, despite the fact that he has spent countless hours in recent years blaming Syria for the assassination of his father, an allegation Damascus has always denied.

Shifting regional alliances

Warming Syrian-Lebanese relations stem from a shifting of regional alliances which has seen Syria emerge from five years of international isolation, say political analysts. Under former US President George W. Bush, Lebanon and other US-allied countries were wooed away from Syria in an attempt to isolate it. That project failed and with the US and major Arab powers such as Saudi Arabia once again reaching out to Damascus, Syrian-Lebanese rapprochement was only a matter of time.

“Washington’s defeat in reshaping the Middle East according to its desires also meant a defeat for Saudi Arabia and its local Lebanese clients,” Murhaf Jouejati, professor of Middle East Studies at George Washington University, said. “Since almost everything is a zero sum game in the Middle East, that defeat meant a victory for the Iran-Syria alliance and their local Lebanese allies.”

Initial signals of the defeat came with the bloodying of Israel’s nose by Hezbollah during the 2006 Israeli war on Lebanon. The failure of Israel’s strikes on Gaza in late 2008 and early 2009 to secure the release of one of its soldiers held by Hamas – a stated goal of the attacks – was seen as an additional loss for Tel Aviv.

“Syria’s enemies thought a defeat of Hezbollah would bring down the Syrian regime and its mini-axis,” Rime Allaf, a Syrian political analyst at London’s Chatham House, said. “It didn’t happen.”

This led to a recent period of rapprochement between Syria and Saudi Arabia, the traditional patron of Hariri’s Future Movement, which – on the surface – has calmed internal power struggles in Lebanon and diluted anti-Syrian sentiment within the March 14 coalition.

The new dynamics have also given Damascus greater leverage when it comes to the balance of power with Israel. In the absence of a comprehensive peace settlement, preventing Lebanon from falling prey to Israeli machinations is a constant theme in Syrian foreign policy.

“Lebanon is strategic to Syria, to hold it away from the Israeli line of fire and to get its support for the resistance,” Khalid Aboud, a Syrian MP and secretary of the Syrian parliament, said. “It is natural for us to have a good relationship. But the murder of Hariri was used by the US to tear apart relations between Beirut and Damascus.”

No choice

Analysts say that Lebanon had no other choice than to come back to Syria.

“It was Lebanon, not Syria, that was really isolated by the international community,” Allaf said. “Lebanon has not received the US patronage it was promised and its other neighbour is Israel. There was never any other option for the Lebanese but to talk to Syria.”

Joshua Landis, director of the Center for Middle East Studies and associate professor at the University of Oklahoma, agrees.

“Many Lebanese hate both sides, Syria and the US, but they don’t have the luxury of doing without one,” he said. “They are being forced to choose sides. Hariri and his allies chose the US in 2005 believing that Syria had killed their leader. We are now seeing a great shift as Hariri separates from the right-wing and goes back to a traditional alliance with Syria and Hezbollah.”

If Syrian-Lebanese relations are returning to their former status, the issue of equality is being mooted. Syria has long been portrayed as playing with an innocent Lebanon which is unable to stand up for itself. Despite the withdrawal of Syrian troops from Lebanon and the establishment of diplomatic relations between the two countries, accusations of Syrian control over the country via indirect means abound.

Aboud says Syria’s relations with Lebanon have always been conducted according to international law.

However, he suggested the relationship would now proceed in a more equal manner.

“In the past, some Syrians who benefited in Lebanon became like a mafia looking out for their own interests, with cooperation from some in Lebanon,” he said.

“There will be no more of these old-fashioned relationships which benefited from the shadows and the dark. The relationship will not be good if it is not equal.”

Lebanon also benefits from Syria, just in a different manner, Jouejati points out.

“The benefits for each are not comparable,” he said. “Syria benefits strategically, while Lebanon benefits economically. Syria is one of Lebanon’s most important markets and Lebanon is separated from its Gulf market by Syria.”

Junior partner

Others predict the relationship will be lopsided. Despite Lebanese national elections and greater stability in the wake of a recent period of Syrian-Saudi rapprochement, Lebanon remains a weak state rife with sectarian divisions.

“There is no glue in Lebanon so it is always subject to foreign meddling,” Landis said, adding that as long as the Arab-Israeli conflict remained unresolved, Damascus would have a strategic interest in ensuring Hezbollah remained armed, powerful and a challenge to Israel.

Putting pressure on Israel and having another alliance in the resistance is “the number one priority”, according to Aboud. “We are telling the Lebanese that this is our demand. We want them to speak out loudly for the resistance.”

So far this demand has met with success, with Jumblatt urging resistance and refusing to condemn Hezbollah’s arms.

There are challenges to ongoing smooth relations, such as resistance in Lebanon from Lebanese Forces leader Samir Geagea and Phalange Party head Amin Gemayel, as well as the ongoing investigation into the killing of Hariri.

But neither is seen as a real threat to the rapprochement. Officials on both sides are showing a willingness to turn the page despite unfinished business. The UN-backed Special Tribunal for Lebanon also seems to be going nowhere fast.

“Both US and Lebanese politicians have engaged with Syria and put political chips on the country,” Landis said. “If they thought there was a jack-in-the-box waiting to come out, they wouldn’t be doing that.”

BEIRUT - The President of the Special Tribunal for Lebanon, Judge Antonio Cassese, the Vice-President, Judge Ralph Riachy, and Pre-Trial Judge, Judge Daniel Fransen, are visiting Lebanon from 8 to 14 May 2010.

During their stay, they will take part in a colloquium, jointly organised by the Tribunal and Saint Joseph University, comparing the applicable law of the Tribunal with that of Lebanon. This colloquium will enable the Tribunal judges and Lebanese experts to have an exchange of views on three major topics: the status of victims, the rights of the accused and trials in absentia. The Tribunal judges will also take this opportunity to hold talks with representatives of Lebanese and international non-governmental organisations.

These meetings, which follow on from the visit made in February of this year, are a reflection of the Tribunal’s desire to listen to concerns expressed within Lebanon in relation to its roles and the challenges it faces. They are also intended as a means of sustaining the ongoing dialogue between the Tribunal and civil society.

May 7, 2010 - Sudan Tribune - Sudan seeks Lebanon support in UN Security Council

May 7, 201 (KHARTOUM) — A Sudanese Presidential adviser travelled recently to the Lebanese capital to ensure the support of the Arab League member to its positions in the United Nations.

Since January 2010, Lebanon is elected as non-permanent member of the Security Council. The Arab country will serve a two-year term.

Khartoum faces international pressures over its rejection to cooperate with the International Criminal Court (ICC). Arab and African countries asked the 15 member council to suspend the jurisdiction of the war crimes court on Darfur but Britain, France and the US showed opposition.

Last April the ICC prosecutor Luis Moreno Ocampo asked judges to report Sudan to the U.N. Security Council for refusing to hand over a government minister and a militia leader accused of atrocities in Darfur. The court ordered the men arrested in 2007 on 51 charges of crimes against humanity and war crimes.

Mustafa Osman Ismail paid a three day visit to Beirut where he met with Lebanese President Michel Suleiman and the Prime Minister Saad Al-Hariri to brief them on the position of the Sudanese government on Darfur and implementation of the 2005 peace agreement.

Mustafa told the official SUNA that Lebanon is now representing the Arab group in the Security Council and presides over the Council during this month of May 2010.

"We hope, as is natural, that Lebanon stands by the Arab and African decision which supports Sudan.

He also said that the Lebanese officials he met reassured him on their support to Sudanese position over all the issues raised in the Security Council.

"They are with the Arab and Africa decision, and with the interest of Sudan. Also they would support the Sudanese positions before the Security Council,” he said.

Lebanon has witnessed the opening of special tribunal in The Hague to try the suspected assassins of former Lebanese Prime Minister Rafiq Al-Hariri in 2005.

Al-Hariri’s son Saad who is now the Prime minister, at the time, commented the ICC indictment of the Sudanese President saying that justice will reach Bashir as part of a growing trend in the region.

The remarks drew a rebuke from the Sudanese embassy in Beirut who said that “linking Al-Hariri’s trial to efforts by the ICC to issue an arrest warrant for Bashir is illogical and defies the reality of things”.

“The special tribunal [for Rafiq Al-Hariri] was requested by the Lebanese government to help in investigation then prosecuting Al-Hariri’s assassins,” he adde.

May 3, 2010 - Now Lebanon - Wahhab deems STL and UN “a big lie”

The Special Tribunal for Lebanon (STL) and UN institutions “are a big lie” working for US interests, said Tawhid Movement leader Wiam Wahhab in an interview with the Kuwaiti newspaper An-Nahar published Monday. The international court has a political agenda that targets Syria and Hezbollah, he added.

He said he wished President Michel Sleiman would take the initiative to improve Lebanese-Syrian relations, adding he does not expect the toppling of the national-unity cabinet. He stated however that new alliances would surface “to correct past mistakes.”

He commented on the municipal elections that started in Mount Lebanon on Sunday, saying he and Progressive Socialist Party leader MP Walid Jumblatt reached a general understanding. He did not elaborate further.

May 2, 2010 - Now Lebanon - Cassese to visit Lebanon next month

Kuwaiti newspaper Al-Anbaa reported on Sunday that President of the Special Tribunal for Lebanon (STL) Antonio Cassese is to visit Lebanon next month to take part in a conference on the international tribunal.

On 13 December 2005 the Government of the Lebanese Republic requested the UN to establish a tribunal of an international character to try all those who are alleged responsible for the attack of 14 february 2005 that killed the former Lebanese Prime Minister Rafiq Hariri and 22 others. The United Nations and the Lebanese Republic consequently negotiated an agreement on the establishment of the Special Tribunal for Lebanon.
