Now Lebanon - An-Nahar: Hariri-Nasrallah meeting becoming less feasible - September 21, 2010

An-Nahar newspaper on Tuesday quoted an unnamed ministerial source as saying that a meeting between Prime Minister Saad Hariri and Hezbollah Secretary General Sayyed Hassan Nasrallah has become less feasible due to the rising tension in Lebanon over the weekend.

Last week, armed Hezbollah bodyguards received former General Security chief Jamil as-Sayyed at the VIP lounge upon his arrival at Beirut’s Rafik Hariri International Airport without the needed permission from any of the relevant bodies. The move stirred controversy and escalated tension, especially between the Future Movement and Hezbollah.

Sayyed, who had just returned from France, was summoned by Attorney General Judge Said Mirza for questioning following the former’s September 12 statement, in which he attacked Hariri.

The source told the daily that relations between Hezbollah and the Future Movement had deteriorated following the airport incident.

Any meeting between Hariri and Nasrallah might impose difficult conditions, such as writing a draft lining out how to deal with controversial issues like the Special Tribunal for Lebanon (STL), the source added.

Now Lebanon - As-Safir: Jumblatt upbeat about Nasrallah-Hariri meeting - September 21, 2010

As-Safir newspaper quoted on Tuesday Progressive Socialist Party leader MP Walid Jumblatt as saying that his attempts to bring Hezbollah Secretary General Sayyed Hassan Nasrallah and Premier Saad Hariri together were fruitful.

Jumblatt said the he sent Public Works and Transportation Minister Ghazi Aridi to meet with the Hezbollah chief, after which Nasrallah sent a positive message to Hariri.

However, Jumblatt did not reveal the content of the message, the daily added.

Tensions between the Future Movement and Hezbollah ran high after armed Hezbollah bodyguards received former General Security chief Jamil as-Sayyed at Beirut’s Rafik Hariri International Airport without the needed permission from any of the relevant bodies.

Sayyed, who had just returned from France, was summoned by Attorney General Judge Said Mirza for questioning following the former’s September 12 statement, in which he attacked Hariri. Hezbollah on Friday called for the judiciary to revoke the summons.

Jumblatt also told the daily that Hariri’s September 6 interview with As-Sharq al-Awsat newspaper—in which the PM said some people misled the Special Tribunal for Lebanon (STL) and ruined Lebanese-Syrian relations—was a huge step toward safekeeping peace.

“However, [Sayyed’s] attacks are unjustified,” the PSP leader added.

Now Lebanon - Syria concerned that airport incident hurt Hezbollah, Al-Hayat reports - September 21, 2010

Al-Hayat newspaper on Tuesday quoted a source as saying that Damascus is very worried about Saturday’s airport incident, adding that it has greatly damaged Hezbollah’s image as well as that of its allies.

Tension between the Future Movement and Hezbollah ran high after armed Hezbollah bodyguards received former General Security chief Jamil as-Sayyed at Beirut’s Rafik Hariri International Airport on Saturday without the needed permission from any of the relevant bodies.

Sayyed, who had just returned from France, was summoned by Attorney General Judge Said Mirza for questioning following the former’s September 12 statement, in which he attacked Prime Minister Saad Hariri.

The source also told the daily that “such external concern will put pressure [on Lebanese parties] to foster calm and to adhere to the [Saudi-Syrian] rapprochement.”

Syrian President Bashar al-Assad, Saudi King Abdullah bin Abdel Aziz and President Michel Sleiman held a meeting in Baabda on July 30 in a bid to defuse political tension following Hezbollah Secretary General Sayyed Hassan Nasrallah’s speech calling the STL an Israeli project designed to target Hezbollah by stirring up sectarian strife in the country.

Now Lebanon - Habib: Najjar responsible for dealing with false witnesses issue - September 21, 2010

Lebanese Force bloc MP Farid Habib told Ad-Diyar newspaper in an interview published on Tuesday that Justice Minister Ibrahim Najjar is the person responsible for dealing with the issue of the Special Tribunal for Lebanon’s (STL) false witnesses.

The cabinet delegated Najjar on August 18 to follow up on the issue of the false witnesses who gave fake testimonies in the investigation of the 2005 assassination of former Prime Minister Rafik Hariri.

“Do they want to teach Najjar [how to do] his job?” said Habib, in reference to the March 8 parties who have called on the Lebanese judiciary to investigate the issue.

In July, Hezbollah called the STL an Israeli project, saying the tribunal will indict some of his party’s members for Rafik Hariri’s murder.

Now Lebanon - Chamoun regrets Sayyed’s airport reception - September 21, 2010

Following his meeting with Maronite Patriarch Nasrallah Boutros Sfeir, National Liberal Party leader MP Dori Chamoun said on Tuesday that he regrets Saturday’s airport incident, NOW Lebanon’s correspondent reported.

It appears that the state “has no presence at the airport, which [allowed] for the holding of such a reception for someone who’s an outlaw,” he added.

Now Lebanon - Abdo denies warrants issued against him - September 21, 2010

In a statement issued on Tuesday, former Ambassador to France Johnny Abdo denied that there are any warrants issued against him.

“Some media outlets have intentionally said—in their attempt to defend the illegal arms that have taken over Beirut’s Rafik Hariri International Airport [over the weekend]—that Johnny Abdo [returned] to Lebanon by force even though there are warrants against him… Some have even said they were arrest warrants,” the statement said.

Daily Star - Gemayel: Opposition taking country to 'collective suicide' - September 20, 2010

BEIRUT: The head of the Phalange Party, Amine Gemayel, accused opposition forces Sunday of taking the country toward “collective suicide.”

Speaking to supporters in the Bekaa Valley town of Zahle, Gemayel said Lebanon’s unity and sovereignty were at stake, adding that all attacks on the Special Tribunal for Lebanon (STL) to try suspects into the 2005 assassination of former Premier Rafik Hariri, “will not change the course of justice but will only harm Lebanon.”

The former Lebanese president arrived in Zahle for a two-day visit on Saturday. The goal of the visit was to meet Phalange party officials and supporters.

Gemayel said that rather than uniting to face external threats, some Lebanese groups were “settling personal accounts, which is a dangerous matter.”

Gemayel said when his son, slain Industry Minister Pierre Gemayel, was killed in 2006, he had not held “anyone responsible because I [did] not want the [killer] to remain unknown.”

Gemayel said he respected Prime Minister Saad Hariri’s decision not to make accusations in his father’s killing, adding that only the STL was entitled to issue accusations.

Earlier this month, Hariri told Saudi-daily Ash-Sharq al-Awsat he had made a mistake when he accused Syria of standing behind his father’s assassination.

Gemayel stressed that Lebanon “must hold onto Arab consensus,” adding that a “separate peace deal with Israel must not be signed, “whatever the pressures.”

He said that “a tangible progress, although insufficient, has been achieved on the level of Lebanese-Syrian ties.” – The Daily Star

مَن يشهد ويشاهد هذا التصويب الناري في الحملات المتبادلة يستعيذ من ارتداداتها على الأوضاع الأمنية في البلاد.
ومن حق المواطن المشدوه أمام هذه المشاهد المتلاحقة أن يخشى من عودة الاحتكاك على خلفية ما سُرِّب من الاشتباه بالقرار الظني الذي ستصدره المحكمة الدولية الخاصة بلبنان.
ولا يبدو من السجال الدائر حول هذه المحكمة ومحاولة تسييسها ما ينبئ بتنحية الأضرار المسرّبة على الساحة الداخلية ما دامت ذيول هذا القرار تشكّل فتنة داخلية مفتعلة. وكيف يمكن لضباط أربعة أن ينسوا ما عانوه من ظلم الاشتباه السياسي وهم قابعون في السجون حتى جاء المدعي العام لهذه المحكمة دانيال بلمار ليتثبّت من عدم وجود أدلّة تدينهم ويفرج عنهم.
وإذا كان رئيس الحكومة سعد الحريري أدان إفادات شهود الزور، التي أساءت إلى العلاقات اللبنانية - السورية، فكيف لـ«حزب الله» الذي تعرّض لحملة إسرائيلية توّجها رئيس الأركان الإسرائيلي غابي أشكينازي قبل خروجه من هذا المنصب في آذار المقبل، أن يطمئن إلى سلامة ما توصّلت إليه التحقيقات والقرار الظني المنتظر الذي يبطّن اتهامًا مباشرًا للحزب بالطريقة التي عوملت بها سوريا اقتصاصًا من موقفها المعارض للحرب الأميركية على العراق.
وكيف يجوز «للشاهد الملك»، كما سمّوه، محمد زهير الصديق أن يُظهر نفسه، وهو يسرح ويمرح من دون أية مذكّرة جلب تلجأ إليها المحكمة الدولية أو يطالب بها لبنان، على إحدى صفحات جريدة «السياسة» الكويتية ليعود ويكرّر ادّعاءه بتورّط «حزب الله» على ذمة مسؤول سوري سابق لا يُركن معه إلى شهادته الميتة لأنه «ميت»؟!
باستطاعة مَن زوّر إفادته أمام لجنة المحقّقين الدوليين بحق بلاده وبحق الحقيقة وراء اغتيال الرئيس الشهيد رفيق الحريري أن يكرّر الفعلة نفسها وللأسباب إياها ولا تتحرّك النيابات والإستنابات الدولية لاعتقاله بواسطة الإنتربول.
لقد بتنا، مع هذا النمط المتّبع في التعامل مع المعطيات نشك في النيات المشبوهة التي تحاول النيل من سمعة المقاومة اللبنانية وسلاحها المشروع في الدفاع عن الأرض ما دامت أجزاء من أرضنا تحتلّها إسرائيل. كما أن الإصرار على ترك شهود الزور أحرارًا طليقين، من دون حساب أو مساءلة يؤسّس لمشروع فتنة داخلية بدأت تذر قرنها وتنذر بشرور مستطيرة على السلم الأهلي في لبنان.
فهل تتنبّه القيادات اللبنانية إلى خطورة ما يُحاك لإحداث حالة انقــسام عمـــيقة بين طرفي النزاع قبل فوات الأوان لئــلاّ يقــع لبنان في المحظور الأكبر.
من المهم جدًا أن نتفهّم حقيقة الظنون التي تشتبه بقرار ظني مشبوه!

تمثيل جريمة اغتيال الرئيس رفيق الحريري لن ينفذ هذا الشهر. العملية التي استغرق الإعداد لها ثلاثة أشهر، على أن تنفذ في الثامن والعشرين من هذا الشهر في قاعدة «كابسيو» الفرنسية بالقرب من بوردو تأجلت حتى شهر تشرين الأول المقبل.
وكان مصدر فرنسي قد كشف الأسبوع الماضي لـ«السفير» أن جهات أمنية فرنسية تضغط لإلغاء تمثيل الجريمة على الأراضي الفرنسية كي لا يفسر ذلك قرارا سياسيا فرنسيا بدعم أي قرار ظني يوجه الاتهامات إلى عناصر من «حزب الله» بالتورط في جريمة الحريري.
وبحسب إعلاميين في المنطقة كانوا قد طلبوا تغطية العملية، فإن الجهات الفرنسية المشرفة على التدابير الأمنية أبلغتهم تأجيلها أسبوعا أو عشرة أيام، معللة قرارها «بضرورة استكمال الإجراءات الأمنية في المنطقة».
ويدور سجال داخل الأوساط الأمنية والدبلوماسية، حول احتمال العودة عن القرار خصوصا أن مسرح الجريمة قد اكتمل بناؤه، وبالتالي فإن تفكيكه والتراجع عن القرار سيتركان آثارا سيئة على سمعة فرنسا والتزاماتها تجاه الأمم المتحدة. كما أنها تخاطر بالظهور وكأنها قد تخلت عن دعم المحكمة الدولية. وقال المصدر الفرنسي إن المتحمسين للتعاون مع المحكمة الدولية يلفتون الانتباه الى أن عددا كبيرا من أعضاء لجنة التحقيق هم فرنسيون وأنهم اكتسبوا خبرة فائقة بفضل الفرصة التي أتاحتها لهم قضية الرئيس الحريري والإمكانيات الهائلة التي توفرها لهم منذ خمسة أعوام لجنة التحقيق الدولية، وهي فرصة لم توفرها أي محكمة دولية أخرى.

المفاعيل القانونية لتحرك النيابة التمييزية
باستدعاء السيّد للإستماع إلى إفادته

بدأ اليوم الأول من السنة القضائية الجديدة أمس بالحديث عن فتح قسم المباحث الجنائية المركزية تحقيقاً مع المدير العام السابق للأمن العام اللواء الركن جميل السيد في شأن ما أدلى به في مؤتمره الصحافي الذي عقده الأحد الماضي.
ويأتي تحرك قسم المباحث الجنائية، بناء على طلب النائب العام التمييزي سعيد ميرزا في ضوء كتاب تسلمه من وزير العدل إبرهيم نجار طلب فيه تحريك الحق العام بالإستناد إلى المادة 14 من قانون أصول المحاكمات الجزائية. وقد استدعي السيد للإستماع إلى إفادته في موضوع "تهديد أمن الدولة والنيل من الدستور وتهديد رئيس الحكومة سعد الحريري والتهجم عليه وعلى القضاء وأجهزة الدولة".
وتنص المادة 14 من هذا القانون على الآتي: "لوزير العدل أن يطلب إلى النائب العام التمييزي إجراء التعقبات في شأن الجرائم التي يتصل خبرها بعلمه. ولهذا الأخير (المدعي العام التمييزي) عند الإقتضاء الحق في إجراء التحقيق مباشرة أو بواسطة معاونيه من قضاة النيابة العامة الملحقين به أو أفراد الضابطة العدلية التابعين له من دون أن يكون له حق الإدعاء".
وفي ضوء هذا النص تحركت النيابة العامة التمييزية وطلب رئيسها القاضي ميرزا من قسم المباحث الجنائية المركزية، ومقره قصر العدل في بيروت، إستدعاء اللواء السيد إلى دائرة القسم والإستماع إلى إفادته حول أقواله في المؤتمر الصحافي وقصد أفراد منه منزل اللواء السيد أول من أمس ولم يجدوه وعائلته بداعي سفرهم الأسبوع الماضي إلى الخارج.
ماذا يعني فتح هذا التحقيق من الناحية القانونية؟
إن تحرك النيابة العامة التمييزية بقصد الإستماع إلى إفادة اللواء السيد هو في طور بدايته. ويمكن إعتباره بمثابة إخبار مقدم من وزير العدل، الذي لا سلطة قضائية له، إلى القضاء للتحقيق في شأنه. وهذا التحرك لم يصل بعد إلى طور الإدعاء على المطلوب للاستماع إليه، في رأي مصدر قانوني إذ ليس من صلاحية النيابة العامة التمييزية، الادعاء. فهذه الخطوة هي من صلاحية النيابة العامة الإستئنافية والتي يأتي دورها في المرحلة التالية، في حال تقرر المضي في هذا الملف قضائيا".
ففي المرحلة الاولى يستمع قسم المباحث الجنائية إلى الشخص المطلوب الإستماع إلى إفادته في حال أبلغ وحضر إلى التحقيق الذي بنتيجته يتخذ القاضي ميرزا قراره. فإما ان يقرر حفظ الملف وتنتهي الأمور عند هذا الحد وتُقفل القضية أمام القضاء، واما ان يحيل نتيجة التحقيق الذي أجراه قسم المباحث على النيابة العامة الإستئنافية ويطلب منها إجراء المقتضى القانوني بالإدعاء فتتحرك الدعوى العامة اذذاك بالادعاء العام وفق المواد القانونية التي يرتئيها المدعي العام الإستئنافي وتتطابق مع الأفعال المنسوبة إلى المدعى عليه. وتحال أوراق الإدعاء على قاضي التحقيق الأول الذي يستدعي المدعى عليه في حال لم يكن قد أوقف ويبدأ إستجوابه ويقرر إما إصدار مذكرة توقيف وجاهية في حق المدعى عليه أو تركه بسند إقامة أو بكفالة مالية.
أما ما هي الإحتمالات القانونية التي يمكن أن يلجأ إليها القضاء في حال لم يحضر المطلوب الإستماع إلى إفادته فيقول المصدر القانوني أن بلاغ بحث وتحر قد يصدر لمدة عشرة أيام عن النائب العام التمييزي في حق هذا الشخص ويمكن الإكتفاء بهذه المدة او تجديدها لمدة شهر. ومفاعيل هذا البلاغ هي توقيف صاحبه أينما وُجد على الأراضي اللبنانية. وفي حال عدم التوقيف خلال هذه المدة قد يحال ملفه عند إنقضائها على النيابة العامة الإستئنافية لإجراء المقتضى القانوني في حقه بالسير بالدعوى غيابيا".

قرار غير نهائي لقاضي الإجراءات التمهيدية أمهل الفريقين 13 يوماً للإجابة عن أسئلة
المحكمة مختصة ضمنياً للنظر في طلب السيد الحصول على مستندات

أصدر قاضي الإجراءات التمهيدية لدى المحكمة الخاصة بلبنان دانيال فرانسين قراراً غير نهائي عن إختصاص المحكمة للفصل في طلب المدير العام السابق للأمن العام اللواء الركن جميل السيد الحصول على المواد الثبوتية الخاصة بالإفتراء والإحتجاز التعسفي" في ملف إغتيال الرئيس رفيق الحريري، وصفته للإدعاء أمام المحكمة.
وكان السيد تقدم بهذا الطلب أمام المحكمة في 17 آذار الماضي وأحاله رئيسها القاضي أنطونيو كاسيزي على القاضي فرانسين لبت هاتين النقطتين.
وأعلن قاضي الإجراءات التمهيدية في خلاصة قراره المسهب والمعلل بالإستناد إلى قوانين وإجتهادات المحاكم الدولية والمحكمة الاوروبية أن المحكمة "مختصة للفصل في أساس الطلب الذي تقدم به السيد الذي، بحسب قرار فرانسين أيضاً، "يتمتع بصفة الإدعاء أمام المحكمة بغية الحصول على مواد الملف الجزائي، والمتعلق بقضية الحريري الخاص به".
إلا أن القاضي فرانسين لم يبت في قراره أساس طلب المدير العام السابق للأمن العام منحه الحق في الحصول على المستندات الثبوتية (محاضر في ملف التحقيق بقضية إغتيال الحريري). وقال في هذا الإطار إنه "ينبغي السماح للمدعي العام القاضي دانيال بلمار وللمستدعي السيد بعرض ملاحظاتهما وحجههما في هذا الصدد". ودعاهما إلى الإجابة عن عدد من الأسئلة طرحها عليهما تتصل بالمستندات المطلوبة من السيد، لدى قلم المحكمة في مذكرة خطية لكل منهما ضمن مهلة أقصاها الأول من تشرين الآول المقبل، أي بعد 13 يوماً.
وفي ضوء الأجوبة المقدمة من الفريقين القاضي بلمار والسيد سيصدر القاضي فرنسين قراراً نهائيا" في طلب السيد إعطاؤه المواد الثبوتية.
وأبرز ما لحظه قرار القاضي فرانسين إعتبار أن المحكمة
مختصة للفصل في أساس الطلب الذي تقدم به السيد. وعللت في هذا السياق "أن المحكمة تتمتع بإختصاص ضمني للفصل في مسائل فرعية تتعلق بمهماتها". ورأت ان الفصل فيها "ضروري للإنصاف في الإجراءات ولحسن سير العدالة" و"خدمة لمصلحة العدالة" رغم أن "النظام الأساسي للمحكمة وقواعد الإجراءات والإثبات لا تمنح المستدعي (السيد) صراحة صفة تخوله الحصول على مواد الملف الجزائي الذي إتهم وإعتقل بموجبه لكن موضوع طلبه يدخل ضمن السلطات الضمنية للمحكمة"، معتبراً أن طلبه "يقوم على أحد الجوانب الأساسية لحقوق الدفاع" وإلا تكون "تجرده من حقه في الإستفادة من حماية قانونية فعلية" و بقي هذا الحق حبراً على ورق".
وأشار القرار إلى أن للمستدعي السيد "صفة للإدعاء أمام المحكمة (لجهة تقديم طلب الحصول على مواد ثبوتية)". ولفتت إلى أن "هذا الحق هو نتيجة مباشرة لحقوق الدفاع المكرسة في الصكوك الدولية الرئيسية المتعلقة بحقوق الإنسان رغم أن هذه الصكوك لا تنص على هذا الحق صراحة". وقال "يجب أن يستفيد المستدعي من الحقوق الأساسية للدفاع المماثلة لتلك الممنوحة لأي شخص متهم، مع أن المحكمة لم توجه إتهاماً رسمياً إلى المستدعي، كالحق في الإطلاع على ملفه الجزائي".
وعرض القرار، الذي نشره الموقع الألكتروني للمحكمة، طلب السيد وجواب القاضي بلمار عنه. ومضمونهما كانا محور الجلسة العلنية المتلفزة في حينه. ثم تناول مسألة إختصاص المحكمة وحق السيد في تقديم هذا الطلب. وأورد في هذين البابين:
"(...) - اختصاص المحكمة:
قبل النظر في أساس القضية، يجب تحديد ما إذا كانت المحكمة تتمتع بالاختصاص للفصل في طلب المستدعي الحصول على البعض من مواد الملف الجزائي الخاص به.
يُحصر الاختصاص المادي للمحكمة حصراً تاماً، كما لحظ المدعي العام، بالاختصاص القضائي الذي تمنحه إياه المادة 1 من الاتفاق بين الأمم المتحدة والجمهورية اللبنانية المُرفق بقرار مجلس الأمن رقم 1757 (2007) والذي اعتمد في 30 أيار 2007 (المشار إليه في ما يلي باسم "الاتفاق") والمادتان 1 و2 من النظام الأساسي، أي مقاضاة الأشخاص المسؤولين عن الاعتداء الذي وقع في 14 شباط 2005 وأدّى إلى مقتل رئيس الوزراء اللبناني السابق رفيق الحريري وآخرين، وعند الاقتضاء، مقاضاة مرتكبي اعتداءات أخرى متلازمة. لذا، لا يمكن المحكمة تجاوز هذا الاختصاص قانوناً من دون خرق مبدأي القانونية والاختصاص الأساسيين.
ولكن، وفقاً للاجتهاد المستمر لمحكمة العدل الدولية، والمحاكم الجنائية الدولية، وغيرها من المحاكم الدولية، تتمتّع كل محكمة دولية بسلطة الفصل في مسائل لا تدخل ضمن اختصاصها الأصلي بحد ذاته، ولكن تتصل به اتصالاً وثيقاً، مما يحتّم دراسة هذه المسائل ضماناً للإنصاف في الاجراءات ولحسن سير العدالة. وبمعنى آخر، تتمتّع المحكمة، في إطار تأديتها لمهماتها الرسمية، باختصاص ضمني للفصل في مسائل فرعية تتعلق بمهماتها أو قد يكون لها وقع عليها، ويجب الفصل فيها خدمة لمصلحة العدالة.
تجدر الاشارة في هذا الاطار الى ان النظام الأساسي للمحكمة والقواعد لا تمنح المستدعي صراحة صفة تخوّله الحصول على مواد الملف الجزائي الذي اتهم واعتقل بموجبه. لكن موضوع الطلب يدخل ضمن السلطات الضمنية للمحكمة إذ انه يتصل بصورة وثيقة باختصاصها المادي الأصلي وان الفصل فيه ضروري ضماناً للإنصاف في الاجراءات ولحسن سير العدالة.
في هذا الصدد، يتناول الطلب الملف الخاص بقضية الاعتداء الذي استهدف رئيس الوزراء اللبناني السابق رفيق الحريري وأشخاص آخرين. ولكن منذ العاشر من نيسان 2009، ووفقاً للمادة 4، الفقرة 2 من النظام الأساسي، أصبح للمحكمة أسبقية على المحاكم اللبنانية في هذه القضية، فباتت تتمتّع مذذاك باختصاص حصري في شأنها كونها المحكمة الوحيدة المكلّفة بالنظر في هذه القضية والتي تحوز مواد هذا الملف.
على صعيد آخر، يقوم الطلب على أحد الجوانب الأساسية لحقوق الدفاع كما ينص عليها القانون الدولي، أي المتّهم في الحصول على مواد الملف، وهو حق يجب أن تضمنه المحكمة خدمة لمصلحة العدالة. وسوف يتطرّق قاضي الاجراءات التمهيدية الى هذه النقطة عند معالجة المسألة الثالثة الواردة في الفقرة 28 أعلاه.
لذا، ونظراً الى اختصاصها الحصري، إذا قضت المحكمة بعدم اختصاصها للفصل في هذا الطلب، تحرم المستدعي امكان نظر قاض في مطالبه بتنفيذ أحد حقوقه الأساسية، فتجرّده بذلك من حقه في الاستفادة من حماية قانونية فعلية.
ختاماً وبناء على ذلك، تتمتّع المحكمة بالاختصاص للفصل في الطلب.
- صفة المستدعي للادعاء أمام المحكمة:
بعد تبيان اختصاص المحكمة للفصل في الطلب، يجب تحديد ما اذا كان المستدعي يتمتع بصفة الادعاء أمام المحكمة.
في هذا السياق، يلحظ قاضي الاجراءات التمهيدية أن المستدعي لا يُعتبر فريقاً كالمدعي العام والدفاع وفقاً للمادة 2 من القواعد، ولا متضرراً مشاركاً في الاجراءات وفقاً للمواد 2 و17 و86 من القواعد، ولا حتى طرفاً ثالثاً أو صديقاً للمحكمة بحسب المادة 131 من القواعد، وكما أحسن المدعي العام الاشارة، لا ينص صراحة الاتفاق ولا النظام الاساسي للمحكمة ولا القواعد على امكان شخص من غير الاشخاص السالفي الذكر تقديم طلبات الى المحكمة.
ولكن رغم ذلك، لا يعتبر المستدعي غير معني بالاجراءات المقامة والمتواصلة امام المحكمة، اذ تنص المادة 4، الفقرة 2 من النظام الاساسي على ان "ينقل الاشخاص المحتجزون (من السلطات القضائية اللبنانية) رهن التحقيق (في قضية الحريري) الى عهدة المحكمة"، كما تقضي المادة 17، الفقرتان "الف" و"باء" من القواعد بأن يفصل قاضي الاجراءات التمهيدية في مواصلة احتجاز هؤلاء الاشخاص ضمن مهلة معقولة بدءا من تاريخ نقلهم الى عهدة المحكمة، والحال ان المستدعي هو أحد هؤلاء الاشخاص.
على وجه التحديد، أصدر قاضي تحقيق لبناني مذكرة توقيف بحق المستدعي وجهت اليه تهمة ارتكاب جرم أبلغ اليه بموجب المادة 107 من قانون أصول المحاكمات الجزائية اللبناني الجديد. بناء على ذلك احتجز المستدعي من السلطات القضائية اللبنانية من 30 آب 2005 الى 10 نيسان 2009 اي الى تاريخ نقل ملفه الى المحكمة. وقد نقل المستدعي الى عهدة المحكمة في هذا التاريخ وفقا للقرار الصادر في 7 نيسان 2009 عن قاضي التحقيق لدى المجلس العدلي اللبناني، ثم احتجز تحت سلطة المحكمة من 10 نيسان 2009 الى 29 نيسان 2009، وهو تاريخ تخلية سبيله من قاضي الاجراءات التمهيدية.
وتجدر الاشارة هنا الى ان المدعي العام لم يوجه تهمة الى المستدعي منذ تاريخ نقله الى عهدة المحكمة، ولكن لم يصدر قرار بمنع محاكمته. وفي هذا الاطار، ينبغي التذكير بأن تخلية سبيل المستدعي قد تم من "دون المساس بملاحقات محتملة قد تلجأ اليها المحكمة الخاصة لاحقا، كما ينص عليه قرار قاضي الاجراءات التمهيدية الصادر بتاريخ 29 نيسان 2009".
في ضوء هذه الظروف، يتمتع المستدعي بصفة الادعاء امام المحكمة بشأن المسائل المتعلقة بحرمانه حريته".
د – الحق في الحصول على الملف الجزائي وشروط انفاذه
بما أن للمحكمة اختصاصا للفصل في الطلب وللمستدعي صفة للادعاء أمامها، يتعين الان تحديد ما اذا كان من حق المستدعي، نظرا الى وضعه المبين في الفقرات 39 الى 41 اعلاه، الحصول على الملف الجزائي الخاص به، وفي حال الايجاب يجب النظر في كيفية تنفيذ هذا الحق وتحديد، عند الاقتضاء، نطاقه وشروطه.
تجدر الملاحظة ان الحق في الحصول على الملف الجزائي هو حق يمنحه القانون العرفي الدولي لكل شخص متهم. ويشكل هذا الحق احدى أبرز الوسائل لضمان تنفيذ فاعل لحقوق الدفاع، ولا سيما لغرض الطعن بقانونية الاحتجاز وبطبيعته التعسفية.
لا تنص الصكوك الدولية الرئيسة المتعلقة بحقوق الانسان على هذا الحق صراحة، ولكنه نتيجة مباشرة لحقوق الدفاع المكرسة في هذه الصكوك، ولا سيما الحق في الاستفادة من كل الوسائل لاعداد الدفاع والحق في الاطلاع بالتفصيل على الاتهامات الموجهة الى الشخص ومبدأ تكافؤ وسائل الدفاع، وتعترف دول عدة بهذا الحق، أكانت تعتمد العرف الروماني الجرماني او القانون العام، وكذلك الهيئات الدولية الرئيسة لحماية حقوق الانسان، ومنها لجنة حقوق الانسان والمحكمة الاوروبية.
وينبغي التذكير في هذا السياق ان لبنان صادق في 3 تشرين الثاني 1972 على العهد الدولي الخاص بالحقوق المدنية والسياسية (المشار اليه في ما يلي باسم "العهد") الذي دخل حيز التنفيذ بتاريخ 23 آذار 1976، علاوة على ذلك، بيد ان لبنان ليس طرفا في الاتفاق الاوروبي لحماية حقوق الانسان والحريات الاساسية التي دخلت حيز النفاذ في 3 ايلول 1953 (والمشار اليها في ما يلي بعبارة "الاتفاق الاوروبي")، إلا أنه يمكن الاهتداء باجتهاد المحكمة الاوروبية اذ سمح بتحديد ملامح الحقوق التي تضمنها هذا الاتفاق، مع الأخذ في الاعتبار وجود قاسم مشترك بين مختلف الانظمة القانونية للدول الاطراف فيه سواء كانت تعتمد القانون المدني او القانون العام. فضلا عن ذلك، ترتدي المبادىء العامة المنبثقة من هذه الانظمة القانونية أهمية خاصة بالنسبة الى المحكمة اذ ان اجتهاد المحكمة الاوروبية يعتبر مرجعا في مجال حقوق الانسان لهيئات قضائية وطنية عدة غير ملتزمة الاتفاق الاوروبي من المحاكم الدولية.
ففي قضية "مورين ضد المانيا" (Moren c. Allemagne) مثلا، أشارت المحكمة الاوروبية الى ما يلي:
"[ترجمة] لا يكون مبدأ تكافؤ وسائل الدفاع مضمونا اذا منع محامي الدفاع من الحصول على مواد الملف التي ترتدي اهمية جوهرية لغرض الطعن بقانونية احتجاز موكله بصورة.
ومن هذا المنظور، اعتبرت المحكمة الاوروبية في قضية "اوج الان ضد تركيا (Ocalan c. Turquie) أن:
"[ترجمة] […] عدم استفادة المستدعي من الحق في الاطلاع على مستندات الملف بصورة مناسبة باستثناء قرار الاتهام الصادر بحقه، تساهم ايضا في تعقيد اعداد دفاعه، رغم احكام المادة 6، الفقرة الاولى، عطفا على احكام الفقرة 3 (ب).
"[ترجمة] […] يشكل مبدأ تكافؤ وسائل الدفاع جزءا من مفهوم اوسع، وهو مبدأ المحاكمة العادلة الذي يضم ايضا الحق الاساسي في اقامة اجراءات جزائية وجاهية. وينطوي الحق في الحصول على محاكمة جزائية وجاهية، أكان لطرف الدفاع ام للادعاء، على قدرة الاطلاع على الملاحظات والأدلة الصادرة عن الفريق الآخر ومناقشتها. يمكن التشريعات الوطنية تلبية هذا المطلب بمختلف الطرق، على ان تضمن الطريقة المعتمدة تمتع فريق الدفاع بامكان حقيقي للتعليق على الاتهامات.
كما تكرس المادة 110 من القواعد بصورة غير مباشرة حق المتهم في الحصول على مواد الملف الجزائي الخاص به. اذ تنص احكام هذه المادة على ان يتسلم المتهم "نسخا عن الادلة المؤيدة التي ارفقت بقرار الاتهام عند طلب المصادقة عليه، وايضا جميع افادات المتهم التي تلقاها المدعي العام"، وذلك في غضون 30 يوما من مثوله الاول امام المحكمة او في اي مهلة اخرى يحددها قاضي الاجراءات التمهيدية. كما ينبغي ان يحصل ضمن المهلة التي حددها قاضي الاجراءات التمهيدية او غرفة الدرجة الاولى على نسخ عن افادات جميع شهود الادعاء، وكل الافادات الخطية، ونصوص الافادات، او سواها من النصوص التي تم تنظيمها.
اما في ما يتعلق بالاتهام، فينبغي التعاطي مع هذا المفهوم بمرونة كما اشارت اليه المحكمة الاوروبية، اذ يجب الا يفهم بمعناه الصارم، بل بما يعني "ابلاغا رسميا صادرا عن السلطة المختصة يوجه اتهاما بارتكاب جرم"، ويتطابق ايضا ومفهوم ترتب "انعكاسات جسيمة على وضع المشتبه به" “(اضيفت هذه العبارة بالخط المائل).
اخيرا، تظل حقوق الدفاع قائمة حتى اذا لم يعد الشخص الخاضع لتحقيق جزائي متهما بصورة رسمية او اذا صدر قرار بمنع محاكمته. ويطبق ذلك ايضا على الحق في الحصول على الملف الجزائي، فلا يمكن ان يسقط هذا الحق بمجرد تخلية الشخص المعني. اذ ينبغي ان يكون الحق في الاطلاع على المواد المستخدمة في الاجراءات بمثابة النتيجة الطبيعية للحق الاساسي في الحصول، عند الاقتضاء، على تعويض عن الضرر الناتج من احتجاز غير قانوني، وهو حق مكرس في الصكوك الرئيسة لحماية حقوق الانسان، والا بقي هذا الحق حبرا على ورق، وذلك لعدم التمكن من اثبات عدم قانونية الاحتجاز.
لذا، مع ان المحكمة لم توجه اتهاما رسميا الى المستدعي، ينبغي ان يؤخذ في الاعتبار تبلغه، في مذكرة التوقيف الصادرة عن السلطات القضائية اللبنانية، الجرم المسند اليه وما ترتب عليه من انعكاسات جسيمة على وضعه وخصوصا بسبب احتجازه، رغم انتهاء هذا الاحتجاز. وفي هذا الصدد، يجب ان يستفيد المستدعي من الحقوق الاساسية للدفاع المماثلة لتلك الممنوحة لاي شخص متهم، كالحق في الاطلاع على ملفه الجزائي.
اما في ما يتعلق بمسألة تنفيذ الحق في الحصول على الملف الجزائي، فيتبين وفقا للتشريعات والاجتهادات الوطنية والدولية ان هذا الحق ليس مطلقا، اذ قد يخضع لبعض القيود ولا سيما أن تسليم المواد المعنية قد يؤثر سلبا في تحقيق جار او لا احق، او يتنافى ومصالح اساسية كسلامة الاشخاص المعنيين بهذه المواد، او يمس الامن الوطني او الدولي. كما يمكن ان ترتبط هذه القيود بالصعوبات الملازمة لاجراء التحقيقات في مجال الارهاب. في بعض الحالات، ومن اجل تذليل هذه الصعوبات، سلم باحترام هذا الحق حتى لو لم يمنح الحق في الاطلاع على الملف سوى لمحامي المتهم.
كما قد تحد اعتبارات اخرى من امكان الطلب مباشرة من المحكمة المواد التي قد تحوزها. فتلزم آليات المساعدة المتبادلة والتعاون الدولي التقليدية بين الدول على سبيل المثال، الاطراف الثالثة باللجوء الى السلطات الوطنية المختصة للتقدم بمثل هذه الطلبات. وفي هذا السياق، تطلب المحكمة الجنائية الدولية ليوغوسلافيا السابقة، في اطار الاجراءات المنصوص عليها في المادة 75، الفقرة "حاء" من قواعد الاجراءات والاثبات، ان ترفع طلبات التعاون الى قضاة المحكمة مع الحصول، مبدئيا، على موافقة قاض وطني او هيئة قضائية وطنية، وذلك من دون المساس بتلك التي يجوز توجيهها مباشرة الى المدعي العام.
في ضوء هذه الاعتبارات، يجدر تحديد ما اذا كان يمكن المستدعي، في هذه الحالة، ممارسة حقه في الحصول على الملف الجزائي أو اذا تطبق هنا القيود والحدود المذكورة اعلاه او سواها. وفي هذا الصدد، كان قاضي الاجراءات التمهيدية قد دعا المستدعي والمدعي العام الى معالجة هذه المسائل في جلسة انعقدت في 13 تموز /يوليو 2010 /104 فشدد فيها المستدعي على ان (1) القانون اللبناني لا يفرض أي قيود في مجال الإرهاب في ما يتعلق بحق المتهم في الحصول على ملفه الخاص، وأنه (2) وفقاً للمادة 76 من قانون أصول المحاكمات الجزائية اللبناني، يجب أن يتمكن هذا الأخير من الاطلاع على هذه المواد قبل استجوابه من القاضي، وأن (3) السلطات السورية المكلفة حالياً النظر في قضية "شهادات الزور" لن توجّه أي طلب مساعدة الى المحكمة لأنها لا تعترف باختصاصها. ولكن لم يشأ المدعي العام التطرق الى هذه المسائل معتبراً انها تمسّ بأساس الملف وأنها غير مرتبطة فقط بإشكاليتي الاختصاص وصفة المستدعي للادعاء أمام المحكمة، اللتين يجري الفصل فيهما في هذه المرحلة من الاجراءات. وعلى صعيد آخر، طلب المدعي العام مهلة للإدلاء بملاحظاته خطياً حول هذه المسائل الأساسية.
بما أنه تم التسليم باختصاص المحكمة وبتمتّع المستدعي بصفة الادعاء بغية إنفاذ حقه في الحصول على الملف الجزائي، لم يُعد موضوع اندراج إشكالية القيود أو الحدود لهذا الحق ضمن اساس الملف مطروحاً. ولكن في هذه المرحلة من الإجراءات، ينبغي السماح للمدعي العام وللمستدعي بعرض ملاحظاتهما وحججهما في هذا الصدد.
من هذا المنطلق، يدعو قاضي الاجراءات التمهيدية كلاً من المستدعي والمدعي العام، وهو الوحيد الذي يحوز الملف الخاص بقضية الحريري، الى الاجابة على الأسئلة الآتية وفقاً للشروط والمهل المبيّنة في هذا القرار:
في المرحلة الراهنة للتحقيق:
1 - هل تدخل كل المواد التي يطلب المستدعي الحصول عليها في الملف الجزائي الخاص به وهل هي في حوزة المدعي العام؟
2 – هل تُطبّق القيود والحدود المذكورة في الفقرتين 53 و54 أعلاه على هذه الحالة المعيّنة؟
3 – هل تُطبّق قيود وحدود أخرى؟
4 – في حال وجود قيود وحدود اخرى، هل تُطبّق على كل المواد التي يطلب المستدعي الحصول عليها أو على البعض منها فقط، وفي هذه الحال، على أي منها؟
5 – في حال مُنح المستدعي الحق في الحصول على الملف، كيف يتم ذلك؟ بمعنى آخر، هل يجب أن تسلم المواد أو النسخ عنها إلى المستدعي أو لن يحق له سوى الاطلاع عليها؟ وهل يجب أن يُحصر الحق في الاطلاع عليها على محاميه فقط؟
6 – هل تطبّق آليات المساعدة المتبادلة الدولية في الشؤون القضائية، وفي هذه الحال، ما الذي يترتّب عليها من نتائج بالنسبة الى طلب المستدعي؟
خامساً - الحكم:
لهذه الأسباب وبموجب المادة 1 والمادة 4، والمادة 16 من النظام الأساسي، إن قاضي الاجراءات التمهيدية، يعلن أن المحكمة المختصة للفصل في أساس الطلب، ويعلن أن المستدعي يتمتع بصفة الادعاء أمام المحكمة بغية الحصول على مواد الملف الجزائي المتعلق بقضية الحريري الخاص به، ويقرّر، قبل الفصل في أساس الطلب، أن تودع المذكرات الخطية للمستدعي والمدعي العام التي تضم إجاباتهما عن الأسئلة المطروحة في الفقرة 57 من هذا القرار قلم المحكمة ضمن مهلة أقصاها الأول من تشرين الأول 2010، ويقرّر أن تُسلّم المذكرات الى المستدعي والمدعى العام في الوقت نفسه بعد ترجمة مذكرة المدعي العام الى الفرنسية.
ويقرّر أن يودع المستدعي والمدعي العام إجاباتهما قلم المحكمة في غضون 10 أيام من تاريخ التسليم المتزامن للمذكرات، مع ترجمة مذكرة المدعي العام إلى الفرنسية".

Iloubnan - Kabbara: STL enemy is our enemy too - September 20, 2010

“Enemies of justice and truth, who are Iran’s party and its allies, have torpedoed the Lebanese State in order to torpedo the international tribunal”, he said. He ensured that, “War against the State, the Lebanese authorities and the people, has just started, thus, we must be ready to face it”.

Iloubnan - Sakr accuses Jamil Sayyed of fabricating Der Spiegel report and ensures Hariri won’t let Hezbollah make harm to itself - September 20, 2010

After the weekend shocking incident at Beirut airport that blew up condemning reactions, Lebanon First bloc MP Okab Sakr delivered a much heated address on Monday, strongly lashing out at former general Jamil Sayyed. In a press conference held in March 14 Coalition headquarters, Sakr accused Sayyed of fabricating Der Spiegel report, a 1.5 year ago, in order to sow the seeds of discord in Lebanon.

“On this September 20, 2010, I would like to pay tribute to the Maronite Patriarch Nasrallah Boutros Sfeir who initiated on September 20, 2000, the Appeal of Maronite Bishops to end the Syrian occupation in Lebanon and manage a true national unity”, Sakr started. “I would like to point out, first of all, that the current battle in Lebanon is not sectarian at all. It is neither Sunnis against Shiites, nor State against Opposition because we have a national unity Cabinet, not even a March 14 battle because the positions of both Speaker Nabih Berri and MP Sleiman Franjieh are totally different from the ones of the rest of opposition. So, could the first have rallied March 14 Coalition’s ranks?” Sakr replied in fact to the virulent campaign and attack led by general Sayyed against Prime Minister Saad Hariri and his allies.

“By making this flow of accusations, Sayyed is seeking to drag Lebanon into an endless crisis in order to defend himself but I will show you now the plot he was sewing from one year and a half”, he said. “A year and a half ago, the crisis started in Lebanon with the famous Der Spiegel article which reported the involvement of Hezbollah members in the assassination of former Premier Rafic Hariri. Since that time, Hezbollah has threatened to “cut the hands” of the report’s author as well as a flow of threats which repercussions would only target Lebanon”.

“Afterwards, we heard about communication of information then reporting, wither to the Special Tribunal for Lebanon’s panel or media or other jurisdictions, followed by contradicting statements. All of that ended up by showing that Der Spiegel was fabricated, communicated and reported by Jamil Sayyed himself in order to protect himself and sow the seeds of discord in Lebanon”. “The game is over, you opened and unveiled all cards, Mr. Sayyed, along with the secret of this Der Spiegel affair”, Sakr signaled, proving that the report was issued in April 2009, one year prior to the behind closed doors meeting between PM Hariri and Hezbollah secretary general Hassan Nassrallah which occurred in April 2010.

Thus, he said, the reported information didn’t come from investigating sources but from elsewhere; they were purely fabricated by Jamil Sayyed in order to set up turmoil in Lebanon. What happened, he said, on Sunday at Rafic Hariri International Airport has only harmed its perpetrators and showed that status quo power was the ruling authority. Commenting Hezbollah’s appeal to sentence the mastermind of Der Spiegel report, Sakr called on it to “listen to Speaker Nabih Berri and positively respond to the openness of PM Hariri in order to shelter Lebanon any endless crisis, amid the troubles that are arising all over the Arab world”.

Addressing the false witnesses issue, Sakr made it clear that neither Internal Security Forces Director General Ashraf Rifi, nor ISF Intelligence Desk head general Wissam Hassan nor head of security of prisons general Antoine Chakkour had probed or questioned any of the “false witnesses”, not even the General Prosecutor Said Mirza who used to hand them over to the STL.

“Sayyed requested an indemnity of $15 million then, slammed a ‘broker’ between Hezbollah and Hariri whom he revealed the name, Mostapha Nasser, in order to get $7 million as indemnity. If the issue can be settled with some dollars, let it be! Just go to courts and win your case legally, but you cannot use the streets to recover your right as you claim”, Sakr pointed.

To sum up, Sakr stressed anew that as long as March 14 Coalition existed along with Saad Hariri in Prime Ministry, there is no fear for Lebanon or for the civil peace. Sakr ensured that PM Hariri would endeavor to the maximum in order to save Lebanon’s security and prevent Hezbollah from making any harm to itself. “Yes for civil peace. No for civil surrender. Yes for State resistance. No for resistance against the State”. Sakr concluded.

وقال في تصريح لوكالة "فرانس برس" امس: "انا تحت القانون، لكن باعتبار انني كنت في الماضي أقمت دعاوى بحق المدعي العام التمييزي سعيد ميرزا في موضوع تورطه في قضية شهود الزور، تكف يد هذا القاضي تلقائيا عن اي اجراء يتعلق بي لوجود خصومة شخصية بيني وبينه. هذا موجود في القانون اللبناني والدولي".
وأوضح انه تقدم الجمعة الماضي "بمراجعة امام الغرفة الجزائية لدى محكمة التمييز طالبا تنحية القاضي ميرزا وانا في انتظار صدور القرار".
أضاف: "المدعي العام هو خصمي الشخصي وقد تقدمت بالوثائق التي تثبت ذلك، وبالتالي فإن كل الاجراءات الصادرة عنه بما فيها التبليغ لم يعد جائزا حكما بحسب القانون". وأكد انه "لم يبلغ بعد" بأي موعد للمثول امام القضاء بشأن تهمة "التهديدات".
ورأى أن الاستقبال الذي حظي به في مطار رفيق الحريري الدولي اول من امس، كان "دعما للقانون من خلال الدعم السياسي والشعبي بعدما يئست من ان يقوم سعد الحريري بمحاسبة شهود الزور".
اضاف: "خمس سنوات وانا اطالب بمحاسبة شهود الزور عبر القانون، لكن يبدو انك عندما تلجأ الى القانون في بلد مثل لبنان فإن المسؤولين في الدولة يستخفون بك الا اذا كان معك دعم سياسي وشعبي".
وتابع: "كلما منعتم القانون سنحاسب شهود الزور في الشارع وهذه هي معادلتنا. انا ابن الدولة وخدمت فيها اربعين سنة وبالتالي انا احتكم الى المؤسسات (...) قلت فقط ان هناك طبقة سياسية اخترعت شهود الزور (...) ويحق للمواطنين استخدام كل مظاهر التعبير والاحتجاج والتظاهر في الشارع ضد هذه الطبقة كما يحصل في كل البلدان الديموقراطية".

In a statement issued Monday, Mustafa Nasser denied having “a relationship of any kind with [former General Security chief] Jamil as-Sayyed,” adding that “what is circulating in the media regarding my mediation is inaccurate.”

Earlier Monday, Lebanon First bloc MP Okab Sakr said that Nasser was the go-between for Sayyed’s unsuccessful request for a multi-million dollar settlement from Prime Minister Saad Hariri in exchange for dropping a lawsuit that Sayyed filed in Damascus in December 2009 against Lebanese and Syrian public figures.

“In all of my journalistic and political life, I have not performed any role except that of communication between the martyr [former] Prime Minister Rafik Hariri and Hezbollah, then between PM Saad Hariri and Hezbollah,” Nasser added.

March 14 politicians should stop talking about militias, Minister of Agriculture Hussein al-Hajj Hassan told al-Manar television on Monday evening, asking “is it not militia behavior to imprison someone without any evidence?”

Former General Security chief Jamil as-Sayyed was held for four years on suspicion of involvement in former Prime Minister Rafik Hariri’s 2005 assassination, then released in April 2009 due to lack of evidence.

In an interview with al-Mustaqbal newspaper published on Sunday, Lebanon First bloc MP Ahmad Fatfat said that “Hezbollah is not a resistance but has proven to be a militia that seeks to [carry out] a coup.”

In a press conference at Rafik Hariri International Airport on Saturday, Sayyed said that the Special Tribunal for Lebanon (STL) cannot be trusted until Lebanese learn why witnesses conspired to give false testimonies about the Rafik Hariri murder, adding that Prime Minister Saad Hariri and the March 14 alliance used such false witnesses to take over the government.

“The file on false witnesses will not be closed until the truth is made clear,” Hajj Hassan said.

Now Lebanon - Qamati: How did Geagea know about Sayyed’s summons? - September 20, 2010

How could Lebanese Forces (LF) leader Samir Geagea know about the judiciary’s summons of former General Security chief Jamil as-Sayyed, and “what is his legal capacity so that [he was able] to know?” Hezbollah official Mohammad Qamati asked while speaking to OTV on Monday.

As-Safir newspaper reported on Thursday that Geagea informed LF officials that Sayyed would be summoned for questioning. Later on Thursday, the LF issued a statement saying that this article’s report that Geagea said his party would confront those objecting to the summons was “nothing but a story from its writers’ imagination and is totally untrue.”

In a statement issued on Friday, Hezbollah called on the judiciary to revoke Attorney General Said Mirza’s decision to summon Sayyed for questioning about his threatening speeches.

Naharnet - French Sources Do Not Rule Out Indictment Postponement - September 20, 2010


French sources have said that Special Tribunal for Lebanon Prosecutor Daniel Bellemare is aware of the fragile situation in Lebanon and could mull postponing the indictment to avoid strife in the country.

The sources, which are following up the regional situation and inter-Arab ties, told pan-Arab daily al-Hayat in remarks published Monday that Bellemare has realized the indictment could have negative repercussions on Lebanon.

"Given the dangerous and fragile situation, he might have understood that he needs to postpone the indictment for some time," the sources said about the prosecutor.

However, French presidential circles have informed Lebanese and Arab officials that Paris cannot interfere in Bellemare's work.

They expressed fear that Lebanon is on a dangerous slope and said the issue of false witnesses in ex-Premier Rafik Hariri's assassination case is a trap set up by Hizbullah.

Furthermore, the sources regretted that Prime Minister Saad Hariri said it was wrong to accuse Syria of murdering his father because he has repeatedly said that "he trusted the international tribunal which alone would decide who is innocent and who is guilty."

MP Oqab Saqr on Monday accused former General Security Department chief Maj. Gen. Jamil Sayyed of fabricating the story published by German magazine Der Spiegel last year about the alleged involvement of Hizbullah in ex-Premier Rafik Hariri's assassination.

The report at the time had quoted sources close to the international tribunal and said it had examined internal documents.

"What was published by the German Der Spiegel was fabricated by Jamil Sayyed," Saqr said during a press conference.

"We don't want an apology from Hizbullah but we want the Lebanese to know … who spread the rumor" to Der Spiegel, the lawmaker said.

Last week, Saqr accused Sayyed of dispatching a man to Premier Saad Hariri asking for $15 million in return for giving up his case. "The mediator who asked for a financial settlement for Sayyed was Mustafa Nasser," the MP said during his press conference on Monday.

Saqr urged Hizbullah to beware and not to play with fire saying there were attempts to ignite Shiite-Sunni strife in the region, including Lebanon.

He also urged Nasrallah to "extend his arm" as Hariri has done and stop his "attempted coup" to avoid civil war.

Turning to the issue of false witnesses, Saqr said the March 14 forces want to know who fabricated them. Let Syrian authorities question Hussam Hussam, who is currently in Syria, to know who was behind him, the MP told Sayyed.

Naharnet - Hariri Murder Reenactment Postponed - September 20, 2010

A reenactment of the assassination of ex-Premier Rafik Hariri, which was scheduled to be staged in France on September 28, was postponed till October, As Safir daily reported Monday.

The exercise is to take place under tight security at a military base in Captieux, in the Gironde region, southwest France. It normally serves as an army firing range.

Parts of the Beirut street that Hariri's convoy had taken and the surrounding buildings had been reconstructed for the exercise.

A French source told As Safir last week that French security sides were calling for the annulment of the reenactment in order not to interpret it as a political decision aimed at supporting the indictment that could be issued by the Special Tribunal for Lebanon prosecutor against Hizbullah members.

The authorities that are overseeing the reenactment have told journalists that they postponed the event because they needed more time to implement security measures in the area.

Meanwhile, a French source denied to el-Shark newspaper that the reenactment was cancelled. He said the date of the event would be announced at a later stage.

Selon lui, le TSL « s'est enlisé dans un jeu politique arbitraire visant à un règlement de comptes avec la résistance en faveur d'Israël ». Et le député de se demander si M. Hariri ne cherche pas plutôt à gagner du temps en œuvrant à apaiser les esprits en attendant l'acte d'accusation. M. Kandil a en outre considéré qu'il était « honteux d'entendre dire par certains que Saad Hariri est le Premier ministre des sunnites et que la résistance est chiite », insistant sur le fait que dès le moment où M. Hariri est devenu chef du gouvernement, il l'est devenu pour l'ensemble des Libanais. Et de se demander si la résistance a libéré le seul territoire chiite, en occultant les villages sunnites, druzes ou chrétiens, ou si au contraire elle n'a pas libéré l'ensemble des territoires libanais qui se trouvaient sous l'occupation.

Le président du parti Kataëb Amine Gemayel a visité hier les différentes autorités religieuses de Zahlé, notamment le mufti de Zahlé et de la Békaa, cheikh Khalil el-Maïss, l'évêque maronite de Zahlé, Mgr Mansour Hobeika, et l'évêque grec-catholique de la ville, Mgr André Haddad. À l'issue de sa visite à l'évêché maronite, il a appelé les hommes politiques à adopter un discours moins tendu, qualifiant les discours d'escalade de « suicidaires pour ceux qui les prononcent ». Interrogé sur la proposition du député Walid Joumblatt d'annuler le Tribunal spécial pour le Liban (TSL) à moins qu'il ne fasse l'unanimité, M. Gemayel a répondu qu'« empêcher le TSL de suivre son cours et d'émettre un jugement, c'est autoriser de nouveaux assassinats à l'avenir ».
Sur les relations avec la Syrie, il a préconisé « un dialogue transparent entre les deux pays, à travers lequel tous les dossiers seront ouverts ».

La veille, au cours du dîner annuel du bureau Kataëb de Zahlé, M. Gemayel a estimé que « le refus du TSL n'entravera pas le processus déjà en marche ni n'empêchera l'annonce de la vérité, mais exposera le Liban au danger ». « Si un conflit éclate, personne n'en sortira gagnant, et personne ne deviendra innocent s'il est accusé, et vice versa, a-t-il souligné. Aucun innocent ne doit être accusé, mais les parents de martyrs tiennent à la justice internationale. »
M. Gemayel a affirmé que « le Hezbollah doit se comporter avec l'État, l'armée et le peuple libanais en tant que parti qui respecte la loi, non en tant que parti qui se place au-dessus de toutes les lois et de toutes les autorités ».
Sur les relations libano-syriennes, il a trouvé qu'« il est de l'intérêt des deux pays que cette relation s'organise dans un cadre institutionnel », dénonçant « ceux qui utilisent leurs liens avec la Syrie pour faire de la surenchère, et qui l'utilisent pour affirmer leur pouvoir sur leurs partenaires nationaux ».

La situation

C'est une véritable tempête politique qui souffle sur le pays depuis samedi, consécutivement à l'arrivée intempestive de l'ancien directeur de la Sûreté générale, Jamil Sayyed, à Beyrouth.

L'accueil « officiel » réservé à M. Sayyed au salon de l'aéroport où des députés du Hezbollah et du CPL l'attendaient, la démonstration de force du parti de Dieu, qui a déployé son service de sécurité autour et à l'intérieur de l'aéroport, a eu pour effet d'enflammer la majorité et notamment le Courant du futur, dont les députés ont réagi au quart de tour.
La contre-attaque était d'une violence singulière comme en témoignent particulièrement la déclaration du député Mohammaed Kabbara et le communiqué des députés du Akkar. Pour M. Kabbara, les positions du Hezbollah et de son « protégé » sont l'expression d'une guerre menée simultanément contre le leadership sunnite et l'État dans le but de les affaiblir. Pour les députés du Akkar, le Hezbollah est devenu pratiquement « une milice ». Les deux positions se recoupent autour d'une même idée : le fait que le Hezbollah ne tienne plus compte de ce que la déclaration ministérielle et la conférence nationale du dialogue prévoient au sujet du Tribunal spécial pour le Liban donne à la majorité la latitude de revenir elle aussi sur son engagement en faveur du trinôme prôné par le Hezbollah : Résistance-armée-peuple.
Faut-il craindre le pire ? Le pire est ce qu'on redoute dans certains milieux de la majorité, où l'on voit pointer à l'horizon un deuxième 7 mai, partant du principe que le Hezbollah est prêt à tout pour défaire l'engagement du Liban en faveur du TSL et empêcher la publication de l'acte d'accusation dans l'affaire de l'assassinat de Rafic Hariri. Sauf que cette fois, les sunnites ne se laisseront pas faire, note-t-on dans ces milieux.
Dans d'autres milieux, on estime au contraire que la polémique, aussi violente soit-elle, ne dépassera pas le seuil des échanges d'accusation, aussi bien la Syrie et l'Arabie saoudite étant soucieuses d'empêcher que la guerre verbale ne dégénère. C'est ce discours qu'un émissaire du Hezbollah a entendu récemment à Damas. C'est aussi ce même discours que M. Sayyed aurait également entendu dans la capitale syrienne.
La montée en flèche des positions de part et d'autre a ainsi eu pour effet d'accélérer les contacts politiques menés loin des feux de la rampe pour atténuer la tension politique. Signe que ces contacts ont abouti, sans qu'on ne sache exactement sur quoi pourrait reposer une entente : le Premier ministre, Saad Hariri, qui a prolongé son séjour à Riyad sur conseil de l'Arabie saoudite, sera de retour aujourd'hui et le Conseil des ministres se tiendra demain à Baabda. Au cours de cette réunion, le président Michel Sleiman mettrait de nouveau l'accent sur le respect des institutions et tiendrait de la sorte presque le même discours qu'il avait tenu au lendemain des attaques du chef du CPL, le général Michel Aoun, contre les services de sécurité.
Le bloc parlementaire du président de la Chambre, Nabih Berry, qui tiendra une réunion aujourd'hui est appelé à faire écho au chef de l'État. Il est intéressant de noter dans ce cadre que le ton virulent du Hezbollah qui a poursuivi sa campagne contre les faux témoins au cours du week-end tranchait avec celui, apaisant et pondéré, des ténors du mouvement Amal, mais pas avec celui du général Aoun, qui a affirmé, dans une déclaration à la chaîne satellitaire al-Jazira qu'il « conduit une révolution intellectuelle au Liban pour changer la manière avec laquelle le pays est gouverné et pour imposer le respect des lois ». Le respect des procédures judiciaires ne devrait pas en faire partie ? La question se pose.
Quoi qu'il en soit, de sources informées, on assure que la procédure judiciaire engagée contre M. Sayyed suit son cours normalement et qu'il n'est pas question de faire machine arrière, quitte à ce que les ministres du 8 Mars se retirent du gouvernement en signe de protestation. L'ancien directeur de la Sûreté estime qu'il n'a pas été notifié de la convocation du parquet mais, de sources judiciaires, on souligne que le fait qu'il en parle publiquement, à travers les médias, est une reconnaissance de cette notification.
Étant donné la détermination dont chacun des deux camps fait montre, il est légitime de s'interroger sur la forme que prendrait un règlement. Selon les mêmes sources, la solution ne peut être que politique.
Toute l'attention est ainsi portée sur Damas où un émissaire saoudien est attendu aujourd'hui pour des contacts qui seront axés principalement sur le Liban. Riyad souhaite que la Syrie assume un rôle plus actif auprès de ses alliés, de peur d'une discorde sunnito-chiite qui éclabousserait en premier les pays de la région.

L'ancien directeur général de la Sûreté générale, Jamil Sayyed, est rentré samedi à Beyrouth, deux jours après sa convocation par le procureur général, Saïd Mirza, entouré des députés du Hezbollah et de certains députés du CPL, déterminés à le « protéger » sur le double plan politique et sécuritaire jusqu'au bout et visiblement à n'importe quel prix.
À l'aéroport international Rafic Hariri, où il a été reçu sur le tarmac par le responsable de la sécurité et de la discipline du Hezb, Wafic Safa, puis emmené au salon d'honneur sans que le ministère des Affaires étrangères n'en soit nullement informé, Jamil Sayyed, devant les députés du Hezb et d'autres du CPL du général Aoun, a donné une conférence de presse d'une rare violence au cours de laquelle il s'est attaqué au Premier ministre Saad Hariri, au Courant du futur ainsi qu'au procureur général Saïd Mirza, menaçant d'avoir recours à la rue « s'il le faudrait » pour que « justice soit faite ». Et juste avant lui, c'était le député hezbollahi Nawwaf Moussaoui qui s'était livré au même exercice, précisant que les députés présents représentaient le mouvement Amal et son chef, le président de la Chambre Nabih Berry, qui n'avaient délégué personne à l'aéroport.

« Que tous ceux qui m'entendent au Liban et à l'étranger sachent que ce qui se passe aujourd'hui dans le pays n'est pas un coup d'État ni un conflit avec la justice, comme se plaisent à répéter certaines parties de la majorité et du 14 Mars pour ouvrir la voie aux ingérences externes. Ces manifestations et cet accueil s'inscrivent dans une démarche de soutien à la vraie justice et à l'État. Cette justice ne peut exister tant que les faux témoins et ceux qui les manipulent ne seront pas jugés », a ainsi déclaré Jamil Sayyed. S'adressant au PM Saad Hariri, l'ancien directeur général de la SG a affirmé que les gens qui l'entourent, à l'instar de Saïd Mirza, Detlev Mehlis et Achraf Rifi, doivent se retrouver dans une prison du Liban ou de La Haye, accusant le PM d'avoir été, depuis 2005, leur complice pour « être à la tête du pouvoir ». « Ce que vous avez fait est le véritable coup d'État. La justice doit remonter jusqu'à ceux qui ont planifié et fabriqué les faux témoins, orientant l'enquête vers une fausse piste qui a entraîné des catastrophes entre le Liban et la Syrie », a-t-il ajouté.
Signalons que dans une interview recueillie hier par l'AFP, Jamil Sayyed a qualifié d'« illégales de facto » les poursuites lancées par la justice contre lui. « Dans un pays comme le Liban, quand vous recourez à la loi, on se moque de vous. Vous êtes donc obligé d'avoir recours à une démonstration de force politique ou populaire pour protéger vos droits et pour la bonne application de la loi », a-t-il jugé.

La cinglante réponse de Rifi
Dans un communiqué publié le même jour, soit samedi, le directeur général des FSI, le général Achraf Rifi, a vertement répondu à Jamil Sayyed : « C'est en prison que vous et vos semblables assassins que vous protégez devez croupir. Saïd Mirza et Wissam Hassan méritent des médailles pour ce qu'ils ont fait dans l'affaire des faux témoins. Vos aboiements ne serviront à rien et vos tentatives d'occulter le vrai problème, l'assassinat des martyrs, échoueront », écrit le général Rifi, assurant que les criminels seront bientôt sous les verrous. « Nous nous retrouverons en justice », a-t-il également promis.

The judiciary will not revoke its summons of former General Security chief Jamil as-Sayyed and his summons will become an arrest warrant if he does not respond, MTV quoted an anonymous judicial source as saying on Sunday.

In a statement issued on Friday, Hezbollah called on the judiciary to revoke Attorney General Judge Said Mirza’s decision to summon Sayyed for questioning after Sayyed said on September 12 that “[Prime Minister Saad Hariri] should take a lie detector test to prove he did not support or fund false witnesses in the Special Tribunal for Lebanon (STL).” The former General Security chief also threatened to take his right “with his own hands” if Hariri did not give it to him.

AFP reported that Sayyed was accompanied from the airport by armed Hezbollah bodyguards when he returned to Beirut on Saturday after a short visit to France.

Sayyed has argued that Mirza is not legally qualified to take judicial action against him because Mirza is one of several Lebanese and Syrian public figures named as defendants in a lawsuit Sayyed filed in Damascus in December 2009.

MTV also quoted an anonymous source close to Prime Minister Saad Hariri saying that the premier will not “evade confrontation if it is imposed upon him… or accept additional nails in the state’s coffin.”

Now Lebanon - March 14 holds emergency meeting to discuss Sayyed’s airport reception - September 19, 2010

The March 14 General Secretariat held an emergency meeting on Sunday evening to discuss “dangerous developments that occurred in the past hours, especially Hezbollah’s military and security seizure of Beirut’s Rafik Hariri International Airport,” according to a statement issued by the secretariat.

This comes after former General Security chief Jamil as-Sayyed was received Saturday at the airport by a delegation that reportedly included members of Hezbollah and other March 8 parties. AFP reported that Sayyed was accompanied from the airport by armed Hezbollah bodyguards after he returned from a short visit to Paris.

Now Lebanon - Airport was turned into a Hezbollah security zone, March 14 source says - September 20, 2010

An unnamed March 14 source told As-Sharq al-Awsat newspaper in an interview published on Monday that “Beirut’s [Rafik Hariri International] Airport was turned into one of Hezbollah’s security zones on Saturday, which reflects [negatively] on the [status] of airport security.”

On Saturday, armed Hezbollah bodyguards met and accompanied former General Security chief Jamil as-Sayyed upon his arrival in Beirut, after he was summoned by the court for questioning over his September 12 statement in which he attacked Prime Minister Saad Hariri.

Another prominent security source, who spoke on condition of anonymity, told the daily that “armed Hezbollah members stormed the airport premises and the VIP lounge without having permits from the Interior Ministry or Ministry of Foreign Affairs or airport security.” He added that such a step has actually damaged Hezbollah and the Resistance more than it did the state and its institutions.

The source also said that “ the Resistance has committed suicide and turned itself into a militia.”

Lebanese ex-general Jamil Sayyed who spent four years in jail without charges in connection with the assassination of former premier Rafiq Hariri said Sunday that ongoing legal action against him was "illegal."

Jamil Sayyed has brought lawsuits against prosecutor general Said Mirza, accusing him of producing "false evidence." "Mr. Mirza is supposed to be a public prosecutor, i.e. neutral, but considering these lawsuits he became my personal adversary," Sayyed said. He said that by law, "all proceedings by him (Mirza) are -- de facto -- illegal."

Sayyed, the former head of General Security, said he still had not been called in for questioning. Sayyed is one of four generals who say they were arbitrarily detained between August 2005 and April 2009 after they made strongly worded accusations about the Hariri case.

Asked about the welcoming of Sayyed at Rafik Hariri international airport on Saturday, they said the event was aimed at "removing injustice off him."

"There would either be a law that is implemented on everyone in this country or we would adopt the policy of each person according to his stance," the sources added.

An Nahar newspaper said Sunday that following a press conference at the lounge during which he unleashed his rage on several officials, Hizbullah took private security measures to escort Sayyed to his home in Beirut's Jnah neighborhood.

According to the daily, no one asked the foreign ministry to open the lounge which is usually earmarked for cabinet ministers, MPs and high-level state employees if they were tasked with carrying out missions abroad.

Head of Hizbullah's Security and Liaison Committee, Wafiq Safa, and his bodyguards were inside one of the vehicles which took Sayyed from the runway to the VIP lounge and then to this home, An Nahar said.

Sayyed arrived in Beirut from Paris on Saturday afternoon. During his press conference at the lounge, the former security chief launched a vehement attack against Prime Minister Saad Hariri, State Prosecutor Saeed Mirza, Police Chief Maj. Gen. "Saïd Mirza devrait être dessaisi de ses fonctions et placé à la disposition du Conseil supérieur de la magistrature car c'est conflit personnel qui l'oppose à moi", a poursuivi Sayyed, en référence à la plainte qu'il a déposée devant la justice libanaise et d'une autre devant la justice syrienne dans le cadre du dossier des faux témoins. Assassinat Hariri La tension politique monte au Liban en raison des pressions de plus en plus fortes exercées par le Hezbollah et ses alliés pour discréditer le Tribunal spécial pour le Liban (TSL), chargé d'enquêter sur l'assassinat de l'ancien Premier ministre libanais Rafic Hariri. Dernières salves en date, les députés du mouvement chiite et leurs alliés avaient refusé jeudi dernier d'approuver en commission une clause sur le financement du TSL, dans lequel Beyrouth participe à hauteur de 49%.

Vendredi et samedi, également, les députés du Hezb se sont répartis les attaques contre le tribunal, les faux témoins et la majorité. Bien que toujours verbales, jusqu'à présent, ces attaques sont perçues comme une nouvelle tentative de discréditer le tribunal, créé en 2007 par une résolution du Conseil de sécurité de l'ONU.

En juillet, le secrétaire général du Hezbollah Hassan Nasrallah avait annoncé s'attendre à ce que le TSL accuse des membres de son parti d'implication dans le meurtre de Hariri. Depuis, la formation chiite a haussé le ton contre le tribunal, l'accusant d'être "politisé" et "à la solde d'Israël".
"Pour le Hezbollah, si le gouvernement libanais décide que le tribunal est nul et non avenu, cela serait un pas important dans la bonne direction", explique Hilal Khachane, professeur de sciences politiques à l'Université américaine de Beyrouth.

"Le tribunal n'aurait ainsi plus de mécanisme pour appliquer ses décisions, notamment quand il s'agit d'appréhender au Liban des personnes poursuivies", a-t-il ajouté.
Dans une incroyable volte-face, le Premier ministre Saad Hariri a affirmé début septembre avoir commis une "erreur" en accusant la Syrie du meurtre de son père.
"Saad Hariri a fait une concession colossale équivalente à un tremblement de terre (...) et ce à quoi on assiste maintenant, ce sont les répliques, qui peuvent être aussi désastreuses que le séisme" lui-même, souligne M. Khachane.
Ainsi, Jamil Sayyed, l'ancien directeur de la Sûreté générale, écroué pendant quatre ans dans le cadre de l'enquête et libéré en 2009 en raison de l'absence d'"éléments de preuve suffisants", s'est attaqué à Saad Hariri. Il l'a accusé d'avoir "vendu le sang" de son père et d'avoir "faussé les pistes dès le départ", critiquant également la justice libanaise et le TSL et appelant les Libanais "à refuser l'état des choses dans le pays même si cela nécessite de faire tomber l'État par la force".
La justice libanaise a lancé des poursuites contre lui à la suite de ces propos. Sayyed est rentré quand même samedi à Beyrouth entouré des députés et de gardes du corps du Hezb. À l'aéroport, il s'est lancé dans une diatribe contre Hariri et le Courant du futur (voir par ailleurs).

Chafic Masri, un expert en droit international, craint que les tensions dégénèrent en violences: "Le tribunal est une institution internationale dans laquelle personne ne peut s'ingérer (...) mais personne ne sait où va mener cette boule de feu".
Si des membres du Hezbollah sont accusés par le TSL, certains craignent une répétition du conflit de mai 2008 qui avait opposé des partisans du mouvement chiite à des partisans de Saad Hariri, rappelant les années de la guerre civile (1975-90).
"Le Hezbollah et ses alliés veulent que le Premier ministre change de position sur le tribunal et, s'il ne le fait pas, ils peuvent faire pression sur lui", estime Paul Salem, directeur du centre Carnegie pour le Moyen-Orient.
"Ils peuvent faire tomber le gouvernement ou pousser à des troubles civils", poursuit-il. "Hariri est dans une position très, très, très difficile".
Pour Hilal Khachane, "Saad Hariri n'a aujourd'hui comme option que celle de faire des concessions (...) il s'est placé dans une situation où le loup est le juge".

“I request [Prime Minister Saad] Hariri’s apology for his policy that has persecuted me for four years and distorted my reputation,” Change and Reform bloc leader MP Michel Aoun told Al-Jazeera television on Saturday.

Aoun said that the March 8 coalition is not carrying out a coup, but “a political revolution on corruption and the attack on individuals’ rights.”

Last Tuesday, Aoun called on Lebanese citizens to not abide by requests from the Internal Security Forces (ISF)- Information Branch or Attorney General Said Mirza, adding that the state is falling and that “the judiciary is burning.”
Aoun reiterated his call for forming a parliamentary investigation committee to examine the actions of Attorney General Said Mirza, ISF Director General Achraf Rifi, and ISF-Information Branch head Wissam al-Hassan, and added that he is supporting former General Security chief Jamil as-Sayyed’s case because Sayyed was falsely accused.

In a press conference last week, Sayyed warned Hariri to “give me my right, [or] I swear on my honor that I [will] take it with my own hands.” He also called on the people to “revolt against authority and attack officials in their houses.”

Sayyed was detained from 2005 to 2009 on suspicion of involvement in the 2005 assassination of former Prime Minister Rafik Hariri. In April 2009, the Special Tribunal for Lebanon (STL) ordered his release due to lack of evidence.

In a fiery speech earlier on September 5, Aoun criticized the government and asked what Sleiman “is doing after his constitutional speech besides weeping.

“[Retired Brigadier General Fayez] Karam does not know of the details of my relations with Hezbollah or any other ally,” the MP added.

Karam- an FPM official- was arrested on August 5 on charges of spying for Israel.

In an interview with Sada al-Balad newspaper published on Sunday, Loyalty to the Resistance bloc MP Nawwar Sahili said that the Special Tribunal for Lebanon (STL) will not harm Hezbollah, adding that those who want to use the tribunal to target the party will be harmed themselves.

Hezbollah Secretary General Sayyed Hassan Nasrallah said in July that the STL is an Israeli project designed to target Hezbollah by stirring up sectarian strife in Lebanon.

“What concerns us is the country’s unity and interests,” the MP also said, adding that Hezbollah does not fear the tribunal.

Sahili said that Hezbollah will reveal the names of those involved in the matter of false witnesses in the investigation of the 2005 assassination of former Prime Minister Rafik Hariri when the time is right. “Revealing the names at an inappropriate time would not lead to the desired aim, which is to maintain Lebanon’s unity,” he added.

Commenting on Progressive Socialist Party leader MP Walid Jumblatt’s expectation that Israel would wage a military attack against Lebanon this month, Sahili said that he does not think it is true.

Sayyed has argued that Mirza is not legally qualified to take judicial action against him because Mirza is one of several Lebanese and Syrian public figures named as defendants in a lawsuit Sayyed filed in Damascus in December 2009.

Mirza summoned Sayyed for questioning at Justice Minister Ibrahim Najjar’s request after Sayyed said on September 12 that “[Prime Minister Saad Hariri] should take a lie detector test to prove he did not support or fund false witnesses in the Special Tribunal for Lebanon (STL).” The former General Security chief also threatened to take his right “with his own hands” if Hariri did not give it to him.

ILoubnan - Hezbollah's support to Jamil Sayyed exacerbates tension in Lebanon - September 18, 2010

Former Lebanese general Jamil Sayyed, who has been summoned by prosecutor Said Mirza for threatening remarks made against Prime Minister Saad Hariri was on Saturday under th protection by opposition group Hezbollah and its christian ally Free Patriotic Movement.

Jamil Sayyed was detained for four years on suspicions of involvement in the 2005 assassination of former prime minister Rafik. He was released in 2009 when the Special Tribunal for Lebanon (STL) ordered his release due to lack of evidence.

Sayyed said that the testimony that sent him in detention was made by a false witness. Last week, he publicly threatened current Prime Minister Saad Hariri in a press conference held in Paris. "I will not remain silent until justice is made...' Sayyed said, accusing Hariri of paying for the testimony that sent him to jail. 'False witnesses must be held accountable under the law, or we shall settle the score against them in the street,' Sayyed warned.

Those remarks, including one to take justice 'with his own hands' if Hariri did not admit to his alleged crimes, prompted Lebanese prosecutor Said Mirza on Thursday to summon Sayyed for questioning regarding threats to Hariri and state security. When Sayyed arrived at Beirut's international airport on Saturday, he was greeted by Hezbollah lawmakers and officials, who escorted him to prevent anyone from arresting him. Hezbollah issued a statement on Friday saying that Mirza's request to summon Sayyed was 'political,' calling for a reversal of the judiciary's decision to summon Sayyed for questioning. 'Hezbollah fully supports Sayyed,' the statement said, adding that 'any move to take legal action against Sayyed will cause chaos in the country.' Hezbollah's MP Hassan Fadlallah said Saturday that 'no one is capable of putting Sayyed in prison.'

Some observers believe that the situation in Lebanon is critical and similar to the atmosphere that prevailed in May 2008, when gunmen of a Hezbollah-led alliance occupied the Sunni part of Beirut, to protest a decision by the Western-backed government to dismantle the movement's special telecommunications network.

Former General Security chief Major General Jamil al-Sayyed stressed on Saturday that he will return to Lebanon as scheduled, saying that it "makes no difference to him if he is arrested because the law is not on their side, but only the orders of their masters."
"I demanded that General Prosecutor Saeed Mirza step down because I consider him as my opponent and therefore any decision he issues will be rejected," he stated from Paris.

Furthermore, he said that Pre-Trial judge Daniel Fransen's latest order "is the first step towards achieving justice."

"The tribunal's decision to hand us evidence is a new setback for the sides that have been trying to cover up the facts in the assassination of former Prime Minister Rafik Hariri," Sayyed continued.

Minister of Transportation and Public Works Ghazi Aridi stated on Saturday that the government should be able to handle the arrest warrant issued against former General Security chief Major General Jamil al-Sayyed.

He made his statement after holding a closed-door political meeting on Saturday with Free Patriotic Movement leader MP Michel Aoun during which he commended the MP for clarifying that he had not called for civil disobedience.

Naharnet - Lebanon's Foreign Ministry Denies Report Siddiq is in Australia - September 18, 2010


Mohammed Zuheir Siddiq, a former witness in the inquiry into the assassination of ex-PM Rafik Hariri, has moved to Australia, according to the Lebanese Ambassador to Australia Robert Naoum.
The daily Ad Diyar reported on Saturday that Naoum informed the Lebanese Foreign Ministry that Siddiq is living in a villa in a high-class neighborhood in Canberra.

The information has been transferred to William Habib, the head of the Directorate of Political and Consular Affairs, who in turn relayed it to the Internal Security Forces directorate.

The Foreign Ministry has meanwhile denied Ad Diyar's report.

Naharnet - Moussawi Threatens from Airport: Hizbullah Won't Allow Sayyed to Be Re-Arrested - September 18, 2010


Hizbullah MP Nawwaf Moussawi on Saturday said the Opposition was present at Beirut airport to "rescue the State and the Judiciary."
"The Lebanese state and its reputation had been damaged by the arbitrary arrest of the four officers. And today they wanted once again to damage the State's institutions by implicating the judiciary," Moussawi said from Beirut airport ahead of Maj. Gen. Jamil Sayyed's arrival from Paris.

Sayyed arrived at Beirut airport to a warm welcome from Hizbullah political and party officials.

"Today, we avoid repeating the same mistake. We are going to welcome Maj. Gen. Sayyed on the free Lebanon territory.

Moussawi said Hizbullah will "escort Sayyed home.

"At this stage, at the time of false witnesses, false security and some false judiciary … we came to tell those who committed the crime four years ago against Lebanon, its security and judiciary in the arrest of four officers will not be able to violate the Lebanese State and its institutions and its judiciary once again, " Moussawi warned.

Lebanon First MP Oqab Saqr on Saturday described Hizbullah's support for Maj. Gen. Jamil Sayyed as a "symbol of fragmenting the State."
He also described as "outlaws" Sayyed as well as Hizbullah and its allies.

"Today, Beirut airport was occupied by an outlaw under the protection of groups of outlaws," Saqr said.

Sayyed Warns Hariri upon Arrival in Beirut: We'll Settle Score against False Witnesses in Street if We Were Prevented by Law
Former Head of Lebanon's General Security Department Maj. Gen. Jamil Sayyed arrived in Beirut Saturday to a warm welcome from Opposition political and party officials who escorted him home.
Sayyed, once again, launched a vehement attack against Prime Minister Saad Hariri, State Prosecutor Saeed Mirza, Police Chief Gen. Ashraf Rifi and Detlev Mehlis, former head of the U.N. investigation into the assassination of ex-PM Rafik Hariri.

"There is no indictment before Mehlis, Rifi and Mirza are tried," he warned from Beirut airport.

Sayyed said during a press conference he held at the airport after returning from Paris: "False witnesses were recognized by PM Saad Hariri and we demand that they be held accountable under the law."

"If false witnesses are not held accountable under the law, we shall settle the score against them in the street," he warned.

"I place myself at the disposal of the Lebanese judiciary, but not at Mirza's disposal," Sayyed stressed.

On Friday, Sayyed requested that the Court of Cassation remove Mirza, Rifi and Brig. Gen. Wissam al-Hasan from their posts.

Sayyed said he wants Mirza removed "due to the personal rivalry" between them.

As for Rifi and Hasan, Sayyed said he wants them removed because both men work as "law enforcers under Mirza."

At the airport, Sayyed said Sunnis should realize that they "exploited" Rafik Hariri's death to fight Syria and the Resistance.

He denied that the Opposition was preparing to wage a coup against the Lebanon regime.

"There is no coup or confrontations. But there are protests to support the State, the law and the true justice because there is no justice until the false witnesses are brought to justice," he said.

Turning to Hariri, he warned: "Sheikh Saad, this issue will not come to an end until the criminals around you and held accountable."

US Special Envoy to the Middle East George Mitchell was in Beirut on Friday. But before coming to Lebanon, Mitchell visited Damascus, where he stated that a peace deal meant an "agreement between Israel and the Palestinians, between Israel and Syria, and between Israel and Lebanon and the full normalization of relations between Israel and its neighbors."

Next month, Iranian President Mahmoud Ahmadinejad is coming to Beirut with the opposite message, one that says he wants Lebanon to be the battlefield on which Iran can fight to protect its regional interests.

The war is to be fought by Hezbollah, but the Special Tribunal for Lebanon (STL) is an obstacle that needs to be removed before the end of the peace negotiations between Israel and the Palestinians.

Although any indictment handed down by the STL will not force Hezbollah to cooperate (it knows that the Lebanese government cannot force the Party of God to do so), Hezbollah would prefer to remove anything that could weaken it internally, and in the last few days the opening salvos in the battle to dismantle the tribunal has started.

Rumor has it that if former General Security chief Jamil as-Sayyed is summoned by Attorney General Judge Said Mirza over comments made by Sayyed at his press conference last Sunday, civil violence similar to – or according to some people, even worse than – that of May 7, 2008 will take place.

Mirza summoned Sayyed “for questioning over the latter’s threats against the Lebanese state, judiciary and Prime Minister Saad Hariri.” But Sayyed was in Paris and will be back today, Saturday.

Hezbollah issued a statement on Friday saying that Mirza’s request to summon Sayyed on Thursday was “political par excellence.” The party added: “We were surprised by the judiciary’s decision… which is political and oppressive to those who declare the truth.” Hezbollah also called for revoking the judiciary's decision to summon Sayyed for questioning.

Hezbollah’s MPs have also demanded that Lebanon stop funding the STL, prompting March 14 MPs to withdraw from Thursday evening’s session of the Parliamentary Finance and Budget Commission to prevent a quorum and a vote on the 2010 state budget clause pertaining to the court’s funding.

Meanwhile, MTV reported that Loyalty to the Resistance bloc MP Hassan Fadlallah said in Thursday’s session that parliament should abolish the STL before the end of September, otherwise “the matter [will be] very dangerous.”

The message from Hezbollah and March 8 is clear: Lebanon should stop funding the tribunal, parliament should agree to abolish it, and Prime Minister Saad Hariri should make an unequivocal statement that the STL is politicized and that he can no longer trust its impartiality.

Simply, nothing else matters. And the tensions that currently plague Lebanon – the threats, clashes and political campaigns – are linked to the STL. Those who criticize the tribunal, such as Jamil as-Sayyed, will be protected, no matter what they did in the past, while those who trust it and hope it will deliver justice will be deemed traitors.

But what can Hezbollah really do? After the Saudi-Syrian agreement at the Beirut Summit on July 30, it has become clear that Syria will not side with Hezbollah in any violent sedition. The Syrian regime has cooled its backing of Hezbollah, while Syria’s allies – including Parliament Speaker Nabih Berri and the recently-reclaimed Druze leader MP Walid Jumblatt – have distanced themselves from Hezbollah’s campaigns. Both said that they can differentiate between an indictment handed down by the STL and the court itself. Hezbollah’s only ally is the increasingly-isolated Free Patriotic Movement leader MP Michel Aoun.

Under these circumstances, another May 7 is probably unlikely, as is a coup d’état. Politically, Hezbollah and Aoun cannot do it alone. They can burn the streets, but if Syria is not on their side, the political balance is difficult to alter.

But is the Saudi-Syrian deal that solid? It was supposed to have been based on two commitments: Syria’s promise to back Saudi Arabia in Iraq by supporting Iyad Alawi in his bid for the premiership, while Saudi Arabia was expected to support Syria’s interests in Lebanon. Due to the complicated political scene in Lebanon, and mainly to the Iranian influence in both Lebanon and Iraq, these two commitments have not been easy to fulfill.

The deal has not collapsed, but it has become less effective, as many Lebanese expected, while the calm that prevailed since the Beirut Summit has also evaporated.

Yes, Hezbollah is trying to stymie the Saudi-Syrian deal. Iran does not want the Syrian regime to “return” to Lebanon on the back of a Saudi-brokered deal because this would make the ties between Syria and Hariri stronger than those between Syria and Hezbollah. Such a deal might also strengthen any prospects for peace, something that Hezbollah and Iran do not want.

Attacking both Hariri and President Michel Sleiman through Aoun and Sayyed is therefore the beginning of the confrontation. Hariri, in the meantime, is expected to make more compromises to Syria and tame all those who are still criticizing or seeking to thwart Syrian interference in Lebanon.

Torn between Hezbollah’s campaign to bring him down and Syria’s demands, Hariri will be walking a very thin line in the coming weeks and months. If the Saudi-Syrian deal survives, Syria will clearly be “back.” If it fails, Hezbollah will be able to carry out its threats. Until then, the only solution left for those who still believe in the principles of March 14 is to show a united front through improved rhetoric, clear commitments and a unified position.
