July 1, 2010 - L'Orient le Jour - Geagea : Le comportement de certains nous incite à croire qu’ils sont liés à l’assassinat de Hariri

Le président du conseil exécutif des Forces libanaises, Samir Geagea, a dénoncé hier « les agressions contre les forces de la Finul au Liban-Sud », estimant que ces actes sont « inacceptables, dans la mesure où la partie qui en ressort le plus lésée est l'État et le peuple libanais ».
« La 1701, qui a été adoptée à l'unanimité en Conseil des ministres et qui est appuyée par tous, est dans l'intérêt du Liban, notamment de sa frontière sud », a poursuivi M. Geagea, qui a exprimé son étonnement face « aux mouvements populaires qui représentent une couverture aux agissements de certaines parties politiques, lesquelles souhaitent brouiller par des parasites cette résolution ou lui porter atteinte d'une manière ou d'une autre ».
« Ces événements ne sont ni fortuits ni impulsifs, d'autant qu'ils se produisent dans plus d'une région, sous différentes formes », a noté le leader des FL. « Ces forces ont un devoir à remplir vis-à-vis de l'État libanais, et non d'une force politique libanaise quelconque (...) », a-t-il ajouté, appelant « le président de la République, le gouvernement et le Conseil des ministres dans son ensemble à prendre les mesures nécessaires pour que l'État libanais ne soit pas décrédibilisé et encore plus à découvert qu'à l'étape actuelle ».
Concernant l'affaire de l'arrestation pour espionnage d'un employé d'alfa, Samir Geagea a « rendu hommage aux services de sécurité, qui ont effectué une grande progression dans la poursuite des réseaux d'espionnage israéliens et arrêté une trentaine de personnes pour espionnage ». Il a critiqué « ceux qui, de l'intérieur ou de l'extérieur du pouvoir, profitent de cette situation pour aboutir à des objectifs plus lointains ». « D'où est-ce que les médias obtiennent leurs informations, alors même que l'enquête n'est toujours pas terminée ? » s'est-il interrogé, précisant qu'une autorité sécuritaire officielle, quelle qu'elle soit, n'a le droit de divulguer aucune information afin de préserver le secret de l'enquête. M. Geagea a appelé le ministre de la Justice, Ibrahim Najjar, à remplir son rôle dans cette affaire de manière sérieuse pour découvrir la source de ces informations transmises aux médias. « Dans le cas où elles émaneraient de sources sécuritaires, il convient de déférer ces dernières en justice pour enquête, conformément à la loi. Si elles ne sont que le fruit de l'imagination de ces médias, il convient de déférer ces médias devant la justice pour enquête et prendre les mesures nécessaires à leur encontre », a souligné le chef des FL. « Les médias du 8 Mars ont lié la question de l'employé d'alfa au TSL, alors que, jusqu'à présent, il n'y a même pas le moindre acte d'accusation. Je refuse de croire qu'une partie libanaise puisse être liée à l'assassinat du Premier ministre Rafic Hariri. Cependant, le comportement de certaines parties au Liban nous incite à croire qu'elles sont liées à cet assassinat », a-t-il ajouté.
Il a par ailleurs critiqué « les parties qui s'érigent en responsables de la protection des ressources du Liban, comme si l'État ou le peuple n'existaient pas, et que le Hezbollah était seul responsable de tout ». « Cette logique est catastrophique et mènera à l'effondrement du pays », a-t-il dit. Concernant le timing de cette affaire de prospection de gaz, Samir Geagea a indiqué : « Certains sont à la recherche d'un nouveau Chebaa qui soit brûlant, mais cela est inadmissible alors qu'il y a un État. S'il existe un problème dans le tracé de nos frontières maritimes, cela est de la responsabilité de l'État libanais. Leur logique conduit à l'érosion de l'État et de ses institutions. »
Le président du conseil exécutif des FL s'est par ailleurs entretenu à Meerab avec l'ambassadrice des États-Unis, Michelle Sison, avec qui il a évoqué les agressions contre les forces de la Finul au Liban-Sud et la nécessité pour l'État d'assumer ses responsabilités dans ce cadre. L'entretien a également porté sur la prospection de pétrole et de gaz, et sur le tracé des frontières maritimes, ainsi que sur la situation régionale et la nécessité d'alléger le blocus sur Gaza. De son côté, Mme Sison a exprimé « le soutien des États-Unis à la souveraineté du Liban terrestre et maritime, ainsi que le soutien de l'administration US à la décision du gouvernement libanais relative au tracé des frontières du Liban, conformément au droit international ».
Samir Geagea a enfin accordé audience à l'ambassadeur de France, Denis Pietton, avec qui il a procédé à un tour d'horizon de la situation régionale. Les deux hommes ont également évoqué certaines questions soulevées par M. Geagea lors de son voyage à Paris avec le chef de la diplomatie française, Bernard Kouchner, ainsi que la situation au Liban-Sud, au lendemain des agressions contre la Finul, et la question de l'octroi de droits civils aux réfugiés palestiniens soulevée par le député Walid Joumblatt à la Chambre. « Nous comprenons la difficulté que cela pose pour le Liban et le caractère délicat de la question de l'implantation. Cependant, nous pensons qu'il est nécessaire d'améliorer la situation matérielle des Palestiniens à travers un consensus entre toutes les parties libanaises et l'ambassadeur de Palestine au Liban », a indiqué M. Pietton. Concernant les agressions contre la Finul, l'ambassadeur de France a mis l'accent sur « le droit de la Finul à circuler librement pour accomplir sa mission ». « Ce qui s'est produit hier s'inscrivait dans le cadre naturel de l'action de la Finul, et les autorités libanaises avaient été tenues au courant au préalable », a-t-il conclu.

BEIRUT: The Special Tribunal for Lebanon announced Tuesday it will hold a public hearing to allow former head of the General Security, who was detained over the killing of former Premier Rafik Hariri, to challenge the court.

Jamil al-Sayyed filed a request in March for access to investigation files to prove his assertion that he had been the victim of slander and was arbitrarily detained from 2005-09.

Sayyed and the prosecutor will each have 20 minutes in the hearing on July 13 to present their arguments to the court, said judge Daniel Fransen in a ruling dated June 25.

The Lebanese general was placed in temporary detention on August 30, 2005, on an arrest warrant issued by a Lebanese judge. The UN tribunal ordered his release along with three other generals on April 29, 2009.

In its first annual report published in March, the tribunal announced investigators were getting closer to identifying the suicide bomber who carried out the attack.The Hariri murder has been widely blamed on Syria, a main backer of Hezbollah, although Damascus has roundly denied involvement.

A UN commission of inquiry had said it had evidence to implicate Syrian and Lebanese intelligence services prior to the tribunal's formation, but there are currently no suspects in custody. The head of the UN tribunal said last month that it could file charges by the end of the year.

Le rassemblement Moultazimoun a stigmatisé hier « la campagne visant à discréditer le Tribunal spécial pour le Liban », ainsi que « les derniers articles publiés par le quotidien al-Akhbar qui annoncent un nouveau 7 mai, comme si cette date était effectivement glorieuse ». « Le 7 mai constitue une journée noire et honteuse dans l'histoire du Liban moderne. Ce jour-là, les armes illégales ont commis des massacres et ont placé le Liban au bord du gouffre et des combats intercommunautaires (...) », a noté Moultazimoun à l'issue de sa réunion hebdomadaire. « Nous voulons la justice, et la vérité est notre objectif. Le TSL reste l'espoir des Libanais pour que la justice soit réalisée et les coupables, quels qu'ils soient, sanctionnés. Tous ceux qui posent des obstacles à l'action du tribunal sont complices du crime (...) », a conclu le rassemblement.

June 30, 2010 - Naharnet - Salam to Security Council: Lebanon is with Force of Law and not Law of Force

Lebanon's ambassador to the U.N. Nawaf Salam urged all states to respect international law saying the force of law and not the law of force, which Lebanon supports, guarantees respect for human rights and equality among states.
Salam made his comment on Tuesday during a Security Council open debate on the rule of law.

To maintain peace and security, it was unlawful to use military option to deter and punish, and, as such, the ambassador welcomed the International Tribunal on the Law of the Sea, the International Court of Justice and other such bodies that contributed to the peaceful resolution of disputes.

However, he noted the selective application of certain rules, which threatened to render meaningless the concept of rule of law. One example were rulings directed at Israeli practices, where the Jewish state had annexed territories of other states, built settlements and committed transgressions against holy sites and engaged in acts of collective punishment and siege.

It had also made threats of war against Lebanon and committed daily violations of the country's sovereignty by land, sea and air, Salam told the Council.

He questioned why certain resolutions were implemented and others ignored, and why sanctions were announced against some but not others.

He noted that equality among states was one of the pillars of the international system, adding that the Council's credibility remained in question so long as there was no review of its structure or methods of work.

Still, Salam welcomed the Council's efforts to include the protection of civilians in its mandates and the need to uphold international humanitarian law. He welcomed its steps to create international and mixed tribunals to prosecute those who committed grave crimes, and looked forward to the activation of the Special Tribunal for Lebanon to restore justice to the victims, without politicization.

June 30, 2010 -The National - The Hariri tribunal is so inept, it almost seems deliberate

Last Updated: June 30. 2010 6:14PM UAE / June 30. 2010 2:14PM GMT Recently, one of the men arrested in the investigation of the 2005 assassination of Lebanon’s former prime minister, Rafiq Hariri, pursued a revealing legal manoeuvre. He demanded that the special tribunal set up by the United Nations a year ago to try those suspected of the murder show him the evidence used to arrest him.

The man is Jamil alSayyed, the former head of Lebanon’s General Security directorate and one of four generals arrested on the advice of United Nations investigators a few months after the Hariri murder. Mr al Sayyed spent four years behind bars, until he was released last year along with his colleagues by the tribunal prosecutor, Daniel Bellemare, because there was not enough evidence to indict them. Mr al Sayyed’s request shows how onetime suspects are now willing to take the tribunal on, largely because it has lost all momentum.


Mr al Sayyed’s innocence is a matter of conjecture. He was a main cog in the Syrian-dominated security network in Lebanon during the time Damascus ruled directly over the country. It was this network that investigators believe was behind Mr Hariri’s killing. The detention of Mr al Sayyed and his associates was repeatedly reconfirmed by the body set up to investigate the killing, the United Nations International Independent Investigation Commission (UNIIIC), whose last head was Mr Bellemare, before he became tribunal prosecutor. Yet it is also true that the investigators did not turn their suspicions about Mr al Sayyed into indictable offences. Therein lies the tribunal’s difficulties.


Five years after the Hariri assassination, we are nowhere closer to seeing the guilty accused. Back in 2005, the decision of the UN Security Council to set up an investigation of the Hariri killing was an innovation. It was the first time that the international organisation had looked into a political assassination, the rationale being that this would help deter such crimes in the future. UNIIIC was set up, and its first commissioner was Detlev Mehlis, a German judge who had investigated high-profile terrorist crimes in former West Berlin, including the 1986 LaBelle discotheque bombing.


Mr Mehlis had no doubt that the Hariri assassination was ordered by Syria, even if Lebanese individuals or groups also participated in the operation. His team began a police investigation, and interviewed Syrian officials and intelligence officers inside Syria and abroad. On the eve of his departure in December 2005, Mr Mehlis even recommended to his successor, the Belgian judge Serge Brammertz, that he arrest the former head of Syria’s military intelligence apparatus in Lebanon.


Mr Brammertz never did so. In fact he arrested no one during his two-year tenure. While this may have been because one of Mr Mehlis’ witnesses appeared unreliable, there were far deeper problems in the Belgian’s investigation. He cut back on police officers and added analysts. Analyses can address details of a crime, but only a police investigation, which entails taking suspects into custody and using their testimonies to unravel the decision-making hierarchy, can identify the guilty. In fact, Mr Brammertz did not investigate much at all before handing over to Mr Bellemare.


Was this intentional on Mr Brammertz’s part? I contacted him in April of last year for a book I was writing to give him an opportunity to respond to my criticisms of his work. I also wanted him to reply to allegations levelled at him by Mr Mehlis in an interview I conducted with the German for The Wall Street Journal. Mr Brammertz declined. However, it was difficult not to notice that his appointment after serving on the Special Tribunal for Lebanon – namely, as prosecutor for the International Criminal Tribunal for the former Yugoslavia – was a promotion by the UN, even though his performance in Beirut hardly merited such an accolade.


Perhaps that was precisely what the UN liked in Mr Brammertz. As Mr Mehlis later recalled, when he met Kofi Annan before starting his mission, the UN secretary-general told him that “he did not want another trouble spot”. Mr Mehlis did not oblige. He raised the heat on Syria and although he received Security Council backing, which strengthened his mandate, the UN bureaucracy must have winced at the tensions resulting from these confrontations.


Mr Bellemare has been a different kettle of fish. A Canadian judge, he had no experience of terrorist crimes when he came in. His tenure as commissioner, then as prosecutor, has produced little apparent progress. He seems to have information pointing to on-the-ground involvement by Hizbollah in Mr Hariri’s elimination, but two key questions remain: Does Mr Bellemare have enough to indict? And if he does, who will the prosecutor point the finger at, low-level operatives or higher-level decision-makers, including Syrian officials?


For now, we can only speculate. However, there seems less and less doubt that the two-year tenure of Mr Brammertz damaged the prosecution’s case, perhaps fatally. Mr Bellemare also discredited the tribunal by awaiting its formation before releasing the four generals, when, aware that there would be no indictments, he could have requested that the Lebanese authorities do so earlier.

Worst of all, key figures have left the tribunal one after the other, including Mr Bellemare’s chief investigator and two registrars. This implied, at the very least, that these individuals did not expect indictments in the foreseeable future; but in several specific cases the exits also hinted at Mr Bellemare’s managerial shortcomings.


Indictments may come later this year, but it seems doubtful, given what we know, that those who ordered the assassination will be charged. The zeal with which the tribunal’s president, Antonio Cassese, has pressed for this deadline indicates he is putting pressure on Mr Bellemare. Mr Cassese knows that the tribunal’s funding is closely tied to signs of genuine progress. He is right to be worried.

naharnet - Lebanon Media Exaggeration of Latest Israeli Spy Aims at Causing Confusion in UN Hariri Probe

An MP with the March 14 coalition said media exaggeration of the latest arrest of an Alfa employee on suspicion of spying for Israel was an attempt aimed at causing confusion in the investigation into the assassination of former PM Rafik Hariri.
"It also targets the credibility of the investigations" conducted by police officer Wissan Eid in the Hariri murder case before his assassination.
Eid, Lebanese Internal Security Forces senior terrorism investigator, was assassinated Jan. 25, 2008.
At the time of assassination, Eid was also top Lebanese investigator into the Hariri murder.
"There is an attempt to exaggerate the issue of the (Alfa) detainee to discredit all reports" issued by the U.N. Committee investigating Hariri's assassination "and to signal that the probe may have been manipulated," the March 14 lawmaker said in remarks published Wednesday by Ad-Diyar newspaper.

Le juge de la mise en état du Tribunal spécial pour le Liban, Daniel Fransen, a enfin tranché : le 13 juillet prochain, à 15h, il entendra successivement le procureur, Daniel Bellemare, et le requérant, Jamil Sayyed, pendant 20 minutes dans la salle d'audience du TSL, en vue de prendre une décision relative à la requête déposée par l'ancien directeur de la Sûreté. Ce dernier avait demandé « la remise des éléments de preuve relatifs aux crimes de dénonciations calomnieuses et de détention arbitraire », dont il avait été victime.
La décision du juge de la mise en état est d'autant plus intéressante qu'elle vient contredire l'avis émis par le procureur, qui dans sa dernière réplique avait estimé que « tenir une audience sur des questions strictement légales de compétence et de qualité à agir n'est pas nécessaire », soulignant en outre que « le requérant avait déjà eu toute l'opportunité de présenter ses arguments au travers d'une procédure publique de dépôt d'écritures ». M. Bellemare avait également indiqué que le fait de reprendre oralement les mêmes arguments préalablement énoncés par écrit par M. Sayyed « serait contraire aux exigences d'une bonne administration de la justice ».
Tel n'est pas, semble-t-il, l'avis de Daniel Fransen qui, en ordonnant la tenue d'une audience publique, justifie sa décision par le fait qu'il « est dans l'intérêt de la justice d'organiser une audience au cours de laquelle le requérant et le procureur auront la possibilité de mettre en exergue ou de préciser oralement certains points fondamentaux de leurs argumentations sur la compétence du tribunal et la qualité du requérant à comparaître en justice. La tenue d'une audience publique constitue également une opportunité pour le juge de la mise en état d'obtenir du requérant et du procureur certaines précisions ou éclaircissements en lien », précise encore le juge qui fait cependant remarquer que le requérant « ne dispose pas d'un droit absolu à faire valoir ses prétentions oralement devant le tribunal ».
Après avoir entendu les arguments qui seront respectivement présentés par l'un et l'autre, Daniel Fransen leur posera toutes les questions qu'« il estimera utiles ».
Le juge de la mise en état devra ensuite statuer sur sa compétence à se prononcer sur la demande de M. Sayyed relative aux éléments de preuve, ainsi que sur la qualité de l'officier à ester en justice auprès du TSL. En cas de réponse affirmative à ces deux questions, il devra examiner la requête dans le fond.
Rappelons qu'une correspondance écrite avait eu lieu entre les trois parties au cours des trois derniers mois dans laquelle M. Bellemare avait réfuté, dans la forme, la demande de M. Sayyed, arguant que ce dernier n'étant ni accusé ni victime, il n'a pas par conséquent qualité à s'adresser au TSL. Qui plus est, avait avancé M. Bellemare qui s'était abstenu de se prononcer sur le fond de l'affaire, le TSL, qui est un tribunal d'exception, ne saurait être compétent puisque sa mission est limitée par son statut qui l'autorise à se pencher sur la seule affaire de l'assassinat de Rafic Hariri. M. Sayyed devait bien entendu prouver le contraire et motiver sa demande dans la forme aussi bien que dans le fond.

جلسة لاهاي لبحث قضيّة شهود الزور: كشف الخلل واجب لا إنجاز

قرار قاضي الإجراءات التمهيدية فرانسين عقد جلسة علنية يتواجه فيها المدعي اللواء جميل السيد مع المدعي العام في المحكمة دانيال بلمار، سيكون له تأثيره على أمور كثيرة تخص المحكمة. صحيح أن بإمكان رئيس الجلسة تجاهل الكثير من المطالب، إلا أن الأمر يظل في حدود التقديرات. ذلك أن ما يمكن المحكمة أن تخرج به من هذه المداولات ينحصر في خيارات محدودة، بينها:
أولاً: أن إقرار حقه الحصول على ما يعتبره ملفات وأدلة تخص الشهود الزور الذين أعلن الادعاء العام مباشرة أو من خلال ناطقين باسمه عدم أهليتهم في ملفاته، سوف يعقبه قرار بتسليم السيد هذه الملفات وهذه الأدلة، وهي تتيح له بقدر كبير إكمال ما هو لديه ولدى وكلاء الضباط الأربعة، ما يتيح عملياً الوصول الى إطلاق عملية محاكمة الشهود الزور ومن يقف خلفهم حتى لو قررت المحكمة أن الأمر ليس اختصاصها.
ثانياً: أن رفض المحكمة الأخذ بالأسباب التي يقدمها السيد طلباً لهذه المعلومات، سوف يقود الى اعتبار الأدلة جزءاً من التحقيق أو من سريته، وهو ما يعيد ملف هؤلاء الى المحكمة حكماً، ما يؤدي الى إلغاء قرار عدم الاختصاص، ما يمكّن السيد من طلب محاكمة هؤلاء أمام المحكمة نفسها.
ثالثاً: أن تقبل المحكمة طلبات السيد وتطلب من المدعي العام تقديم ما لديه من أدلة إليه، وأن تعطي بلمار في الوقت نفسه هامش الاستنساب في اختيار ما يريد أن يعطيه للسيد من لائحة مطالبه. وهو سوف يتطلب جولة ثانية من المقاضاة والدفاع وخلافه، ولن يكون بمقدور المحكمة تحت أي طائل التسويف في هذا الملف وهي التي تحتاج الى ما يعزز الثقة بها لا ما يزيد من الشكوك.
في هذا السياق، ثمة اعتقاد بأن مجرد موافقة قاضي الأمور التمهيدية عقد الجلسة العلنية في 13 تموز المقبل، قد يستهدف الوصول الى أمور أخرى. أي إنه قبل بعقد الجلسة وقد يحكم لمصلحة بلمار. وهو يكون قد أعطى انطباعاً عن رغبته في التعاون وإفساح المجال أمام الجهات المتضررة للتعبير عن رأيها وإثارة قضاياها. وهو يستهدف عملياً الحصول على صدقية وشرعية مهنية وأخلاقية لتحصين المحكمة كإطار عام، ما يسهل على المدعي العام الوصول الى قرار اتهامي يتردّد بقوة أنه سياسي بامتياز.
ولذلك، فإن النجاح في إلزام بلمار من خلال المحكمة نفسها العودة الى ملف الشهود الزور يجب ألا يقتصر على الإطار العام، بمعنى أن الموضوع هنا ليس نجاح جميل السيد في الحصول على قرار بعقد جلسة علنية، ولا بأن يثير موضوع الشهود الزور أمام هيئة قضائية عليا، بل إن الموضوع هو العمل بجدية على اعتبار محاكمة الشهود الزور شرطاً إلزامياً للعبور نحو تحقيقات سليمة من جميع النواحي، ولا سيما أن التحقيقات الجارية الآن مع مواطنين لبنانيين لهم انتماءات سياسية مختلفة، بينها ما يتصل بحزب الله، إنما تشير الى أن في فريق المدعي العام محققين يملكون معلومات من دون إثباتات، لا بل إنهم يقدمون معطيات مبنية على بناء هش، جرى ترتيبه أو تركيبه في ليل.
وفي هذا السياق لم يتوقف الفريق اللصيق بالرئيس سعد الحريري عن الحديث عن «أن مسار الأمور يتجه صوب الظن بمجموعة عناصر من حزب الله بالوقوف خلف عملية الاغتيال». ويضيف هؤلاء تقديراتهم بأن قيادة حزب الله لن تبادر الى رد فعل قد يجعلها في قفص الاتهام
الغرب لا يعرف أنه يحمّل نفسه مسؤوليّة خطوة قد توقعه في الفخّ
الشعبي، وخصوصاً أن الحريري نفسه عرض على قيادة الحزب أن يخرج هو إلى اللبنانيين ويعلن أن المتهمين بالقتل مجموعة ضالة لا قيادة ولا رعاية لها، لا في قيادة حزب الله ولا عند الشيعة.
بعيداً عن سذاجة الحريري وأصحاب هذه النظرية العبقرية، فإن الأمر برمّته يعود الى الدائرة السياسية الإقليمية والدولية التي تتولى إدارة أعمال فريق المحققين في المحكمة، وخصوصاً بعدما أظهرت المعلومات المسرّبة أن جل ما يعرفه محققو بلمار، هو ما كان قد قدّمته إليهم على كتب معلومات أجهزةٌ أمنية، بينها قوى الأمن الداخلي في لبنان وبعض الأجهزة العربية والإسرائيلية. ولم يتجاوز جهد فريق بلمار حدود درس التقاطعات وخلافه.
ولذلك، فإن قرار قيادة حزب الله التعاون مع المحكمة الدولية وفريق الادعاء فيها، لا يمكن تحويله الى رصيد في مصلحة المحكمة أو الادعاء العام فيها. بل على العكس، فإن تعاون الحزب ينطلق من حسابات تعود الى الداخل اللبناني وإلى مناخ شعبي وسياسي يناسب المقاومة ويوفر لها حصانة إضافية. وبالتالي، فإن الحزب كان واضحاً في مراسلاته مع المعنيين بالتحقيق في المحكمة وفي القضاء اللبناني ولدى جهات خارجية أخرى، بأنه ليس في موقع منح أحد براءة عن الجرائم التي ارتكبت بحق مواطنين لبنانيين بناءً على مشروع سياسي، وأن الحزب لا يتعامل مع المحكمة على أساس أنها جهة موثوقة، الأمر الذي يعيدنا الى نقطة الصفر وإلى لحظة الخطر.
صحيح أن بمقدور المدعي العام اتهام من يشاء من دون التوقف عند أي اعتبارات سياسية. لكن الأصح أن من يتعامل مع ملف بهذه الحساسية بهذه الطريقة هو واحد من اثنين: إما شخص مخبول يجب تنحيته ومحاسبته، وإما عميل يمثّل مصالح أعداء المقاومة ولبنان، وبالتالي وجبت مواجهته ومعاقبته. وهو أمر في حالة لبنان، يتجاوز الأشخاص والهيئات ويلامس مصالح الدول الكبرى.

المحكمة الدولية تعقد جلسة علنية في 13 تموز المقبل

قرّر القاضي فرانسين تحديد موعد الجلسة العلنية الثانية للمحكمة الدولية الخاصة بجريمة اغتيال الرئيس رفيق الحريري. وكما الجلسة الأولى، تتناول هذه الجلسة قضية إعادة الحقوق الأساسية للواء جميل السيّد. الجلسة الأولى فكّت احتجازه، فهل تُسهم الجلسة الثانية في محاسبة المسؤولين عن ذلك الاحتجاز؟

دانيال فرانسين، قاضي الإجراءات التمهيدية في المحكمة الدولية الخاصة بجريمة اغتيال الرئيس رفيق الحريري، خالف موقف المدعي العام الدولي دانيال بلمار، مثبّتاً سلطته عبر إصداره أمراً قضائياً بعقد جلسة علنية في قضية طلب اللواء الركن جميل السيّد تسليمه مستندات تحتفظ فيها المحكمة في قضية اعتقاله التعسّفي.
الجلسة العلنية للمحكمة الدولية ستعقد في 13 تمّوز المقبل الساعة الثالثة بعد الظهر في مقرّ المحكمة في لايتسكندام (لاهاي). أصدر فرانسين أمراً بذلك يوم الجمعة الفائت وجّهه إلى بلمار وإلى رئيس مكتب الدفاع فرانسوا رو وإلى الوكيل القانوني للواء السيد المحامي أكرم عازوري.
ودعا فرانسين رئيس قلم المحكمة هيرمان فون هيبل إلى اتخاذ الإجراءات الآتية بحسب قواعد الإجراءات والأدلة (139):
1ـــــ إعداد وحفظ محضر كامل ودقیق لجمیع الإجراءات، بما في ذلك التسجیل الصوتي أو التدوین أو التسجیل بالفیدیو.
2ـــــ حفظ جمیع الأدلة المادیة المقدمة أثناء الإجراءات، والمحافظة عليها.
3ـــــ دراسة احتمال منح الإذن لغیر رئیس قلم المحكمة بالتقاط صور للمحاكمة أو إجراء تسجیلات فیدیو أو تسجیلات صوتیة.
وقرّر القاضي البلجيكي تقسيم مجريات الجلسة إلى قسمين: يمنح بداية كلّ من اللواء السيد والمدعي العام بلمار عشرين دقيقة لتقديم وجهتي نظرهما، ومن ثمّ يطرح القاضي أسئلة على الفريقين بخصوص القضية.

وافق فرانسين بلمار رأيه في أن السيّد حصل على الفرص الكافية للتعبير الخطي عن موقفه
عرض القاضي فرانسين في نصّ قراره مواقف الفريقين في فقرتين جاء فيهما أن السيد عدّ طلبه من قاضي الإجراءات التمهيدية عقد جلسة علنية لشرح موقفه حقاً من حقوقه الأساسية بحسب الفقه القانوني الدولي. كذلك أشار السيد إلى أن عقد جلسة علنية يدحض «إجراءات العدالة السرّية التي لا تخضع للتدقيق المعلن وضمانة شفافية الإجراءات العدلية». ويتابع فرانسين نقلاً عن السيد قوله إن عدم عقد جلسة علنية يعني حرمان السيّد حقّاً أساسياً يتمتّع به في التعبير أمام القضاء عن موقفه «بالصوت الحي».
أما المدعي العام فرأى، بحسب فرانسين، أن «عقد جلسة علنية لبحث قضايا قضائية بحتة» غير ضروري. فبحسب بلمار، لقد مُنح السيد الفرص الكافية لتقديم وجهات نظره من خلال تبادل خطي وعلني. وبالتالي فإن بلمار يرى أن «إعطاء السيد فرصة التعبير عن المواقف التي كان قد عبّر عنها خطّياً مناقض لمتطلّبات الإدارة القضائية الجيدة» (permettre au Requérant de faire valoir oralement des arguments qu’il a déjà énoncés par écrit serait contraire aux exigences d’une bonne administration de la justice).
فرانسين شاطر بلمار لكن...
يوافق فرانسين بلمار رأيه في حصول السيّد على الفرص الكافية للتعبير الخطي عن موقفه (الفقرة 7)، لكنه يعود ليذكر في الفقرة التي تلي ذلك أنه «نظراً للظروف الخاصة للقضية ولأهمية الأسئلة التي تطرح من خلالها، يرى قاضي الإجراءات التمهيدية أن في مصلحة العدالة تنظيم جلسة علنية» (Cela étant, compte tenu des circonstances particulières de la présente affaire et de l’importance des questions qu’elle soulève, le Juge de la mise en état estime qu’il est dans l’intérêt de la justice d’organiser une audience). ويضيف أن الجلسة ستمنحه فرصة حصوله على بعض التوضيحات أو الإضاءات تخصّ مثلاً «القوانين المرعية الإجراء الخاصة بالتعاون القضائي الدولي».
خيبة لبلمار وفريقه
كان بلمار قد ذكر في كتاب جوابي على طلب السيد، في 23 حزيران الفائت، أن عقد جلسة كهذه علنية «غير مناسب» وحسم المدعي العام بأن الجلسة العلنية «لن تزيد من فهم قاضي الإجراءات التمهيدية لما تقدّم» It would not enlighten the Pre-Trial) Judge’s understanding of the Applicant’s submissions). وأصرّ بلمار في كتابه على أن فرانسين «مطّلع اطلاعاً كاملاً من خلال المراسلات الخطية الدسمة التي وصلته، وبإمكانه اتخاذ قرار بناءً على ذلك»is fully briefed, based on the) exhaustive written submissions he received, to pronounce on the issues). ولم يتوقّف بلمار عند هذا الحدّ، بل رأى في الفقرة الـ13، أن عقد الجلسة «لا يحبّذ التوفير القضائي» (judicial economy). فبدا أن عقد الجلسة بالنسبة إلى بلمار مضيعة للوقت ولموارد المحكمة. إذ ختم كلامه عن ذلك قائلاً إن عقد جلسة علنية «لن يساعد على توضيح القضية» ولن يكون لمصلحة السيّد، وبالتالي أشار بوضوح إلى «وجوب رفض طلب عقد جلسة علنية» (The Applicant’s request for a hearing should be denied).

هل تعيد الجلسة العلنية الصدقية؟
بُعيد الجلسة الاولى التي عقدتها المحكمة الدولية في نيسان 2009 والتي أمر خلالها القاضي دانيال فرانسين فكّ احتجاز الضباط الاربعة، علت أصوات بعض القانونيين والسياسيين والاعلاميين في لبنان والعالم تقول إن قرار فرانسين كاف للحسم بأن المحكمة غير مسيّسة وبأنها تتمتّع بالصدقية. واليوم بعد صدور قرار فرانسين المخالف لموقف بلمار يُتوقّع أن يتكرّر تعالي تلك الاصوات. غير أن مطلقي تلك الأصوات قد يستفيدون من معرفة أن في إصلاح الأخطاء إيجابية يفترض أن تُثمّن ولكن كان يفترض تجنّب وقوع تلك الأخطاء منذ البداية. ويفترض كذلك التعويض للمتضرّرين. وليس في كلّ ذلك ضمانة لعدم تكرارها وبالتالي فلا حسم في موضوع الصدقية المستحقّة.

سيرة
في 17 آذار 2010 وجّه اللواء جميل السيد بواسطة محاميه أكرم عازوري كتاباً الى رئيس المحكمة القاضي أنطونيو كاسيزي طلب فيه تسليمه مستندات ودلائل تتعلّق باعتقاله التعسّفي.
وفي 15 نيسان أحال الرئيس كاسيزي الطلب الى قاضي الإجراءات التمهيدية دانيال فرانسين ليقوم اولاً بتحديد الصلاحية القانونية في النظر في هذه القضية، وثانياً، بدراسة معمّقة للطلب إذا حسمت قضية الاختصاص. في 21 نيسان حدّد القاضي فرانسين البرنامج الزمني لتقديم كلّ من السيد والمدعي العام دانيال بلمار موقفهما. وطبقاً لذلك البرنامج تقدّم السيد بكتاب شرح فيه موقفه في 12 أيار وردّ عليه بلمار في 2 حزيران فعاد السيد وردّ على الردّ في 17 حزيران وأخيراً تقدّم بلمار بكتاب في 23 حزيران.

June 29, 2010 - Now Lebanon - Sayyed to challenge STL over past detention at public hearing

The Special Tribunal for Lebanon (STL) said Tuesday it will hold a public hearing to allow Brigadier General Jamil as-Sayyed to challenge the court over his detention for alleged involvement in the murder of former Prime Minister Rafik Hariri.

Sayyed was the chief of General Security at the time of Hariri’s 2005 assassination.

Sayyed filed a request in March for access to court investigation files in order to prove the claim he was the victim of slander and arbitrarily detained from 2005 to 2009.

The public hearing is scheduled for July 13. Sayyed and the prosecutor will each have 20 minutes to present their arguments to the court, said STL pre-trial Judge Daniel Fransen in a ruling dated June 25.

The former General Security chief was placed in temporary detention on August 30, 2005 on an arrest warrant issued by a Lebanese judge.

The STL ordered his release along with three other generals on April 29, 2009.

The tribunal was set up by a UN Security Council resolution in 2007 to find and try suspects involved in Hariri’s murder.

In its first annual report published in March, the STL announced investigators were getting closer to identifying the suicide bomber who carried out the attack.

BEIRUT — A UN tribunal probing the 2005 murder of Lebanese ex-premier Rafiq Hariri said Tuesday it will hold a public hearing to allow a general who was detained over the killing to challenge the court.

Lebanese General Jamil el-Sayed filed a request in March for access to court investigation files in order to prove his assertion that he had been the victim of slander and was arbitrarily detained from 2005 to 2009.

Sayed and the prosecutor will each have 20 minutes in the hearing on July 13 to present their arguments to the court, said judge Daniel Fransen in a ruling dated June 25.

The Lebanese general was placed in temporary detention on August 30, 2005 on an arrest warrant issued by a Lebanese judge. The UN tribunal ordered his release along with three other generals on April 29, 2009.

The Hague-based Special Tribunal for Lebanon was set up by a UN Security Council resolution in 2007 to find and try suspects in the assassination of Hariri, a five-time billionaire prime minister who was killed in a massive bombing on the Beirut seafront on February 14, 2005.

In its first annual report published in March, the tribunal announced investigators were getting closer to identifying the suicide bomber who carried out the attack.

The Hariri murder has been widely blamed on Syria, a main backer of Hezbollah, although Damascus has roundly denied involvement.

A UN commission of inquiry had said it had evidence to implicate Syrian and Lebanese intelligence services prior to the tribunal's formation, but there are currently no suspects in custody.

The head of the UN tribunal said last month that it could file charges by the end of the year.

بيلمار يتجنّب مواجهة السيّد وعازوري في جلسة علنية
رد المدعي العام الدولي لدى المحكمة الخاصة بلبنان ، القاضي دانيال بيلمار، على مطالعة اللواء الركن جميل السيّد بشأن التزويد بالأدلّة والإثباتات والوقائع والمعطيات والتسجيلات الصوتية والمحاضر المرتبطة بشهود الزور وشركائهم في قضية اغتيال الرئيس رفيق الحريري، والذين تسبّبوا باعتقال السيّد تعسفياً وسياسياً مع ثلاثة ضبّاط آخرين، مدّة ثلاث سنوات وتسعة أشهر تقريباً.

وجدد بيلمار في رده رفضه التجاوب مع طلب السيّد، انطلاقاً من أنّ المحكمة الخاصة بلبنان من وجهة نظره، ليست لديها الصلاحية للنظر في هذا الطلب، بالإضافة إلى أنّه ليست للسيّد الصفة اللازمة للمراجعة أمام هذه المحكمة، باعتبار أنّ المحكمة مختصة فقط للمتهمّين والضحايا في جريمة اغتيال الحريري، في حين أنّ اللواء الركن السيّد، وبحسب بيلمار، ليس متهماً ولا هو ضحيّة.
وطلب بيلمار في رده من قاضي الإجراءات التمهيدية في المحكمة الخاصة بلبنان دانيال فرانسين، عدم عقد جلسة علنية في مقرّ المحكمة في لاهاي، للفصل بينه وبين السيّد، والاكتفاء بإصدار قرار عادي، مبرّراً ذلك، باختصار الوقت، وعدم تحويل المحكمة إلى منبر علني لهذه القضيّة، وكان السيّد قد طالب بضرورة عقد جلسة علنية تكون مباحة أمام وسائل الإعلام.
وبهذا، بات فرانسين أمام خيارين اثنين، فإمّا أن يعيّن موعداً لجلسة علنية، وإمّا أن يصدر قراره أو حكمه، من دون هذه الجلسة العلنية على غرار الجلسة الشهيرة التي عقدها في 29 نيسان 2009، عندما أعلن براءة الضبّاط الأربعة اللواءين جميل السّيد وعلي الحاج، والعميدين مصطفى حمدان وريمون عازار، وأفرج عنهم فوراً من مكان اعتقالهم في سجن غير شرعي تابع لفرع المعلومات في قوى الأمن الداخلي، في سجن رومية المركزي.
ولا أحد يعرف نتيجة حكم فرانسين قبل صدوره، فإمّا أن يلبّي طلب اللواء السيّد بمنحه الأدلّة والإثباتات على شهود الزور وشركائهم ويمكّنه من ملاحقتهم أمام محاكم أخرى حيث رفعت دعاوى ضدّهم في سوريا وفرنسا على سبيل المثال، وإما أن يأخذ فرانسين برأي بيلمار فيمنع تلك الأدلّة عن السيّد.
ومهما يكن القرار في هذا الشأن، فإنّه برأي متابعين، سيؤدّي إلى نتائج أساسية، فإذا ما حصل السيّد على غايته من الأدلّة والإثباتات عن شهود الزور، سيصبح هؤلاء جميعاً أكثر عرضة للملاحقة.
وإذا رفض فرانسين طلب السيّد وشاطر بيلمار رأيه لجهة حجب الأدلّة، فإنّ المحكمة الخاصة بلبنان، وبرأي معنيين بهذه القضيّة، "تصبح متهمة بإخفاء الأدلّة، ومنح حصانة سياسية غير مشروعة لشهود الزور وشركائهم".
وبين هاتين الحالتين، فإنّ هذه الجبهة القانونية المشتعلة بين السيّد وبيلمار لن تبرد على الإطلاق، وأقلّه خلال فصل الصيف الحار، لأنّه من حقّ كل واحد منهما، بعد صدور قرار فرانسين بحالة سلبية من وجهة نظر أحدهما، أن يلجأ إلى استئناف القرار أمام الهيئة العامة للمحكمة الخاصة بلبنان برئاسة القاضي الإيطالي أنطونيو كاسيزي شخصياً، أو أن يحيل هذا الأخير الرئاسة موقتاً وللبتّ في هذا النزاع، لنائبه اللبناني رالف رياشي.
وممّا لا شكّ فيه، فإنّ هذا التقدّم، يعطي لهذه القضيّة أبعاداً وتعقيدات أخرى، وتصبح المواجهة الحالية بين السيّد وعازوري من جهة، وأطراف المحكمة من جهة أخرى، برأي أحد المعنيين،"الواجهة الأولى من جبل الجليد الذي يخفي خلفه مؤامرة شهود الزور وشركائهم والمناورات السياسية التي تحيط بالمحكمة، وصولاً إلى نتائج كلّ ذلك، على مصداقيتها، بما في ذلك القرار الظنّي المرتقب".
وفي السياق، اشار الحريري الجمعة خلال مؤتمر صحافي عقده في مطار قرطاج في سياق المحكمة الدولية الى ان هناك اجماع وطني على المحكمة الدولية، وعلى دعم المحكمة ويجب علينا انتظار ما سوف يصدر عنها من حكم ومن اتهام، لكنه لاحظ بأن هناك الكثير من الأقاويل والإتهامات التي صدرت خلال السنوات الأربع الماضية من عدة أطراف وبإتجاه كل الناس.
ولاحظت مصادر مطلعة أن كلام الحريري عن المحكمة جاء وسط حملة تهويل بدأت مؤخراً للتأثير سلباً وفي معركة استباقية، قبل صدور القرار الإتهامي المنتظر في الخريف المقبل، بهدف الضغط على الرئيس الحريري والأطراف الدولية المعنية لتجنب الوصول إلى هذا القرار، وهو الأمر الذي لا يستطيع الحريري القيام به لا بصفته الشخصية ولا بصفته الرسمية، لأن نظام المحكمة يخضعها لسلطة مجلس الأمن ولا لسلطة أي طرف لبناني أو غير لبناني•

June 26, 2010 - L'Orient Le Jour - Bellemare persiste et signe : Sayyed n’a pas qualité pour obtenir des documents du TSL

Attendue d'abord au plus tard lundi prochain, la réponse du procureur du TSL, Daniel Bellemare, concernant la requête présentée par Jamil Sayyed est finalement parvenue à ses destinataires le 23 juin. Pour la seconde fois consécutive, le procureur du TSL a répondu négativement et dans la forme uniquement à la requête que M. Sayyed avait soumise au TSL en vue d'obtenir les documents et éléments de preuve qui avaient été à l'origine de sa détention arbitraire quatre années durant (2005-2009).

Sayyed, estimant que l'officier ne fera que répéter ses arguments de vive voix devant le juge de la mise en état, « un exercice qui n'est pas en faveur de l'économie juridique », souligne M. Bellemare. Il reste donc à attendre la décision de M. Fransen qui devra trancher cette affaire dans un sens comme dans un autre. La réponse du juge de la mise en état ne saurait tarder en principe. Il reste à savoir s'il sera convaincu par les arguments avancés par M. Bellemare, ou au contraire par ceux qui ont été formulés par l'ancien directeur de la Sûreté ,auquel cas M. Fransen devra alors trancher sur le fond et dire si oui ou non M. Sayyed pourra faire prévaloir son droit aux documents et éléments de preuve. Rappelons toutefois que M. Bellemare, tout comme M. Sayyed, peuvent faire appel devant l'une des chambres du TSL.

كرّر رفضه تقديم الأدلّة بحقّ شهود الزور وشركائهم
بيلمار يتجنّب مواجهة السيّد وعازوري في جلسة علنية

قبل خمسة أيّام من انتهاء المهلة القانونية المحدّدة له من قاضي الإجراءات التمهيدية في المحكمة الخاصة بلبنان، سارع المدعي العام الدولي لدى هذه المحكمة، القاضي الكندي دانيال بيلمار، إلى تقديم ردّه الأخير على مطالعة اللواء الركن جميل السيّد ووكيله القانوني المحامي أكرم عازوري، بشأن تزويدهما بالأدلّة والإثباتات والوقائع والمعطيات والتسجيلات الصوتية والمحاضر المرتبطة بشهود الزور وشركائهم في قضية اغتيال الرئيس رفيق الحريري، والذين تسبّبوا باعتقال السيّد تعسفياً وسياسياً مع ثلاثة ضبّاط آخرين، مدّة ثلاث سنوات وتسعة أشهر تقريباً.
ويتمحور ردّ بيلمار المنشور على الموقع الرسمي للمحكمة على شبكة الانترنت، حول ثلاث نقاط بينها نقطة وحيدة جديدة، والنقطتان الباقيتان تكرار لما أورده في ردّه الأوّل، وتتعلقّان بإصراره على رفض التجاوب مع طلب اللواء الركن السيّد، انطلاقاً من أنّ المحكمة الخاصة بلبنان من وجهة نظره، ليست لديها الصلاحية للنظر في هذا الطلب، بالإضافة إلى أنّه ليست للسيّد الصفة اللازمة للمراجعة أمام هذه المحكمة، باعتبار أنّ المحكمة مختصة فقط للمتهمّين والضحايا في جريمة اغتيال الحريري، في حين أنّ اللواء الركن السيّد، وبحسب بيلمار، ليس متهماً ولا هو ضحيّة.
أمّا النقطة الجديدة التي أثارها بيلمار في ردّه، فتتمثّل في طلبه إلى قاضي الإجراءات التمهيدية في المحكمة الخاصة بلبنان دانيال فرانسين، عدم عقد جلسة علنية في مقرّ المحكمة في لاهاي، للفصل بينه وبين السيّد، والاكتفاء بإصدار قرار عادي، مبرّراً ذلك، باختصار الوقت، وعدم تحويل المحكمة إلى منبر علني لهذه القضيّة، مناقضاً ما كان قد طالب به السيّد بضرورة عقد جلسة علنية تكون مباحة أمام وسائل الإعلام.
ولم يوضّح بيلمار الأسباب الكامنة وراء تجنّبه مواجهة السيّد وعازوري في جلسة علنية، سائراً على خطى من سبقوه في مضمار التهرّب من مواجهة قانونية حتمية ولا سيما عندما كان الأمر يتعلّق بشهود الزور وشركائهم.
ولم يتسنّ للمحكمة الخاصة بلبنان أن تعقد منذ ولادتها القيصرية في الأوّل من آذار 2009، أيّة جلسة لعدم وجود متهمين أساسيين وموقوفين، ولعدم صدور القرار الظنّي، كما أنّه لم يسبق للقاضي فرانسين أن عقد جلسة لانتفاء مبرّراتها وعدم وجود قضيّة حساسة وجوهرية كالمعروضة عليه من السيّد.
وبات فرانسين أمام خيارين اثنين، فإمّا أن يعيّن موعداً لجلسة علنية، وإمّا أن يصدر قراره أو حكمه، من دون هذه الجلسة العلنية على غرار الجلسة الشهيرة التي عقدها في 29 نيسان 2009، عندما أعلن براءة الضبّاط الأربعة اللواءين جميل السّيد وعلي الحاج، والعميدين مصطفى حمدان وريمون عازار، وأفرج عنهم فوراً من مكان اعتقالهم في سجن غير شرعي تابع لفرع المعلومات في قوى الأمن الداخلي، في سجن رومية المركزي.
ولا أحد يعرف نتيجة حكم فرانسين قبل صدوره، فإمّا أن يلبّي طلب اللواء السيّد بمنحه الأدلّة والإثباتات على شهود الزور وشركائهم ويمكّنه من ملاحقتهم أمام محاكم أخرى حيث رفعت دعاوى ضدّهم في سوريا وفرنسا على سبيل المثال، وإما أن يأخذ فرانسين برأي بيلمار فيمنع تلك الأدلّة عن السيّد.
ومهما يكن القرار في هذا الشأن، فإنّه برأي متابعين، سيؤدّي إلى نتائج أساسية، فإذا ما حصل السيّد على غايته من الأدلّة والإثباتات عن شهود الزور المعروفين أمثال محمّد زهير الصدّيق وهسام طاهر هسام، وإبراهيم ميشال جرجورة، وعبد الباسط بني عودة، وأكرم شكيب مراد، وشركائهم من سياسيين وقضاة وأمنيين وإعلاميين سبق للسيّد أن سمّاهم واحداً واحداً في غير مؤتمر وتصريح صحافي، فيصبح هؤلاء جميعاً أكثر عرضة للملاحقة.
وإذا رفض فرانسين طلب السيّد وشاطر بيلمار رأيه لجهة حجب الأدلّة، فإنّ المحكمة الخاصة بلبنان، وبرأي معنيين بهذه القضيّة، «تصبح متهمة بإخفاء الأدلّة، ومنح حصانة سياسية غير مشروعة لشهود الزور وشركائهم».
وبين هاتين الحالتين، فإنّ هذه الجبهة القانونية المشتعلة بين السيّد وبيلمار لن تبرد على الإطلاق، وأقلّه خلال فصل الصيف الحار، لأنّه من حقّ كل واحد منهما، بعد صدور قرار فرانسين بحالة سلبية من وجهة نظر أحدهما، أن يلجأ إلى استئناف القرار أمام الهيئة العامة للمحكمة الخاصة بلبنان برئاسة القاضي الإيطالي أنطونيو كاسيزي شخصياً، أو أن يحيل هذا الأخير الرئاسة موقتاً وللبتّ في هذا النزاع، لنائبه اللبناني رالف رياشي.
وممّا لا شكّ فيه، فإنّ هذا التقدّم، يعطي لهذه القضيّة أبعاداً وتعقيدات أخرى، وتصبح المواجهة الحالية بين السيّد وعازوري من جهة، وأطراف المحكمة من جهة أخرى، برأي أحد المعنيين، «الواجهة الأولى من جبل الجليد الذي يخفي خلفه مؤامرة شهود الزور وشركائهم والمناورات السياسية التي تحيط بالمحكمة، وصولاً إلى نتائج كلّ ذلك، على مصداقيتها، بما في ذلك القرار الظنّي المرتقب».
فماذا يخبّئ فرانسين في حيثيات قراره؟ وكيف سترسو هذه القضيّة في ظلّ امتلاك جميل السيّد نَفَسَاً طويلاً لملاحقة شهود الزور وشركائهم أينما وجدوا؟

بلمار: الوصول إلى العدالة بالمراسلة

قدّم المدّعي العام في المحكمة الدولية الخاصّة بجريمة اغتيال الرئيس رفيق الحريري، دانيال بلمار، يوم الأربعاء الفائت، ردّه على ما كان اللواء الركن جميل السيّد قد تقدّم به إلى قاضي الإجراءات التمهيدية دانيال فرانسين بخصوص تسليم مستندات في قضية اعتقاله التعسّفي

شدّد المدعي العام الدولي دانيال بلمار على عدم صلاحية المحكمة الخاصة بلبنان النظر في قضية الاعتقال التعسّفي، وادّعى عدم الصلاحية القانونية للواء جميل السيّد في المطالبة بعقد جلسة علنية في لاهاي لبتّ طلبه الحصول على مستندات يحتفظ بها المدعي العام.
اللواء السيد يطالب بتسليمه مراسلات بخصوص استمرار احتجازه في سجن رومية لمدة نحو أربع سنوات، كانت لجنة التحقيق الدولية قد بعثت بها الى القضاء اللبناني.
إن إصرار بلمار على عدم تسليم المراسلات يتلازم مع تأكيده عدم صلاحيته النظر في قضية الاعتقال التعسّفي. لماذا إذاً يتمسّك بلمار بمستندات يقول إنه لا صلاحية له بشأنها؟ ألا يعدّ موقف بلمار عقبة أمام ممارسة السيد حقّه بملاحقة محتجزيه تعسّفياً أمام القضاء اللبناني؟
المدير العام السابق للأمن العام كان قد احتجز في سجن رومية لسنوات قبل أن يأمر القاضي فرانسين بعد نحو شهرين على انطلاق المحكمة في آذار 2009 السلطات اللبنانية بفكّ احتجازه بسبب «عدم صدقيّة المعلومات» التي كان قد احتجز على أساسها بناءً على توصية رفعها رئيس لجنة التحقيق الدولية ديتليف ميليس الى المدعي العام لدى محكمة التمييز القاضي سعيد ميرزا.
للسيّد كما لغيره، بحسب أبسط مبادئ العدالة، الحقّ في ملاحقة من احتجزه تعسّفياً، أو على الأقلّ، من يتّهمه بذلك. لكن بلمار كرّر في ردّه الثاني إصراره على حرمان السيّد هذا الحقّ البديهي.
تناول ردّ بلمار على الكتاب الذي تقدّم به السيّد بواسطة وكيله القانوني المحامي أكرم عازوري في 17 حزيران الفائت، جانبين أساسيين: أولاً إذا كان للمحكمة الخاصة بلبنان الصلاحية القانونية لأمر المدعي العام بتسليم مستندات الى السيّد تساعده في قضية يرفعها أمام القضاء اللبناني. وثانياً إذا كان السيد يتمتع بصلاحية إثارة هذا الشأن.
وحسم بلمار الجانب الأول بالتأكيد أن لا صلاحية قانونية للمحكمة في النظر في هذا الأمر. وأضاف ان السيّد كان قد أشار في ردّه الى المادة 85 من نظام المحكمة الجنائية الدولية المعنية بحقّ ضحية التوقيف والاحتجاز غير القانونيين بالعودة إليها للمطالبة بتعويضات. إن هذه المادة تطبّق، بحسب بلمار، بحقّ «شخص أخلي سبيله بعد صدور قرار نهائي بحقّه أو بعد ختم الإجراءات لهذا السبب، وهو ما لا ينطبق على حالة السيد (following a final decision of acquittal or a termination of the proceedings for that reason, a situation that does not apply to the Applicant). إن التعويضات بحسب المادة 85 تمنح في ظروف استثنائية إثر ثبات تجاوزات جدية وواضحة للعدالة». (الفقرة 5 من ردّ المدعي العام).
لكن القاضي فرانسين رأى في قراره الصادر في 29 نيسان 2009 «أنه لا يمكن، في هذه المرحلة من التحقيق، أن يُعتبر الأشخاص الموقوفون مشتبهاً فيهم أو متهمين في إطار الإجراءات العالقة أمام المحكمة الخاصّة. وبالتالي، طبقاً للقواعد، لا يستوفي وضع هؤلاء الأشخاص تحت الشروط الأساسية التي تبرّر احتجازهم المؤقت أو الإفراج المشروط عنهم». (الفقرة 39) وبما أن «النسخة الفرنسية هي النسخة ذات الحجية» كما ورد في قرار فرانسين، جاء حرفياً في النصّ: «elles (les personnes) ne remplissent pas une des conditions sine qua non pour être placées en détention provisoire, voire même pour être libérées sous condition». بما أن السيّد والضباط الآخرين لا يخضعون لإطلاق السراح المشروط، وبما أن المحكمة لا تعتبرهم مشتبهاً فيهم أو متهمين فإن وضع بلمار شروطاً على تحصيل أحدهم حقوقه القانونية يعتبر مساساً بقرينة البراءة.
إن اعتبار بلمار أن القرار الذي صدر بحقّ السيد غير نهائي مستغرب، فإذا كانت لدى المدعي العام صلاحية قانونية بهذا الشأن بحسب قواعد الإجراءات والأدلّة، تقتصر على التوقيف لمدة شهر قابلة للتجديد مرّتين، أما في ما يخصّ الاتهام فالأمر يخضع لموافقة القاضي فرانسين، أما بخصوص البراءة أو عدمها فلا يعود ذلك لا لبلمار ولا لفرانسين بل لحكم المحكمة. وبما أنه لا اتهام ولا محاكمة حتى الآن فالسيد، كما غيره من الناس، أبرياء نهائياً.
يعبّر بلمار عن مفاجأته بقول السيد إنه لا صلاحية للمدعي العام بشأن طلبه. فهو على ما يبدو لم يفهم أن المقصود هو طلب تسليم مستندات اعترف المدعي العام بنفسه بأنها تخص قضية من خارج صلاحياته، وبالتالي فلا صلاحية للمدعي العام.
على أي حال، إن ردّ بلمار يوضّح «ان نظام روما لا ينطبق على المحكمة الخاصة بلبنان» (الفقرة 6). وهو أمر معروف، لكن من المفيد التذكير به لعلّه يسهم في قياس مدى دقّة قواعدها وعدالتها.
يبدو أن بلمار حسم أن دوافع سجن أشخاص تعسّفياً لا علاقة لها بالجريمة
يقول بلمار إن السيد حصّل طلبه بالوصول الى العدالة (access to justice) عبر تقدمه بطلبات خطية (enjoying access to justice through the submission of his written pleadings) (الفقرة 8 i) وفي ذلك ما يدعو الى التهكّم. فهل يعتبر بلمار أن الوصول الى العدالة يقتصر على المراسلات؟
أما بخصوص الصلاحية القانونية، فيقول بلمار إنه «ينبغي حسمها قبل تقديم أي قضية أمام قاضي الإجراءات التمهيدية. إن الصلاحية القانونية للمحكمة محدّدة في محاكمة إرهابيين. إن طلب السيد لا يدخل ضمن هذه الصلاحية القانونية». إن هذا الحسم يزيد من استغراب القارئ، اذ يبدو أن بلمار حسم بأن دوافع سجن أشخاص تعسّفياً خلال مرحلة التحقيق في جريمة مصنّفة إرهابية لا علاقة لها بتلك الجريمة ومنفّذيها. إذاً حقق المدعي العام في هذا الشأن رغم أنه لا يكفّ عن التكرار أنه من خارج صلاحياته.
أخيراً، يدعو بلمار القاضي فرانسين الى عدم عقد جلسة علنية لبحث هذا الشأن بحجة انتفاء الصلاحية القانونية، ويؤكد أن السيد عبّر عن نفسه وتمّ الردّ على ما ورد عنه، و«سيكرّر مواقفه viva voce (أي بالصوت الحي) أمام قاضي الإجراءات التمهيدية. وهذا ليس من مصلحة التوفير القضائي (judicial economy)». لبنان أسهم أخيراً بـ108 مليارات ليرة لتغطية نفقات المحكمة، فكيف يُحرم مواطن لبناني حقوقه بحجّة «التوفير القضائي»، بينما تصرف الملايين على رواتب بلمار وفريق عمله من دون وجود تقرير مالي يشرح كيفية صرف أموال اللبنانيين؟

الاستعانة بالمدفعيّة القضائيّة الثقيلة
استعان المدعي العام دانيال بلمار بثلاثة خبراء قانونيين دوليين للردّ على الكتاب الذي رفعه اللواء جميل السيد الى قاضي الإجراءات التمهيدية دانيال فرانسين. الثلاثة هم: الأميركي داريل مونديس والألماني إيكهارت ويتهوبف والكندية ماري صوفي بولان.
مونديس، متخرج من كلية الحقوق في جامعة كولومبيا، هو ضابط في البحرية الحربية الأميركية. خدم محامياً للمحكمة الدولية الخاصة بيوغوسلاقيا السابقة خلال محاكمة الرئيس سلوبودان ميلوسيفيتش. وشارك مونديس مقرّر المحكمة الدولية الخاصة بلبنان السابق دايفيد تولبرت في وضع كتاب عن إجراءات محكمة يوغوسلافيا السابقة عام 2000.
أما ويتهوبف فعمل لمصلحة الادعاء العام للمحكمة الجنائية الدولية في قضية الزعيم لوبانغا من جمهورية الكونغو. وهو يتمتّع بخبرة واسعة، غير أن خلافاً وقع بينه وبين المدعي العام لويس مورينو أوكامبو لأسباب مجهولة. بولان محامية كندية عملت لمصلحة الادّعاء في كندا كانت على صلة ببلمار قبل انتقاله الى لاهاي.

BEIRUT: The Beirut Publications Court fined both Al-Mustaqbal director and journalist LL 6 million on Wednesday for slander against former General Security Director General Jamil al-Sayyed. The court charged journalist Fares Khashan and the director of the Arabic daily Al-Mustaqbal, Tufiq Khattab, with slander and fined them LL6 million. They were accused of publishing an article in October 2009 containing material offensive to Sayyed and they were fined an additional LL1 million in personal indemnities. The two were also ordered to publish the court’s verdict. – The Daily Star

L'orient le jour - Le suspense se prolonge dans le litige entre le TSL et Jamil Sayyed

Le Tribunal spécial pour le Liban vient de rendre publics des documents relatifs à un nouveau rebondissement dans l'affaire de Jamil Sayyed, qui ne manquera pas, une fois de plus, de faire couler beaucoup d'encre.

L'ancien directeur de la Sûreté générale avait présenté une requête devant la juridiction internationale pour faire prévaloir son droit à l'obtention des documents et éléments de preuve qui avaient conduit à un moment donné (sous le mandat du premier chef de la commission d'enquête internationale, Detlev Mehlis) à sa détention. Ces documents avaient par la suite été jugés par le TSL comme étant insuffisants, ce qui a abouti à la décision de sa libération en même temps que les trois autres officiers détenus dans le même contexte.
Dans une requête présentée le 17 mars dernier, M. Sayyed rappelle le fait que les autorités judiciaires libanaises aussi bien que le TSL s´étaient prononcés incompétents pour statuer sur l'affaire de son arrestation durant quatre ans. Il soutient qu'il est, par conséquent, de son droit de réclamer tous les documents et éléments de preuves relatifs à son dossier pour pouvoir s'adresser à une juridiction nationale (les tribunaux syriens, en l'occurrence, devant lesquels il a déjà déposé une plainte contre des faux témoins et plusieurs personnalités libanaises).
C'est ce qui ressort à la lecture de la correspondance qui a eu lieu entre l'ancien directeur de la Sûreté générale, représenté par son avocat Akram Azouri, d'une part, et le TSL, d'autre part, représenté successivement par son président, son juge de la mise en état, et son procureur, MM Antonio Cassese, Daniel Fransen et Daniel Bellemare.
Certes, l'affaire n'est pas tout à fait confidentielle puisque M. Cassese avait annoncé la couleur lors de son dernier passage à Beyrouth lorsqu'il avait brièvement mentionné la requête déposée par Jamil Sayyed auprès du TSL, en mars dernier. Sans pour autant s'étendre sur le fond de l'affaire, le président du TSL avait annoncé avoir accepté la demande de M. Sayyed, pour des considérations relevant des droits de l'homme, et notamment du droit de toute personne à présenter un recours devant la justice.

Le droit d'accès à la justice
M. Cassese rappelle dans sa correspondance adressée au juge Fransen que quand bien même le requérant n'est pas « partie » dans la procédure entamée par le TSL, puisqu'il n'est ni accusé, ni victime, ni témoin, ce dernier peut quand même se faire prévaloir de ses droits de recours devant une instance internationale car, dit M. Cassese, « les formalités purement procédurières ne devraient pas l'emporter lorsque d'importants droits risquent d'être compromis ».
Par conséquent, le président du TSL a décidé d'examiner le bien-fondé de la requête, et a habilité M. Sayyed à déposer des documents relatifs à l'affaire sans pour autant se prononcer sur le fond, puisque cette compétence revient de facto au juge de la mise en état auquel le dossier a été transmis.
Reconnaissant ainsi le droit d'accès à la justice, M. Cassese a justifié sa décision en se basant notamment sur « le droit international coutumier, tel qu'il ressort des instruments internationaux ainsi que de la jurisprudence des tribunaux internationaux et des déclarations des États ».
Ayant été saisi de l'affaire, le juge Fransen a ordonné aussi bien au procureur qu'à Jamil Sayyed de présenter leurs arguments respectifs prouvant, d'une part, la compétence du TSL pour répondre positivement ou négativement à la demande de l'officier, et, d'autre part, la qualité de ce dernier de comparaître (sa qualité d'ester) devant le TSL pour faire prévaloir ses droits en matière de documentation. Les deux parties ont été sommées de présenter leurs arguments respectifs selon un calendrier préétabli qui expire lundi 28 juin, date à laquelle M. Bellemare devra remettre au juge Fransen sa dernière réplique.

Une première
Sur base des argumentations respectives de l'un et de l'autre, M. Fransen entendra, lors d'une audience publique dont il fixera la date, le procureur et le requérant pour se prononcer enfin sur la compétence du tribunal et sur la qualité d'ester du requérant, pour pouvoir enfin statuer sur le bien-fondé de la requête.
Entre-temps, M. Sayyed a présenté, dans une première correspondance, son argumentation sur les deux points de droit requis, mettant en avant, d'une part, son droit à l'accès au dossier, « droit qui lui avait été refusé lors de sa détention ». Il avance par ailleurs le refus de la justice libanaise de confronter le faux témoin « dont les déclarations avaient justifié à l'époque sa détention ». Il prouve également la compétence du TSL à statuer sur son dossier puisque entre les dates du 7 mars (date du dessaisissement des autorités libanaises du dossier en faveur du TSL) et du 29 avril (date de sa libération), M. Sayyed « était une personne détenue par le TSL sans qualification juridique ».
Réponse du procureur : Jamil Sayyed n'étant ni accusé ni victime, il n'a pas qualité à s'adresser au TSL. Qui plus est, avance M. Bellemare qui s'est abstenu de se prononcer sur le fond de l'affaire, le TSL, qui est un tribunal d'exception, ne saurait être compétent puisque sa mission est limitée par le statut qui l'autorise à se pencher sur la seule affaire de l'assassinat de Rafic Hariri.
Ce à quoi M. Sayyed répondra en avançant plusieurs arguments, notamment une jurisprudence qui avait admis le fait que les tribunaux internationaux, même s'ils sont une émanation de la volonté du Conseil de sécurité, ne sont pas pour autant des organes administratifs, mais « détiennent un pouvoir inhérent et implicite pour rendre justice ». L'argumentation va encore plus loin en citant comme exemple le cas du tribunal du Rwanda qui avait quand même reconnu sa propre compétence pour statuer sur la demande en indemnités d'un ancien détenu, quand bien même son statut ne le permettait pas.
Il ne reste donc plus qu'à attendre la réplique finale du procureur, prévue pour lundi prochain au plus tard, avant la réponse ultime du juge de la mise en état qui devra fixer la date de l'audience et trancher sur la forme aussi bien que sur le fond.
Un débat d'autant plus passionnant qu'il s'agit, rappelons-le, d'une première en la matière qui ne manquera pas d'établir un précédent.
Rappelons enfin que la confrontation entre M. Bellemare et M. Sayyed sera d'autant plus intéressante que ce dernier n'a effectivement ni une qualité de victime ni une qualité de témoin, encore moins de suspect ou d'accusé. Par conséquent, la question de la qualité de M. Bellemare face au requérant reste entière : ce dernier sera-t-il présent en tant que procureur ou aura-t-il, à titre exceptionnel, une autre qualité pour faire prévaloir ses arguments ?

جبهة المراسلات والمذكرات المتبادلة تشتعل بين جميل السيد وبيلمار
هل يقرر فرانسين الإفراج عن وثائق تدين «شهود الزور» أو يحجبها؟

استعرت جبهة المراسلات والمذكّرات القانونية المتبادلة بين اللواء الركن جميل السيّد والمدعي العام الدولي القاضي دانيال بيلمار حول مطالبة الأوّل بتزويده بكلّ الأدلة والإثباتات عن شهود الزور وشركائهم الذين تسبّبوا باعتقاله التعسفّي مع ثلاثة ضبّاط آخرين على مدى ثلاث سنوات وتسعة أشهر تقريباً، وقبل انتقال ملفّ التحقيق برمّته إلى المحكمة الخاصة بلبنان اعتباراً من يوم الأحد في الأوّل من شهر آذار 2009.
وقد نشر الموقع الإلكتروني التابع للمحكمة الخاصة بلبنان، دفعة واحدة ومن دون أيّة مقدّمات، كلّ هذه المراسلات والمذكّرات المتبادلة بين جميل السيّد وبيلمار، بدءاً من المذكّرة الأولى الأساسية التي أرسلها السيّد في 12 آذار 2010، وصولاً إلى الردّ الأخير له على مطالعة بيلمار في 17 حزيران 2010، لتتبقّى أمام بيلمار مهلة سبعة أيّام عمل بدأت في 18 حزيران 2010 وتنتهي في 28 منه، ليقدّم رأيه النهائي إلى قاضي الإجراءات التمهيدية دانيال فرانسين الذي يتعيّن عليه تحديد جلسة علنية تقام في مقرّ المحكمة في لاهاي، يفصل فيها بين المتنازعين.
وبنى اللواء السيّد ووكيله القانوني المحامي أكرم عازوري، مطالعتهما المشتركة المُحْكَمَة، على أنّ المحكمة الخاصة بلبنان تحتفظ بالإثباتات والأدلّة عن شهود الزور وشركائهم خلال ولاية لجنة التحقيق الدولية المستقلّة، وأنّ المحكمة تنازلت في الوقت نفسه، عن صلاحياتها في محاسبة هؤلاء وملاحقتهم قانونياً، واعتبرت أنّ تلك المحاسبة تقع على عاتق القضاء الوطني سواء أكان هذا القضاء لبنانياً، أو سورياً، أو فرنسياً، أو غيره، وهي من صميم صلاحياته، ولذلك طالب السيّد بتسليمه هذه الأدلّة والإثباتات وبما يسمح له بالادعاء على شهود الزور وشركائهم لدى القضاء الوطني المختص.
واستند السيّد وعازوري وبحسب الملفّات المنشورة على الموقع الإلكتروني، إلى مبدأين قانونيين هما: حقّ الإطلاع على ملفّ التحقيق، وحقّ اللجوء إلى قاض، ورأى أنّ المحكمة الخاصة بلبنان في حال منعته من الإطلاع على الملفّ والحصول على نسخ عنه، فإنّها تكون عملياً قد منعته من حقّه باللجوء إلى قاض، وتكون عملياً قد منحت شهود الزور وشركاءهم حصانة شبه عامة ضدّ أية ملاحقة، وهذا ما يتنافى مع كلّ القوانين الدولية المعترف بها، كما أنّه يتعارض مع مبادئ حقوق الإنسان التي تدعي المحكمة الخاصة بلبنان أنّها قامت على أساسها.
وفي قراءة لفحوى مطالب اللواء الركن السيّد المنشورة على الموقع المذكور، يتبيّن أنّه أكّد على حقّه في استلام جملة مستندات من المحكمة أهمها الآتي:
أوّلاً: كلّ محاضر الاجتماعات التي جرت بين رؤساء لجنة التحقيق الدولية المستقلّة المتعاقبين ديتليف ميليس وسيرج برامرتز ودانيال بيلمار، مع المدعي العام اللبناني سعيد ميرزا وباقي المسؤولين اللبنانيين والتي جرى خلالها التطرّق إلى شهود الزور والاعتقال التعسفي ولاسيّما في الاجتماعات التي حصلت بين برامرتز وميرزا، في 8 كانون الأوّل 2006، و26 نيسان 2007، والاجتماعات بين بيلمار وميرزا في 17 كانون الثاني 2008، و7 آذار 2008، وكانون الأوّل 2008، ومطلع العام 2009، بما في ذلك حقّ اللواء الركن السيّد في الحصول على نسخة عن الرأي الذي أعلن بيلمار أنّه سلّمه إلى ميرزا في نهاية العام 2008، حول الإفراج عن الضبّاط الأربعة وموقف ميرزا والمحقّق العدلي القاضي صقر صقر، من هذا الموضوع.
وتجدر الإشارة هنا، إلى أنّ القاضي ميرزا أنكر استلامه مثل هذا الرأي ليبقى الضبّاط الأربعة معتقلين تعسفياً مدّة أربعة أشهر إضافية إلى حين إفراج المحكمة عنهم في 29 نيسان 2009.
ثانياً: كلّ المحاضر والمستندات المتعلّقة بشهود الزور، ودور «فرع المعلومات» في المديرية العامة لقوى الأمن الداخلي تحت غطاء المدعي العام اللبناني.
ثالثاً: المناورات والضغوط غير المشروعة التي مارسها القاضي الألماني ديتليف ميليس ومساعده مواطنه غيرهارد ليمان، لدفع اللواء الركن السيّد إلى الإدلاء بشهادة زور، مع إصرار السيّد على تزويده بالتسجيلات الصوتية التي تثبت هذه الوقائع.
رابعاً: نسخة عن رأي القاضي سيرج برامرتز المقدّم في 8 كانون الأوّل 2006، إلى القاضيين ميرزا والمحقّق العدلي إلياس عيد، والذي أكّد فيه أنّ كل الشهود كانوا مزورين، ومع ذلك واظب ميرزا وعيد على ممارسة الاعتقال التعسفي بحقّ الضبّاط الأربعة.
خامساً: نسخة عن الشكاوى والادعاءات الشخصية التي تقدّم بها السيّد خلال فترة التحقيق إلى القضاء اللبناني، ضدّ القضاة ميرزا وعيد وصقر، بما في ذلك المستندات المرتبطة بقيام القاضي رالف رياشي بتنحية القاضي عيد بهدف منعه من الإفراج عن السيّد والعميد ريمون عازار في العام 2007.
وبحسب الأوراق المنشورة على الموقع الإلكتروني للمحكمة، يتضح أنّ القاضي بيلمار أجاب في مطلع شهر حزيران 2010، على مذكّرة السيّد مبدياً ممانعته المطلقة لتسليمه أيّاً من المستندات المطلوبة، ومبرّراً رفضه بأنّه لن يدخل في عمق هذه المطالب وفي أساسها، بل سيكتفي بإبداء رأيه إلى القاضي دانيال فرانسين برفضها من الناحية الشكلية بصرف النظر عن صحّتها.
وقد اعتبر بيلمار أنّه من حيث الشكل، لا توجد صلاحية للمحكمة الخاصة بلبنان من خلال نصوصها ونظامها وقواعد إجراءاتها، للنظر في مراجعة السيّد الذي ليس من الأطراف المصرّح لها بالمراجعة أمام المحكمة لاسيّما وأنّه لا يعتبر مشتبهاً به ولا يعتبر ضحيّة، وبالتالي، فإنّ عدم حيازته على إحدى هاتين الصفتين، يجعل منه شخصاً لا يتمتّع بالصفة التي تسمح له بالمثول أمام المحكمة.
وأرفق بيلمار مطالعته الواقعة في 600 صفحة من المستندات، باستشهادات متصلة باجتهادات وأحكام قضائية صادرة عن محاكم دولية أخرى وعن محاكم وطنية متنوّعة.
وردّ السيّد والمحامي عازوري على كلام بيلمار وحججه في ملفّ مؤلّف من مائتي صفحة ضمنها مطالعة رئيسية مكوّنة من نحو عشرين صفحة، وأثبتا أنّ المحكمة الخاصة بلبنان تملك كامل الصلاحية للنظر في طلبات السيّد، كما أثبتا ومن خلال الحجج القانونية، أنّ للسيّد صفة إلزامية للمثول أمام المحكمة انطلاقاً من نصوص المحكمة نفسها ومن وجود أسبقيات قانونية أخرى في هذا المجال، بما فيها الأسبقيات التي استند بيلمار إليها في ردّه على اللواء الركن السيّد.
ولم يكتف عازوري بذلك، بل ذهب إلى ناحية أبعد مثبتاً عدم وجود صفة للقاضي بيلمار نفسه، خصوصاً وأنّ بيلمار نفسه ليس مدعياً عاماً في هذه القضية، ولا هو في موقع اتهامي، بل هو أحد أعضاء المحكمة ويحتفظ بحكم موقعه هذا، بأدلّة وإثباتات لا علاقة لها بالتحقيق لا من قريب ولا من بعيد، وأسقطت المحكمة الخاصة بلبنان صلاحيتها عنها، وبالتالي، فإنّ احتفاظ بيلمار بها لا يؤدّي إلاّ إلى منفعة شهود الزور وشركائهم، ويحرم السيّد من حقّ بديهي له معترف به دولياً، وهو حقّ اللجوء إلى قاض.
وإنْ كانت أيام قليلة تفصل عن معرفة النتيجة النهائية لهذا النزاع، إلاّ أنّ الثابت الأهمّ، هو أنّ اللواء الركن السيّد والمحامي عازوري نقلا معركتهما حول شهود الزور، إلى المحكمة الخاصة بلبنان نفسها، ممّا يعطي لهذا الموضوع أبعاداً أكبر ونتائج خطيرة على المتورّطين معهم في مختلف المواقع الرسمية في الدولة اللبنانية، والتي سبق للسيّد أن عدّدها في غير مؤتمر صحافي عقده منذ خروجه من السجن في 29 نيسان 2009.
وردّاً على سؤال لـ «السفير» عن الأسباب الكامنة وراء إيصال اللواء الركن جميل السيّد الأمور إلى هذا الحدّ، يقول «اسألوا وزير العدل والنائب العام التمييزي أوّلاً، ونحن في نهاية المطاف، أخذنا بنصيحة النائب سعد الحريري يوم طالبناه بمحاسبة شهود الزور وشركائهم، فأجاب علناً من مائدة إفطار في قريطم «القضية ليست عندنا، اذهبوا ودقّوا رأسكم في لاهاي»، ونحن اليوم ندقّ رأسنا في لاهاي».
في الختام، لا بد من طرح السؤالين الآتيين:
أولا، هل ستمنح المحكمة الخاصة بلبنان شهود الزور والمسؤولين عن الافادات الكاذبة وعن تضليل التحقيق الدولي في قضية الرئيس الحريري «حصانة شبه عالمية»، من خلال إسقاط حق اللواء السيد في الحصول على الوثائق والمستندات التي تدين تورط بعض الأشخاص بهذا الجرم حتى يتسنى له مقاضاتهم أمام المحاكم الوطنية؟
ثانيا، ماذا إذا تجاوبت المحكمة مع اللواء السيد سنداً للمبادئ القانونية التي بنى عليها رئيس المحكمة الخاصة القاضي انطونيو كاسيزي في قرار إحالة طلب اللواء السيد إلى قاضي الإجراءات التمهيدية دانيال فرانسين، ومنها «حق كل فرد، لدى الفصل في أية تهمة جزائية توجه إليه أو في حقوقه والتزاماته في أية دعوى مدنية، ان تكون قضيته محل نظر منصف وعلني من قبل محكمة مختصة مستقلة حيادية، منشأة بحكم القانون»؟
يذكر أن هذا الحق، وإن حاول التخفيف من قوته كاسيزي نفسه من خلال اعتباره، في البند 33 من قرار الإحالة، ان «حق الاحتكام إلى القضاء ليس بحق مطلق»، يمكن تعليقه بشكل مؤقت تماشياً مع القانون الدولي، «في حالات الطوارئ الاستثنائية التي تتهدد حياة الأمة والمعلن قيامها رسمياً، أو إذا بررت هذه القيود شروط منها «تجنب ان يكون الهدف الأساسي من الاحتكام إلى القضاء التعدي الجائر على حق الآخرين في الخصوصية، أو إذا أجازتها، أو «الحاجة إلى احترام الحصانات الشخصية أو الوظيفية التي يتمتع بها الشخص أو الدولة التي قدّمت الشكوى ضدها».
هذا الحق سيشق طريقه نحو عملية مقاضاة سيخرج منها السيد منتصراً في مطلق الأحوال، فإما ان يُعطى «الوثائق» ليمضي في مقاضاة من ارتكب بحقه وحق رفاقه من الضباط ظلامة موصوفة، وإما أن تمتنع المحكمة من إعطائه هذه الوثائق، «ويصبح إذاك الحديث عن العدالة أشبه بوجهة نظر» حسب أحد محامي السيد.
لننتظر القاضي فرانسين وكلمته الحاسمة في تموز 2010.

بلمار يحتفظ بأدلّة جنائيّة في قضيّة يدّعي أنها خارج اختصاصه

بأيّ حقّ يحتفظ المدّعي العام في قضية اغتيال الرئيس رفيق الحريري بالرسائل التي كان قد وجّهها رئيس لجنة التحقيق الدولية سيرج براميرتس إلى المدعي العام لدى محكمة التمييز القاضي سعيد ميرزا بخصوص احتجاز أشخاص؟
إذا كان بلمار يرى أن تلك الرسائل من ضمن وثائق التحقيق السرّية، فهذا يعني أن مضمونها يدخل في صلب اختصاص عمله مدّعياً عاماً.
لكن المدعي العام يقول ويكرّر إن قضية احتجاز الناس في إطار التحقيق قبل انطلاق عمل المحكمة (آذار 2009) ليست من اختصاصه القضائي، لكنه يرفض الإفراج عما بحوزته من دليل في قضية جنائية يدّعي أنها ليست من اختصاصه، وفي ذلك مخالفة صارخة لمبدأ العدالة.
نشرت المحكمة الدولية يوم الجمعة الفائت، على موقعها الإلكتروني الرسمي (www.stl-tsl.org/sid/55)، نسخاً عن الوثائق المرسلة الى قاضي الإجراءات التمهيدية دنيال فرانسين من قبل اللواء الركن جميل السيّد والمدعي العام الدولي دنيال بلمار. وكان السيّد قد تقدّم، بواسطة وكيله القانوني المحامي أكرم عازوري، في آذار الماضي من الرئيس القاضي انطونيو كاسيزي بطلب تحديد الصلاحية في قضية الاعتقال التعسّفي الذي تعرّض له.
لم يكن أمام كاسيزي من خيار إلا أمر فرانسين بتلقي مذكرة السيّد وتحديد البرنامج الزمني للمداولات التي قد تختتم بعقد جلسة علنية يحسم فيها الأمر. إذ إن القضية في منتهى الوضوح وهي تتعلّق بالحقّ البديهي لإنسان احتجز تعسّفياً في مقاضاة محتجزيه ومن يقف وراءهم. حدّد فرانسين البرنامج الزمني فمنح بلمار 14 يوماً للردّ على السيّد، ومن ثمّ للسيّد 14 يوماً للردّ على الردّ، ويُمنح بعد ذلك كلّ من الطرفين سبعة أيام للإدلاء بملاحظاتهما.
ردّ بلمار في 4 حزيران الفائت، وردّ عليه السيّد في 17 حزيران. قال بلمار إنه لن يغوص في أساس هذه القضية، مشدّداً على أنه لا صلاحية للمحكمة الدولية، بحسب نصوصها، للنظر باحتجاز السيّد. وأضاف إنه لا صفة قانونية للسيّد بالتقدّم بما تقدّم به الى قاضي الإجراءات التمهيدية، فهو ليس مشتبهاً فيه. وضمّ بلمار الى ردّه مئات الصفحات تضمّنت اجتهادات دولية في هذا السياق. وأخيراً شدّد على سرية المعلومات التي بحوزته لحين إصداره القرارات الاتهامية.
بالمقابل، سعى السيّد ومحاميه أكرم عازوري الى تثبيت أن ما تقدّم به بلمار غير دقيق، إذ إن المراجع التي استعان بها بلمار لدعم موقفه لم يطّلع، على ما يبدو، على كامل مضمونها بحيث إنها تدحض ادعاءات بلمار. فكيف يمكن أن يلغي المدعي العام صلاحية المحكمة النظر في قضية الاعتقال التعسّفي، بينما لا يلغي استعانته بمضمون التحقيقات التي أجريت خلال المدة التي سبقت انطلاق المحكمة، بما فيها التحقيقات التي قام بها عندما تولى بنفسه رئاسة لجنة التحقيق الدولية؟
السيد يطالب بحقّه البديهي في المثول أمام المحكمة، وبالتالي هو يطالب بحقّه في الاطلاع على محاضر الاجتماعات والمراسلات بين لجنة التحقيق الدولية والقضاء اللبناني بخصوص استمرار احتجازه، وبحقّه في الاطّلاع على تقارير يشتبه في أن «شعبة» المعلومات في قوى الأمن الداخلي أرسلتها الى اللجنة الدولية بخصوص الاحتجاز. وكذلك يطالب السيد بحقه في الاطلاع على تفاصيل تنحية القاضي إلياس عيد من قبل القاضي رالف رياشي، وإذا كان لذلك علاقة بسعي عيد إلى فكّ احتجاز السيّد.
لعلّ السؤال الأبرز الذي يطرح هنا هو: ماذا سيفعل بلمار بكلّ تلك الوثائق التي يحتفظ بها؟ هل في قواعد الإجراءات والأدلّة ما يشرّع له الاحتفاظ بها أصلاً؟ وأليس احتفاظه بوثائق تتعلّق بقضية جنائية «من خارج اختصاصه» ما قد يدعو الى الشكّ؟ أمام بلمار سبعة أيام للإدلاء بملاحظاته على ردّ السيّد، فلننتظر جوابه. إما أن يرضخ لمعايير العدالة أو يستمرّ بإضعاف صدقيّة المحكمة الدولية الخاصّة بجريمة اغتيال الرئيس رفيق الحريري؟

Justice Le Tribunal spécial pour le Liban vient de rendre publics des documents relatifs à un nouveau rebondissement dans l'affaire de Jamil Sayyed, qui ne manquera pas, une fois de plus, de faire couler beaucoup d'encre.

L'ancien directeur de la Sûreté générale avait présenté une requête devant la juridiction internationale pour faire prévaloir son droit à l'obtention des documents et éléments de preuve qui avaient conduit à un moment donné (sous le mandat du premier chef de la commission d'enquête internationale, Detlev Mehlis) à sa détention. Ces documents avaient par la suite été jugés par le TSL comme étant insuffisants, ce qui a abouti à la décision de sa libération en même temps que les trois autres officiers détenus dans le même contexte.
Dans une requête présentée le 17 mars dernier, M. Sayyed rappelle le fait que les autorités judiciaires libanaises aussi bien que le TSL s´étaient prononcés incompétents pour statuer sur l'affaire de son arrestation durant quatre ans. Il soutient qu'il est, par conséquent, de son droit de réclamer tous les documents et éléments de preuves relatifs à son dossier pour pouvoir s'adresser à une juridiction nationale (les tribunaux syriens, en l'occurrence, devant lesquels il a déjà déposé une plainte contre des faux témoins et plusieurs personnalités libanaises).
C'est ce qui ressort à la lecture de la correspondance qui a eu lieu entre l'ancien directeur de la Sûreté générale, représenté par son avocat Akram Azouri, d'une part, et le TSL, d'autre part, représenté successivement par son président, son juge de la mise en état, et son procureur, MM Antonio Cassese, Daniel Fransen et Daniel Bellemare.
Certes, l'affaire n'est pas tout à fait confidentielle puisque M. Cassese avait annoncé la couleur lors de son dernier passage à Beyrouth lorsqu'il avait brièvement mentionné la requête déposée par Jamil Sayyed auprès du TSL, en mars dernier. Sans pour autant s'étendre sur le fond de l'affaire, le président du TSL avait annoncé avoir accepté la demande de M. Sayyed, pour des considérations relevant des droits de l'homme, et notamment du droit de toute personne à présenter un recours devant la justice.

Le droit d'accès à la justice
M. Cassese rappelle dans sa correspondance adressée au juge Fransen que quand bien même le requérant n'est pas « partie » dans la procédure entamée par le TSL, puisqu'il n'est ni accusé, ni victime, ni témoin, ce dernier peut quand même se faire prévaloir de ses droits de recours devant une instance internationale car, dit M. Cassese, « les formalités purement procédurières ne devraient pas l'emporter lorsque d'importants droits risquent d'être compromis ».
Par conséquent, le président du TSL a décidé d'examiner le bien-fondé de la requête, et a habilité M. Sayyed à déposer des documents relatifs à l'affaire sans pour autant se prononcer sur le fond, puisque cette compétence revient de facto au juge de la mise en état auquel le dossier a été transmis.
Reconnaissant ainsi le droit d'accès à la justice, M. Cassese a justifié sa décision en se basant notamment sur « le droit international coutumier, tel qu'il ressort des instruments internationaux ainsi que de la jurisprudence des tribunaux internationaux et des déclarations des États ».
Ayant été saisi de l'affaire, le juge Fransen a ordonné aussi bien au procureur qu'à Jamil Sayyed de présenter leurs arguments respectifs prouvant, d'une part, la compétence du TSL pour répondre positivement ou négativement à la demande de l'officier, et, d'autre part, la qualité de ce dernier de comparaître (sa qualité d'ester) devant le TSL pour faire prévaloir ses droits en matière de documentation. Les deux parties ont été sommées de présenter leurs arguments respectifs selon un calendrier préétabli qui expire lundi 28 juin, date à laquelle M. Bellemare devra remettre au juge Fransen sa dernière réplique.

Une première
Sur base des argumentations respectives de l'un et de l'autre, M. Fransen entendra, lors d'une audience publique dont il fixera la date, le procureur et le requérant pour se prononcer enfin sur la compétence du tribunal et sur la qualité d'ester du requérant, pour pouvoir enfin statuer sur le bien-fondé de la requête.
Entre-temps, M. Sayyed a présenté, dans une première correspondance, son argumentation sur les deux points de droit requis, mettant en avant, d'une part, son droit à l'accès au dossier, « droit qui lui avait été refusé lors de sa détention ». Il avance par ailleurs le refus de la justice libanaise de confronter le faux témoin « dont les déclarations avaient justifié à l'époque sa détention ». Il prouve également la compétence du TSL à statuer sur son dossier puisque entre les dates du 7 mars (date du dessaisissement des autorités libanaises du dossier en faveur du TSL) et du 29 avril (date de sa libération), M. Sayyed « était une personne détenue par le TSL sans qualification juridique ».
Réponse du procureur : Jamil Sayyed n'étant ni accusé ni victime, il n'a pas qualité à s'adresser au TSL. Qui plus est, avance M. Bellemare qui s'est abstenu de se prononcer sur le fond de l'affaire, le TSL, qui est un tribunal d'exception, ne saurait être compétent puisque sa mission est limitée par le statut qui l'autorise à se pencher sur la seule affaire de l'assassinat de Rafic Hariri.
Ce à quoi M. Sayyed répondra en avançant plusieurs arguments, notamment une jurisprudence qui avait admis le fait que les tribunaux internationaux, même s'ils sont une émanation de la volonté du Conseil de sécurité, ne sont pas pour autant des organes administratifs, mais « détiennent un pouvoir inhérent et implicite pour rendre justice ». L'argumentation va encore plus loin en citant comme exemple le cas du tribunal du Rwanda qui avait quand même reconnu sa propre compétence pour statuer sur la demande en indemnités d'un ancien détenu, quand bien même son statut ne le permettait pas.
Il ne reste donc plus qu'à attendre la réplique finale du procureur, prévue pour lundi prochain au plus tard, avant la réponse ultime du juge de la mise en état qui devra fixer la date de l'audience et trancher sur la forme aussi bien que sur le fond.
Un débat d'autant plus passionnant qu'il s'agit, rappelons-le, d'une première en la matière qui ne manquera pas d'établir un précédent.
Rappelons enfin que la confrontation entre M. Bellemare et M. Sayyed sera d'autant plus intéressante que ce dernier n'a effectivement ni une qualité de victime ni une qualité de témoin, encore moins de suspect ou d'accusé. Par conséquent, la question de la qualité de M. Bellemare face au requérant reste entière : ce dernier sera-t-il présent en tant que procureur ou aura-t-il, à titre exceptionnel, une autre qualité pour faire prévaloir ses arguments ?

موعد الجلسة الثانية للمحكمة الدولية

شرحت فاطمة العيساوي، المتحدثة الرسمية باسم المحكمة الدولية الخاصة بجريمة اغتيال الرئيس رفيق الحريري، لـ«الأخبار» أمس، موقف المحكمة من القضية التي كان قد رفعها اللواء الركن جميل السيّد إلى لاهاي بخصوص الاعتقال التعسّفي الذي تعرّض له. قالت العيساوي: «وصلنا أمس (17 حزيران) ردّ السيد جميل السيّد على جواب المدعي العام (دانيال بلمار).
وبحسب البرمجة الزمنية التي أمر بها القاضي فرانسين (قاضي الإجراءات التمهيدية) في 21 نيسان 2010، أمام المدعي العام سبعة أيام تبدأ اليوم (18 حزيران) ليتقدّم خلالها بردّ معاكس. إثر انتهاء هذه الإجراءات، وبعد هذا التبادل، سيتخذ قاضي الإجراءات التمهيدية قراراً بهذا الشأن، ويمكنه أن يطلب من تلقاء نفسه (proprio motu) أو بموجب طلب من السيد جميل السيّد أو من المدعي العام، جلسة علنية ويحدد موعدها» (مترجم حرفياً عن الإنكليزية).
وعلمت «الأخبار» أن السيّد تقدّم من خلال وكلائه القانونيين بطلب انعقاد جلسة علنية هي الثانية للمحكمة الدولية منذ انطلاق عملها في آذار 2009.
وتكتّم أمس المدعي العام الدولي والمدير العام السابق للأمن العام عن الأمر، غير أن السجال بين الطرفين يبدو شكلياً. فلا يمكن إسقاط حقّ انسان احتجز تعسّفياً في محاسبة المسؤولين عن ذلك التصرّف الجنائي. وبالتالي المحكمة الدولية تواجه قضية عدلية لا يمكن إغفالها إذا كانت فعلاً أداة لتحقيق العدل بعيداً عن التدخلات السياسية، إذ إن فكّ احتجاز اشخاص احتجزوا تعسّفياً ليس كافياً لتحقيق العدل في هذه القضية، بل على القضاء محاسبة جميع المسؤولين والمحرّضين والمنفذين لجريمة الاحتجاز التعسّفي.
يذكر أن الجلسة الأولى للمحكمة كانت قد عُقدت في 29 نيسان 2009 وترأسها القاضي فرانسين ووجّه خلالها أمراً إلى السلطات القضائية اللبنانية بفكّ احتجاز اللواءين جميل السيد وعلي الحاج والعميدين ريمون عازار ومصطفى حمدان بسبب «عدم صدقية المعلومات» التي احتُجزوا على أساسها. وكانت السلطات القضائية اللبنانية قد سجنت الضبّاط بموجب توصية من رئيس لجنة التحقيق الدولية ديتليف ميليس.
وكان رئيس المحكمة الدولية القاضي أنطونيو كاسيزي قد وجّه أمراً إلى السلطات اللبنانية في 21 نيسان 2009 لتحسين ظروف احتجاز الضباط الأربعة أثناء وجودهم في «مبنى شعبة المعلومات» في السجن المركزي في رومية، بينما لا وجود في قانون تنظيم السجون اللبنانية (المرسوم 14310/49) لمبنى كهذا ولا وجود لـ«شعبة» معلومات في قانون تنظيم قوى الأمن الداخلي (القانون 17/90).

قياديان في تمرد دارفور يمثلان أمام محكمة لاهاي بتهمة ارتكاب «جرائم حرب»
أمستردام - أ ب - قال رجلان متهمان بجرائم حرب مرتبطة بالهجوم الدموي ضد قوات السلام الافريقية في دارفور عام 2007، أمام المحكمة الجنائية الدولية في لاهاي أمس إنهما ثوريان ومستعدان لمواجهة العدالة.
ومثل عبدالله باندا أباكير نورين وصالح محمد جربو جاموس أمام المحكمة الجنائية أمس بعد يوم واحد من وصولهما طوعاً إلى هولندا حيث سلّما نفسيهما إلى المحكمة في لاهاي. ويقول المدعون إن 12 من أفراد قوات السلام الافريقية قُتلوا و8 جرحوا في الهجوم الذي استهدف قاعدتهم في حسكنيتة، في إقليم دارفور (غرب السودان)، وهو الحادث الذي دفع بالاتحاد الافريقي إلى تجميد مهمة قوات السلام في الإقليم الذي يشهد تمرداً منذ العام 2003. وإذا ما وصلت قضيتهما إلى مرحلة المحاكمة، فإن ذلك سيكون أول اختبار للقانون الدولي الذي يقول إن مهاجمة قوات سلام غير قتالية يُعتبر جريمة حرب.
والرجلان متهمان بقيادة مجموعة من ألف متمرد هاجموا قاعدة القوات الافريقية في أيلول (سبتمبر) 2007. ونهب المهاجمون من القاعدة 17 سيارة وثلاجات وأجهزة كومبيوتر وهواتف جوالة وذخائر وأموالاً.
وقرأ مسجّل المحكمة اتهامات ضد الرجلين بارتكاب جرائم حرب مرتبطة بالقتل والهجوم ضد قوات حفظ السلام والنهب.
وعندما طُلب من باندا أن يؤكد هويته ومهنته رد قائلاً: «أنا ثوري». واضاف أمام الجلسة التي دامت 90 دقيقة: «إنني مع الحق والعدالة، لأنني اؤمن بالعدالة».
وحددت القاضية البرازيلية سيلفيا ستاينر يوم 22 تشرين الثاني (نوفمبر) المقبل موعداً لبدء جلسات يتم فيها تحديد هل لدى الإدعاء ما يكفي من أدلة لبدء المحاكمة.
وأصدرت المحكمة الجنائية أوامر اعتقال في حق الرئيس السوداني عمر البشير وشخصين آخرين لهما علاقة بالحكومة السودانية في شأن اتهامات بارتكاب جرائم حرب في دارفور. ورفض الثلاثة المثول أمام المحكمة، لكن الرئيس البشير اضطر إلى تقليص حركته خارج السودان خشية توقيفه.
ودعا باندا في بيان قصير أمام القاضي «جميع الذين استدعتهم المحكمة إلى المجيء إلى هنا لتبرئة أنفسهم». وكرر الموقف نفسه جربو أيضاً.

التبليغات السوريـة فـي قضيـة السيـد مجـدداً:
سبـاقٌ بيـن المذكـرات الغيابيـة والتسويـة المؤجلـة

مضى شهرٌ ونصف الشهر على استلام قاضي التحقيق الأوّل في بيروت غسان عويدات تبليغات قاضي التحقيق الأوّل في دمشق في الدعوى المقدّمة من المدير العام السابق للأمن العام اللواء الركن جميل السيد بحق كل من ارتكب جرم «فبركة وتسويق شهود الزور والتسبب بإعتقال سياسي تعسفي»، وبينهم شخصيات سياسية ونيابية وقضائية وإعلامية لبنانية. ويبدو أن قاضي التحقيق الأول، يعيش سباقاً بين احتمالين لا ثالث لهما؛ فإما أن تتحوّل هذه التبليغات إلى مذكرات توقيف غيابية سيكون لها انعكاسات وتداعيات خطيرة، في حال عدم قيام عويدات بالإجراءات الواجب اتباعها، وتبليغ أصحاب العلاقة مضمون المذكرات ليبنى على كل حالة، ما يجب بناؤه قانوناً.
وإما انتظار التسوية السياسية التي لا يزال وزير العدل الدكتور إبراهيم نجار يأمل بها ومدعي عام التمييز القاضي سعيد ميرزا.
وأوضحت مصادر قانونية متابعة لـ«السفير» أن التبليغات الجديدة التي تسلّمها عويدات، جاءت بمثابة رد مباشر على المطالعة القانونية الأخيرة للنائب العام التمييزي القاضي سعيد ميرزا والتي اعتبر فيها أن القضاء السوري ليس لديه الاختصاص ولا الصلاحية للنظر في هذه «القضية»، كونها حصلت على الأراضي اللبنانية، وكون بعض المتهمين بارتكابها هم ممن لديهم حصانات نيابية أو وظيفية.
في المقابل، يبدو أن القضاء السوري استعاض عن الرد بمطالعة قانونية على مطالعة القاضي ميرزا أكد فيها حقه في إرسال التبليغات تأكيداً منه على حقه في استدعاء كل من يشتبه في أنه كان شريكاً في جريمة ارتكبها مواطن سوري على الأراضي السورية أو خارجها، لا سيما أن القانون السوري يسمح بملاحقة شهود الزور السوريين أينما ارتكبوا جريمتهم، وبالتالي وبحسب الأعراف الجزائية المعتمدة دولياً، فإن مجرد وجود هذه الصلاحية للقضاء السوري على مواطنيه، يعني أنه الجهة الصالحة لملاحقة باقي الشركاء إلى أي جنسية انتموا بصرف النظر عن مكان وقوع الجرم. وترى المصادر نفسها أن دفع ميرزا الشكلي في موضوع «الحصانة» مخالف للقوانين الدولية التي لا تعترف إلا بحصانة واحدة هي الحصانة الدبلوماسية، فبحسب اتفاقية جينف، فإن الحصانة تطبق على الدبلوماسي المعتمد في بلدٍ ما في حال ارتكابه جريمة البلد المعتمد لديه، أما إذا ارتكب الدبلوماسي جرماً في بلد آخر غير معتمد لديه، فلا حصانة له. وسط هذه المعطيات، يبدو أن موقف عويدات يزداد تعقيداً بحيث إنه مضطرٌ للتعامل مع هذه التبليغات بصورة قانونية ولا يمكنه بالتالي الانتظار طويلاً إلى حين «نضوج الحل السياسي» بحسب ما تمنى عليه مرجع قضائي معني. وتشير المصادر إلى أن هذا التمني يعتبر مخالفاً للأصول القانونية ومسّاً باستقلالية القضاء باعتبار أن القاضي يملك سلطة مستقلة عن وزير العدل وعن مدعي عام التمييز. وتخشى المصادر أن تتحول هذه القضية إلى شكوى لدى هيئة التفتيش القضائي إذا استمر واقع شراء الوقت وانتظار الحلول السياسية.
هل يمكن هذه القضية أن تجد لها مكاناً في الأجواء الإيجابية المستجدة بين لبنان وسوريا؟
تقول مصادر مطلعة متابعة لهذا الملف إن القيادة السورية، أبلغت عددا من المسؤولين اللبنانيين ممن فاتحوها في هذا الموضوع مؤخراً «بأن الموضوع لبناني - لبناني والحل والربط بيد اللواء السيد».
هل نشهد مبادرة ما تجاه اللواء السيد لحمله على التراجع عن الدعوى المقامة أمام القضاء السوري أم سيكون لهذا الملف فصول جديدة قد نشهد بعض تطوراتها بين بيروت ودمشق ولاهاي قريباً؟

June 10, 2010 - Daily Star - Hizbullah to sue magazine for Hariri killing claims - reports

BEIRUT: Hizbullah has commenced legal proceedings against a German magazine which claimed the party was behind the killing of former Premier Rafik Hariri, according to media reports this week.


Lebanese daily Al-Akhbar, quoting Hizbullah legal representatives, reported Tuesday that they had asked authorities to bring lawsuits against Der Spiegel and the journalists who worked on the publication’s report which implicated Hizbullah members in Hariri’s assassination and claimed it represented a state within a state.


“The article published in Der Spiegel clearly accuses Hizbullah of assassinating Rafik Hariri and this is a crime punishable by death according to the Lebanese penal code,” Al- Akhbar quoted a Hizbullah lawyer as saying.


The legal source said that witnesses from the UN’s Special Tribunal for Lebanon (STL) – the international court established to try Hariri’s killers – should be made to testify, as Der Spiegel’s report was based on information leaked from tribunal sources.


The report, according to lawyers, was “a crime of slander and an insult to Hizbullah,” and consisted of “fabricating false facts based on the defendants’ imagination.”


The STL itself was guilty of “a blatant defiance of the international justice that was hoped for, whether the leaked information is revealed to be true of false,” the legal source added.


Five-time Premier Hariri was killed along with 22 others when a car bomb obliterated his motorcade as it made its way along Beirut’s seafront on in 2005. Blame for the attack has been laid by many at Syria’s door, although Syria has repeatedly denied any involvement.



The STL has yet to bring charges against any individual.


Al-Akhbar quoted Hizbullah’s legal source as calling for the STL to remain vigilant in safeguarding against “similar slander from suspected media outlets aiming at creating internal divide in the country.”


The source added that STL prosecutors possessed large amounts of evidence that could prevent future allegations from being speculated upon.


Also Wednesday, the STL’s press office denied Lebanese media reports that the legal assistant of Prosecutor Daniel Bellemare had resigned from his post early this month.


As-Safir reported that Bernard Cote had quit the tribunal for unspecified reasons.


But STL spokesperson Fatima Al Issawi told The Daily Star that Cote had in fact retired. “[Cote] had reached an age where he felt it was the time to return to Canada to be with his family,” she said. “He had discussed the matter with the prosecutor several months ago.”


As-Safir claimed Cote’s departure took place in secrecy, an assertion which Issawi refuted. “There is nothing secret concerning his departure. The vacancy announcement had been on the website for several weeks,” she said. “The staffing process to replace him is well advanced and should be completed in the next few weeks.”


The STL has suffered high-profile resignations since its inception, including Bellemare’s spokesperson Radhia Ashouri and Nick Kaldas, head of investigations for the Office of the Prosecutor until January 2010.

Le Tribunal spécial pour le Liban vient de perdre, une fois de plus, un de ses acteurs-clés. En effet, François Côté, l'expert juridique qui servait pratiquement de bras droit au procureur du TSL, Daniel Bellemare, vient de rendre son tablier, « ayant atteint l'âge de la retraite », affirme-t-on officiellement au TSL. Ce nouveau départ vient s'ajouter à une série de démissions qui ont commencé avec celle du greffier, Robin Vincent (juin 2009), suivie de cinq autres Suzan Khan (août 2009), Howard Morrison (août 2009), David Tolbert (septembre 2009), Nick Kaldas ( janvier 2010), Radhia Achouri (mai 2010).
En regardant de plus près les démissions en série, il serait tout d'abord opportun de rappeler que la majorité des personnes qui ont renoncé à la poursuite de leur mission au sein du TSL n'est liée ni de près ni de loin au travail d'investigation du procureur. Si l'on en croit une source informée au sein de cette instance, Daniel Bellemare serait, aux côtés d'une « infime minorité » de responsables au sein du TSL, le seul à connaître les rouages et l'ensemble des détails de l'enquête devant aboutir à la publication d'un acte d'accusation.

Par conséquent, rien ne sert de parler de politisation lorsqu'il s'agit d'analyser les raisons de la démission des deux greffiers, dont la tâche n'a rien à voir avec celle du procureur. Certes, des informations avaient filtré sur une éventuelle mésentente due à une incompatibilité de caractère entre le procureur et le premier greffier Robin Vincent. Les divergences auraient porté sur une question qui a trait à une répartition de ressources financières, notamment au profit du bureau du procureur. Ce n'est pas le cas pour son successeur David Tolbert, dont le procureur et le reste de l'équipe ont accepté la démission à contrecœur. David Tolbert a quitté en effet pour une position bien plus alléchante professionnellement, ayant été nommé directeur de l'ICTJ ( Centre international pour la justice transitionnelle).
Il n'est point besoin d'élaborer non plus sur la démission de Suzan Khan, l'ancienne porte-parole du TSL et dont la fonction n'est aucunement en relation avec celle du procureur. Quant au juge Howard Morrisson, sa mutation auprès du Tribunal international pour l'ex-Yougoslavie avait été décidée par le secrétaire général des Nations unies, Ban Ki-moon, ce qui laisse peu de place à une interprétation autre que celle d'une meilleure opportunité de travail.
Sur les sept démissions, il reste évidemment celles qui sont directement liées au bureau du procureur, à savoir celles de Nick Kaldas, Radhia Achouri et François Côté, et qui pourraient être liées ou non au travail du procureur.
Selon une source informée au sein du tribunal, Radhia Achouri, qui a servi durant plus d'un an comme porte-parole de Daniel Bellemare, aurait également été attirée par une opportunité de travail plus intéressante au sein de l'ONU. Si l'on en croit les indications répétées de plusieurs membres du TSL, Mme Achouri n'avait jamais été mise au courant des détails de l'enquête. Par conséquent, précisent les sources, « toutes les accusations lancées contre cette dernière dans la presse sur son éventuelle implication dans les fuites qui auraient été faites au Der Spiegel sont infondées, car elle ne sait rien ».
Ce n'est probablement pas le cas d'un Nick Kaldas qui était le chef du bureau d'enquête et qui devait en toute logique être au courant de certains détails du dossier. Il en est de même pour François Côté - un ancien ami de Bellemare, et son conseiller juridique au TSL - dont le départ pourrait effectivement être motivé par des raisons personnelles, la porte-parole du TSL, Fatwek Issawoui, ayant précisé que son départ à la retraite avait été prévu il y a plusieurs mois par le procureur.
Il reste qu'il serait utile d'établir un parallèle avec le Tribunal spécial pour l'ex-Yougoslavie qui a connu tout autant de démissions au niveau des postes les plus importants sans que cela n'affecte pour autant la poursuite de ses activités.
