BEIRUT: The Special Tribunal for Lebanon announced the appointment of Marten Youssef as its new spokesperson Tuesday.
According to a statement released by the Netherlands-based court, Youssef, who was born and raised in Egypt, is a Canadian citizen.
The new spokesperson has worked as a journalist in the Middle East and Africa, as well as in Canada.
During his three years in Abu Dhabi, Youssef worked as the senior courts and justice reporter for the English-language The National newspaper.
As spokesperson, Youssef will be the point of contact for all members of the Lebanese and Arab press. He will speak on behalf of STL’s Chambers, the Defense Office and the Registry.
The STL was established in 2009 to probe the 2005 assassination of former Prime Minister Rafik Hariri and 22 others in a massive car bomb in Beirut.
Chief of Public Affairs Crispin Thorold will be in charge of assisting the international media on questions related to Chambers, the Defense Office and the Registry, while Sophie Boutaud de la Combe will answer questions relating to the work of the Office of the Prosecutor.
The U.N.-backed court has been at the root of a conflict between the Hezbollah-led March 8 coalition and the March 14 alliance, which is headed by Hariri’s son, caretaker Prime Minister Saad Hariri. The court’s indictment is widely expected to implicate Hezbollah members in the assassination but the party has denied any involvement and slammed the court as an “Israeli project,” aimed at sowing civil strife. – The Daily Star

The Special Tribunal for Lebanon (STL) has appointed Marten Youssef as its spokesperson, the tribunal’s website said on Tuesday.
“Marten, who was born and raised in Egypt, is a Canadian citizen. He has worked as a journalist in the Middle East and Africa, as well as in Canada,” the website said.

Le TSL publie le code de conduite professionnelle des conseils plaidant devant le tribunal
Le président du Tribunal spécial pour le Liban, le juge Antonio Cassese, a publié hier le code de conduite professionnelle des conseils plaidant devant le tribunal. Établi en application de l'article 60 C du Règlement de procédure et de preuve, ce code constitue le cadre de référence pour les avocats de l'accusation et les conseils de la défense, ainsi que pour les représentants légaux des victimes participant aux procédures devant le tribunal.
Le président du Tribunal spécial pour le Liban, le juge Antonio Cassese, a rendu public le code de conduite professionnelle des avocats plaisant devant le tribunal. Dans son introduction, le président Cassese précise que le code « s'applique à tous les conseils plaidant devant le tribunal, y compris les conseils agissant devant le tribunal pour le compte de l'accusation, de l'accusé, des victimes reconnues au sens du Règlement de procédure et de preuve, ainsi que les conseils qui, en raison des travaux qu'ils effectuent en dehors du prétoire, prêtent directement concours à leurs coconseils intervenant au prétoire et dont la conduite peut avoir une incidence sur l'intégrité et l'équité des procédures devant le tribunal ».
Avant d'accomplir tout acte relevant du champ d'application du présent code, le conseil prend, devant le greffier ou le greffier adjoint, l'engagement solennel suivant : « Je déclare solennellement que je remplirai mes devoirs et exercerai ma profession devant le Tribunal spécial pour le Liban avec intégrité et diligence, honorablement, librement, promptement et consciencieusement, et que je respecterai scrupuleusement le secret professionnel ainsi que les autres devoirs imposés par le code de conduite professionnelle des conseils auprès du tribunal. » Tous les conseils sont tenus de signer une version écrite de l'engagement solennel, que le greffe conserve dans le dossier, prévoit le code.
Concernant les principes qui régissent la conduite professionnelle, le code précise les règles suivantes :
« Dans les limites du mandat qui lui est confié dans le cadre de la procédure, le conseil se conduit avec professionnalisme et dans le respect de la loi, des règlements et de la déontologie de la profession ; il agit avec intégrité, honnêteté et courtoisie ; il préserve l'honneur et la dignité de la profession ; il agit d'une manière qui soit compatible avec le droit de l'accusé à un procès équitable ; il respecte les droits de l'homme et promeut la primauté du droit ; il contribue aux efforts du tribunal visant à rendre justice dans le respect du droit, en évitant notamment tout acte ou toute déclaration susceptible de tromper le tribunal ou de l'induire en erreur. Il est qualifié, informé, expert et compétent au regard du droit applicable et est au courant de l'évolution des questions juridiques pertinentes.
Par ailleurs, le conseil veille résolument, diligemment, promptement et dans toute la mesure de ses moyens aux intérêts de la partie qu'il représente, dans les limites du droit applicable et des dispositions du présent code et eu égard à ses devoirs envers le tribunal, les autres conseils et l'administration de la justice. Le conseil ne permet pas sciemment qu'un faux témoignage soit rendu devant le tribunal. Il veille, dans ses fonctions de conseiller et de représentant des parties, à éviter tout conflit d'intérêts. Si un conflit d'intérêts surgit ou est porté à sa connaissance, le conseil en avertit immédiatement les parties susceptibles d'en subir les effets ainsi que le tribunal. Lorsque la loi l'y autorise, le conseil ne peut poursuivre temporairement sa représentation dans une affaire comportant un conflit d'intérêts qu'après en avoir dûment informé les parties concernées et obtenu leur consentement avisé, et seulement sur approbation expresse de la chambre compétente. Le conseil préserve le secret professionnel des communications avec son client et protège la confidentialité des éléments de preuve et des actes de procédure identifiés comme tels par le tribunal. Sauf décision expresse de la chambre compétente, le conseil ne peut divulguer des dépositions confidentielles qu'aux personnes tenues, en vertu de la déontologie ou d'obligations contractuelles, d'en protéger la confidentialité et seulement si cette divulgation est nécessaire aux investigations ou à la préparation de la cause. »
Le texte définit en outre le rôle du conseil dans la conduite du procès, les responsabilités du conseil principal et du coconseil, les rapports, la coopération, notamment sur les questions de calendrier et les modes de communication avec les autres conseils. Il évoque également la prise en compte des demandes faites par les autres conseils, le comportement portant atteinte à la coopération entre conseils, les propos tenus au sujet des autres conseils, le comportement pendant l'interrogatoire des témoins, les rapports du conseil avec les juges, les communications avec les autres personnes ainsi qu'avec les médias. Sur ce dernier point, le code prévoit que le « conseil indique clairement, en particulier lorsqu'il s'engage à prendre la parole en public, qu'il ne représente pas le Tribunal spécial pour le Liban dans son ensemble. Au-delà des restrictions supplémentaires que peut ordonner, le cas échéant, le juge de la mise en état ou une chambre, le conseil s'abstient de toute déclaration publique mentionnant des informations ou documents concernant les procédures devant le tribunal, ni ne publie ladite déclaration ou n'aide à sa publication ou diffusion, dès lors qu'elle est fausse, décrit avec inexactitude la situation ou la position des autres conseils, d'une autre partie à la procédure, d'un organe du tribunal spécial ou de tout autre personne ayant des liens avec celui-ci ; et ne respecte pas la présomption d'innocence ou divulgue des informations confidentielles.
En cas de doute, le conseil consulte les fonctionnaires en service auprès des chambres ou des juges, le cas échéant, avant de faire toute déclaration relative à une affaire dont le tribunal est saisi ».
Le texte définit enfin le comportement du conseil pendant le procès et la procédure applicable en cas de violation du code.
